HomeMy WebLinkAboutReso 2791-1959RESOLUTION NO. 2791 A RESOLUTION DETERMINING TO UNDERTAKE PROCEEDINGS PURSUANT TO SPECIAL ASSESSMENT AND ASSESSMENT BOND ACTS FOR THE CONSTRUCTION OF I~PROVEMENTS WITHOUT PROCEEDINGS UNDER DIVISION 4 OF THE 'STREETS AND HIGHWAYS CODE INDUSTRIAL PARK UNIT NO. 2-C - ZONE 2. RESOLVED, by the City Council of the City of South San Francisco, California, that WHEREAS, all of the owners of more than 60% in area of the property subject to assessment therefor have signed and filed with the City Clerk of this City a written peti- tion for undertaking proceedings pursuant to special assessment and assessment bond acts, and to assess the costs thereof upon the properties benefited by the acquisitions and im- provements, and waiving proceedings under 'Division 4 of the Streets and Highways Code, for the acquisitions and improvements hereinafter described; WHEREAS, the costs and expenses of said contemplated acquisitions and improvements are to be chargeable upon an assessment district, the exterior boundaries of which are the coterminous exterior boundaries of the composite and consolidated area consisting of Lots 17 through 24, Block 3, Lots 17 and 18, Block 10, Lots 1 through 3 and Lot 10, Block 13, and Lots 9 through 12, Block 14, as shown on the map of South San Francisco Industrial Park Unit No. 2-C on file in the office of the City Clerk; WHEREAS, the public interest and convenience will be served by the taking of said proceedings; WHEREAS, said acquisitions and improvements are described as follows: (a) The grading of the area within the assessmen~ district,, including sloping for the proper drainage of the area of the district and for the protection of the streets to be constructed therein from overftow by water. Easements are hereby granted to the City of South San Francisco for said purposes for the period of construction, at the expiration of which time they shall term- in~te without further action by either party. (b) The improving of Utah Avenue from (center line) 505.89 feet west of Little- field Avenue to 291 feet east of Rozzi Way, and Littlefield Avenue from (center line) 647.92 feet north of Utah Avenue to 300 feet south of Utah Avenue, as shown on the Map of South San Francisco Industrial Park Unit No. 2-C, by the construction therein of 8 inches of untreated base pavement and 3 inches of plant mix surfacing, and Portland cement con- crete curbs, gutters and sidewalks, (c) The construction in said streets of reinforced Portland cement concrete cul- vert pipe and corrugated metal pipe storm drains with standard catch basins and outlet structure. (d) The installation in said streets of asbestos concrete sewer mains with stan- dard manholes, cleanouts and appurtenant structures. (e) The construction in said streets of a fire alarm system complete including conduit, boxes and connection to City system, and also street signs and street barricades. (f) The acquisition of all lands, easements, facilities and work relating or auxiliary to any of the above and necessary to complete the same. NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED and ORDEREDthat all of the owners of more than 60% in area of the property subject to assessment for said proposed acquis- itions and improvements have filed with the City Clerk of this City a written petition for the acquisition and construction of improvements pursuant to appropriate special assess- merit and assessment bond acts, without further compliance with the provisions of Division 4 of the Streets and Highways Code. IT IS FURTHER FOUND, DETERMINED and ORDERED that said proceedings for the acquis- ition and construction of said improvements shall be had pursuant to the Municipal Improve- ment Act of 1913 and the bonds upon the unpaid assessments thereof shall be issued pursuant to the Improvement Bond Act of 1915. IT IS FURTHER FOUND, DETERMINED and ORDERED that the provisions of Division 4 of the Streets and Highways Code be, and they are hereby, dispensed with. I hereby certify that the foregoing resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meet.ing held this 18th day of May, 1959, by the following vote: AYES, Councilmen Andrew Rocca, G.
