HomeMy WebLinkAboutReso 2792-1959RESOLUTION NO. 2792 A RESOLUTION OF INTENTION TO ACQUIRE AND CONSTRUCT IMPROVERENTS AND TO ANNEX THE ASSESSMENT DISTRICT AREA TO THE INDUSTRIAL PARK UNIT NO. 2-C GRADING MAINTENANCE DISTRICT INDUSTRIAL .PARK UNIT NO. 2-C - ZONE 2 RESOLVED, by the City Council of the City of South San Francisco, California, that in its opinion the public interest-and convenience require, and that it is the intention of said Council to order the acquisitions and improvements hereinafter des- cribed: 1. Whenever any public way is referred to as running between two public ways, or from or to any public way, the intersections of the public ways referred to are cluded to the extent that work .shall be shown on the plans to be done therein. ~' 2. Said streets and highways are more particularly shown in the records in the office of the County Recorder of San Rateo County, California, and shall be shown upon the plans herein referred to to be filed with the City Clerk of said City. 3. All of said work and improvements are to be constructed at the places and in the particular locations, of the forms, sizes, dimensions and materials, and at the lines, grades and elevations as shown and delineated upon the plans, profiles and spec- ifications to be made therefor, as hereinafter provided. 4. There is to be excepted from~ the work herein described any of such work already done to line and grade and marked excepted or shown not to be done on said plans, profiles and specifications. 5. Notice is hereby given of the fact that in many cases said work and im- provement will bring the finished work to a grade different from that formerly exist- ing, and that to said extent said grades are hereby changed and that said work will be done to said changed grades. 6. The acquisitions and improvements, are described as follows: (a) The grading of the area within the assessment district, including sloping for the proper drainage of the area of the district and for the pro- tection of the streets to be constructed therein from overflow by water. · Easements are hereby granted to the City of South San FrancisCo for said purposes for the period of construction, at the expiration of which time they shall terminate without further action by either party. (b) The improving of Utah Avenue from (center lin.e) 505.89 feet west of Littlefield Avenue to 291 feet east of Rozzi Way, and Littlefield Avenue from (center line) 647.92 feet north of Utah Avenue to 300 feet south of Utah Avenue, as shown on the Rap of South San Francisco Industrial Park Unit No. 2-C, by the construction therein of 8 inches of untreated base pavement and 3 inches of plant mix surfacing, and Portland cement concrete curbs, gutters and sidewalks. (c) The construction in said streets of reinforced Portland cement con- crete culvert pipe and corrugated metal pipe storm drains with standard catch basins and outlet structure. (d) The installation in said streets of asbestos concrete sewer mains with standard manholes, cleanouts and appurtenant structures. (e) The construction in said streets of a fire alarm system complete in- cluding conduit, boxes and connection to City system, and also street signs and street barricades. (f) The acquisition of all lands, easements, facilities and work relat- ing or auxiliary to any of the above and necessary to complete'the same. 7. Said Council does hereby adopt and establish as the official grades for said work the grades and elevations to be shown upon said plans, profiles and specifica- tions. All such grades and elevations are to be in feet and decimals thereof wi~h ref- erence to the datum plane of the City of South San Francisco. 8. The descriptions of the acquisitions and improvements and the termini of the work contained in this Resolu~on are general in nature. All itemg of work do not necessarily extend for the full length of the description thereof. The plans and rOfiles of the' work and the map and descriptions of the acquisitions, as contained n the Engineer's report, shall be controlling as to the correct and detailed descrip- tion thereof. 9. Said contemplated acquisitions and improvements, in the opinion of the Council, are of more than local or ordinary public benefit and said Council does hereby make the costs and expenses thereof chargeable upon an assessment district, which dis- trict said Council declares to be the district benefited thereby, the exterior boun- daries of which district are the coterminous exterior boundaries of the composite and consolidated area consisting of Lots 17 through 24, Block 3, Lots 17 and 18, Block 10, Lots 1 through 3 and Lot 10, Block ~, and Lots 9 through 12, Block 14, as shown on the map of South San Francisco Industrial Park Unit No. 2-C on file in the office of the City Clerk. 10. Said Council further declares that all public streets and highways within said assessment district in use in the performance of a public function as such shall be omitted from the assessment hereafter to be made to cover the costs and expenses of said acquisitions and improvements. RESOLUTION NO. 2792 (CONTINUED) : 11. Notice is hereby given that s~rial bonds to represent the~unpaid assess- ments, and bear interest at the rate of not to exceed six per cent (6%) per annum, will be issued hereunder in the manner provided in the Improvement Bond Act of'1915, Division 10 of the Streets and Highways Code, the last installment of which bonds shall mature not to exceed twenty-four years from the second day of July next succeeding ten months from their date. 12. Except as herein otherwise provided for the issuance of bonds, all of said acquisitions and improvements shall be made and done pursuant to the provisions of the Municipal Improvement Act of 1913, as amended. 13. Reference is hereby made to proceedings had pursuant to Division 4 of the Streets and Highways Code on file in the office of the City Clerk. 14. Said proposed acquisitions and improvements are hereby referred to the Engineer of Work, he being a competent person employed by said Council for that purpose; and said Engineer of Work is hereby directed to make and file with the City Clerk of this City a report in writing, presenting the following: (a) Maps and descriptions of the lands and easements to be acquired; (b) Plans and specifications of the proposed improvements to be made pursuant to this Resolution; (c) Engineer's statement of the itemized and total es~imated costs and expenses of said acquisitions and improvements and of the incidental expenses in connection there- with; (d) Diagram showing the assessment district above referred to, and also the boundaries and dimensions of the respective~subdivisions of land within said district as the same existed at the time of the passage of this Resolution of Intention, each of which subdivisions shall be given a separate number upon said diagram; (e) A proposed assessment of the total amount of the costs and expenses of the proposed acquisitions and improvements upon the several subdivisions of land in said dis- trict in proportion to the estimated benefits to be received by such subdivisions, res- pectively, from said acquisitions and improvements, and of the expenses incidental thereto. 15. If any excess shall be realized from the assessment it shall be spent for the maintenance of said acquisitions and improvements, unless the Council shall hereafter determine that said amount or any part thereof shall be applied as a credit to each assess- ment herein. 16. NOTICE IS HEREBY.GIVEN that, in the opinion of this Council, the areas con- tained within said proposed assessment district are the properties which will be benefited by the maintenance and operation~of the grading, including sloping for the proper drainage of the area of the district and for the. protection of the streets to be constructed therein from overflow by water, and that the public interest and convenience require, and that it is the intention of this Council to annex said area to the Industrial Park Unit No. 2-C Grading Maintenance District under and pursuant to Chapter 26 of Part 3 of Division 7 of the Streets and Highways Code, for the purpose of maintaining and opera~ng said grading facilities to be constructed hereunder and any additions, improvements and enlargements thereto which may hereafter be made, and that a hearing will be had on said matter by this Council at the same time as the hearing on said report, at which time any and all persons interested may be heard.
