HomeMy WebLinkAboutReso 2829-1959RESOLUTION NO. 2829 A RESOLUTION DETERMINING TO UNDERTAKE PROCEEDINGS PURSUANT TO SPECIAL ASSESSMENT AND ASSESSMENT BOND ACTS FOR THE CONSTRUCTION OF IMPROVEMENTS WITHOUT PROCEEDINGS UNDER DIVISION 4 OF THE STREETS AND HIGHWAYS CODE - INDUSTRIAL PARK UNIT NO. 2-C, ZONE 3' RESOLVED, by the City Council of the City of South San FranciscO, California, that WHEREAS, all of the owners of more than 60% in area of the property subject to assessment therefor have signed and filed with the City Clerk of this City a written petition for undertaking proceedings pursuant to special assessment and assessment bond acts, and to assess the costs thereof upon the properties benefited by the acquisitions and improvements, and waiving proceedings under Division 4 of the Streets and Highways Code, for the acquisitions and improvements hereinafter described; WHEREAS, the costs and expenses of said contemplated~luisit~nsand imIrove~en~ al to be chargeable upon an assessment district, the exterior boundaries of which are the co- terminous exterior boundaries of the composite and consolidated area consisting of Lots 6 to 16, inclusive, Block 10, Lots i to 18, inclusive, Block 11, Lots I to 12, inclusive, Block 12 and Lots 4 to 9, inclusive, Block 13, as shown on the map of South San Francisco Industrial Park Unit No. 2-C on file in the office of the City Clerk; WHEREAS, the public interest and convenience will be served by the taking of said proceedings; WHEREAS, said acquisitions and improvements are described as follows: (a) The grading of the area within the assessment district, including sloping for the proper drainage of the area of the district and for the protection of the streets to be oonstructed therein from overflow by water. Easements are hereby granted to the City of South San Francisco for said pur- poses for the period of construction, at the expiration of which time they shall terminate without further action by either party. (b) The improving of Harris Avenue from 460 feet west of Littlefield Avenue to 660 feet east of Littlefield Avenue~ Littlefield Avenue from East Harris Avenue to 350 feet south of Lawrence Avenue, and Lawrence Avenue in its entirety, as shown on the Map of South San Francisco Industrial Park Unit No. 2-C, by the construction therein of 8 inches of untreated base pavement and 3 inches of plant mix surfacing, and Portland cement concrete curbs, gutters and sidewalks. (c) The construction in said streets of reinforced Portland cement concrete culvert pipe and corrugated metal pipe storm drains with standard catch basins and outlet structure. 406 RESOLUTION NO. 2829 (CONTINUED) (d) The insta:llation in said streets of asbestos concrete sewer:mains with standard manholes, cleanouts and appurtenant structures. (e) The construction in said streets of a fire alarm system complete including 'conduit, boxes and connections to City system, and also street signs and street barricades. (f) The acquisition of all lands, easements, facilities and work relat- ing or auxiliary to any of the above and necessary to complete the same. NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED and ORDERED that all of the owners of more than 60%.in area of the property subject to assessment for said proposed acquisitions and improvements have filed with the City Clerk of this City a written petition for the acquisition and construction of improvements pursuant to appropriate special assessment and assessment bond acts, without further com- pliance with the provisions of Division 4 of the Streets and Highways Code. IT IS FURTHER FOUND, DETERItINED and ORDERED that.said proceedings for the acquisition and construction of said improvements shall be had pursuant to the Municipal Improvement Act of 1913 and the.bonds upon the unpaid assessments thereof shall be issued pursuant to the Improvement Bond Act Of 1915. IT IS FURTHER FOUND, DETERIlNED and ORDERED that the provisions of Div- ision 4 of the Streets and Highways Code be~and they are hereby, dispensed with. I hereby certify that the foregoing resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held this 6th day of July, 1959, by the following vote: AYES, Councilmen Andrew Rocca, G.
