HomeMy WebLinkAboutReso 3105-1960CITY CLERK RESOLUTION NO. 3105 A RESOLUTION APPOINTING ENGINEER AND ATTORNEYS LOWRIE-BOTHIN-SWANSON PROJECT RESOLVED, by the City Council of the City of South San Francisco, California, WHEREAS, this Council has determined to undertake proceedings pursuant to appropriate special assessment and assessment bond acts for the acquisition and construcl and financing of public improvements in said City; ~HEREAS~ the public interest and general welfare will be served by appointing and employing engineers and attorneys for the preparation and conduct of said proceeding~ and work in connection with said acquisitions and improvements; NOW, THEREFORE, IT IS ORDERED, as follows: ' 1. That wilsey, Ham & Blair, Millbrae, California, be appointed and employed as Engineer of Work to do and perform all engineering work r~cessary in and for said pro- ceedings, including all preliminary surveying, preparation of plans, profiles, specifica- tions, estimate of costs, diagram, assessment, setting grade stakes, supervision of work, preparing, signing and filing the list of unpaid assessments, and that its compensation be, and it is hereby fixed, at the customary amount paid therefor by the City, to be assessed as an incidental expense of said proceedings. That the City Engineer of said Ci be authorized and directed to examine and approve said engineering documents, to provide the inspection during the progress of said work, and to accept said work when done to his satisfaction, and that the actual cost thereof shall be assessed upon said district as an incidental expense of said proceedings. 2. That the law firm of Kirkbride, Wilson, Harzfeld & Wallace, San Mateo, Cal- ifornia, be appointed and employed to do and perform all legal services required in the conduct of said proceedings, including the preparation of all papers, exclusive of print- ing, not required to be prepared by the Engineer, examining and approving the engineering documents and advising the engineers in the preparation of their work, advising all City off/c/als on all matters relating thereto when called upon, assisting in the sale of the bonds to be issued upon the unpaid assessments thereof, and furnishing their legal opinion as to the validity of said proceedings and bonds, and that their compensation be fixed at two percent (2%) of the cost of said acquisitions and improvements, exclusive of inciden- tal expenses, to be assessed as an incidental expense of said proceedings. I hereby certify that the foregoing resolution was regularly intro- duced and adopted by the City Council of the City of South San Francisco at a regular meeting held this 7th day of November, 1960, by the following vote: AYES, Councilmen Andrew Rocca, G.
