HomeMy WebLinkAboutReso 3106-1960160 RESOLUTION NO. 3106 A RESOLUTION OF INTENTION TO ACQUIRE AND CONSTRUCT IMPROVEMENTS LOWRI E-BOTHIN-SWANSON PROJECT RESOLVED, by the City Council of the City of South San Francisco, California, that in its opinion the public interest and convenience require and that it is the inten- tion of said Council to order the following acquisitions and improvements, to wit: 1. (a) The acquisition of a right of way for road and utility purposes, 60 feet wide, the center line of which is, generally, the westerly line of the San Bruno Road, now vacated, from within the northerly portion of the lands of Royce northerly to within the south- erly portion of the lands of Swanson, all westerly of the San Francisco Water Department right of way. (b) The acquisition of a right of way for road and utility purposes, 60 feet wide, from the northerly end of the right of way, in subsection (a) above, easterly to the new San Mateo Avenue, with cul-de-sac enlargement at the westerly end and curved returns at the easterly end. (c) The acquisition of a right of :way for road and utility purposes, 60 feet wide, from the southerly end of the right of way in subsection (a) above, easterly to the new San Mateo Avenue, with curved returns at the easterly end. (d) The improving of said rights of way by grading and the construction therein of 8 inches of untreated rock base pavement with 3 inches of plant mix surfacing and Portland cement concrete curbs and gutters, and sidewalk along the westerly side. (e) The construction of necessary catch basins and storm drains to convey storm water runoff to Colma Creek on the north and to the main drainge ditch to the south. (f) The construction of 5.5 feet by 8.5 feet reinforced concrete boxed cul- vert under the street near the south end. (g) The construction of two corrugated metal multi-plate arch culverts for protection of existing 44 inch San Francisco Water Department water line. (h) The relocation and/or alterations to existing utilities as required. (i) The acquisition of an interest in and a right of service from the im- provements to be acquired and/or constructed pursuant to Resolu~on of Intention No. 2771,.A Resolution of Intention to Acquire and Construct Improvements and to Form Grading Maintenance District, Person and Swanson Industrial Tract, adopted April 6, 1959, by the City Council of South San Francisco, as provided by that certain agreement dated June 1, 1960, and executed between Oscar F. Person and Marshall V. Swanson as First Parties, and Bothin Real Estate Com- pany, the Lowrie Paving Company, Inc., and Victor S. Swanson, as Second Parties, on file in the office of the City Clerk. (j) The making of all acquisitions and the doing of all work auxiliary to any of the above and necessary to complete the same. 2. Whenever any public way is herein referred to as running between two public ways, or from or to any public way, the intersections of the public ways referred to are included to the extent that work shall be shown on the plans to be done therein. 3. Said streets and highways are more particularly shown in the records in the office of the County Recorder of San Mateo County, California, and shall be shown upon the plans herein referred to and to be filed with the City Clerk of said City. 4. All of said work and improvements are to be constructed at the places and in the particular locations, of'the for~s, sizes, dimensions and materials~ and at the lines, grades and elevations as shown and delineated upon the plans, profiles and specifications to be made therefor, as hereinafter provided. 5. There is to be excepted from the work herein described any bf such work already done to line and grade and marked excepted or shown not to be done on said plans, profiles and specifications. 6. Notice is hereby given of the fact that in many cases said work and improve- ment will bring the finished work to a grade different from that formerly existing and that to said extent said grades are hereby changed and that said work will be done to said changed grades. 7. Said Council does hereby adopt and establish as the official grades for said work the grades and elevations to be shown upon said plans, profiles and specifications. All such grades and elevations are to be in feet and decimals thereof with reference to the datum plane of the City of South San Francisco. 8. The descriptions of the acquisitions and improvements and the termini of the work contained in this resolution are general in nature. All items of work do not necess- arily extend for the ~11 length of the description thereof. The plans and profiles of the work and maps and descriptions as contained in the Engineer's report, shall be control- ling as to the correct and detailed description thereof. 9. Said contemplated acquisitions and improvements, in the opinion of the Council, are of more than local or ordinary public benefit and said Council does hereby make the costs and expenses thereof chargeable upon an assessment district, which district said Council de- clares to be the district benefited thereby, the exterior boundaries of which district are the coterminous exterior boundaries of the composite and consolidated area of the lands of The Lowrie Paving Company, Inc., Bothin Real Estate Company and Victor S. Swanson lying be- tween the Southern Pacific Railroad right of way and the San Francisco Water Department right of way. 10. Said Council further declares that all public streets and highways within said assessment district in use in the performance of a public function as such shall be omitted from the assessment hereafter to be made to cover the costs and expenses of said acquisitions and improvements. Resolution No. 3106 (Continued): 11. Notice is hereby given that serial bonds to represent the unpaid assess- ments, and bear interest at the rate of not to exceed six per cent (6%) per annum, will be issued hereunder in the manner provided in the Improvement Bond Act of 1915, Division 10 of the Streets and Highways Code, the last installment of which bonds shall mature not to exceed fourteen (14) years from the second day of July next succeeding ten (10) months from their date. 12. Except as herein otherwise provided for the issuance of bonds, all of said improvements shall be done pursuant to the provisions of the Municipal Improvement Act of 1913. 13. Reference is hereby made to proceedings had pursuant to Division 4 of the Streets and Highways Code on file in the office of the City Clerk. 14. Said proposed acquisitions and improvements are hereby referred to the Engineer of Work~ being a competent person employed by said Council for that purpose; and said Engineer is hereby directed to make and file with the City Clerk,of said. City a report in'writing presenting the following: (a) Maps and descriptions of t~e lands and easements to be acquired; (b) Plans and specifications of the proposed improvements to be made pursuant to this Resolution of Intention; (c) Engineer's statement of t~e itemxzed and total estimated costs and expenses of said acquisitions and improvements and of the incidental expenses in connection therewith; (d) Diagram showing the assessment district above referred to, and also the boundaries and dimensions of the respective subdivisions of land within said district as the same existed at the time of the passage of this Resolution of Intention, each of which subdivisions shall be given a separate number upon said diagram; (e) A proposed assessment of the total amount of the costs and expenses of the proposed acquisitions and improvements upon the several subdivisions of land in said district in proportion to the estimated benefits to be received by such subdivisions, respectively, from said acquisitions and .improvements, and of the expenses incidental thereto. i5. If any excess shall be realized from the assessment it shall be spent for the maintenance of said acquisitions and improvements, unless the Council shall hereafter determine that said amount or any part thereof shall be applied as a credit to each assess- ment herein. I hereby certify that the foregoing resolution was regularly intro- duced and adopted by the City Council of the City of South San Francisco at a regular meeting held this 7th day of November, 1960, by the following vote: AYES, NOES, ABSENT~ Councilmen Andrew Rocca, G.
