HomeMy WebLinkAboutReso 3131-1961 RESOLUTION NO. 3131 A RESOLUTION DETERMINING TO UNDERTAKE PROCEEDINGS PURSUANT TO SPECIAL ASSESSMENT AND ASSESSMENT BOND ACTS ~OR THE ACQUISITION AND CONSTRUCTION OF IMPROVEMENTS WITHOUT PROCEEDINGS UNDER DIVISION ~ OF THE STREETS ANDHIGHWAYS CODE LITTLEFIELD AVENUE AND KIMBALL WAY RESOLVED, by the City Council of the City of South San Francisco, California, that WHEREAS, all of the owners of more than 60% in area of the prop- erty subject to assessment therefor have signed and filed with the City Clerk of this City a written petition for undertaking'proceedings pursuant to special assessment and assessment bond acts, and to assess the costs thereof upon the properties benefited by said improvements, and waiving proceedings under Division ~ of the Streets and Highways Code, for the following acquisitions and improvements: (a) The acquisition of land on either side of Littlefield Avenue between the North line of South San Francisco Industrial Park, Map No. 2-C, to East Grand Avenue for the widening of said street to approxi- mately sixty feet and improving of same by grading and the construc- tion thereon of eight inches of untreated rock base pavement with three inches of asphalt concrete wearing surfacing and Portland con- crete curbs and gutters, and a sidewalk along the West side, a storm drain pipe with catch basins and manholes, and monuments. (b) The acquisition.of a right-of-way for the extension of a cul-de-sac road, to be known as Kimball Way, approximately sixty feet · wide for a distance of about five hundred feet Southerly from East Grand Avenue generally along the private right-of-way along the West side of the lands of Swift & Co. approximately seven hundred forty feet Easterly of Littlefield Avenue described in (a) above, together with the construction thereon of grading, eight-inch untreated rock base pavement with three-inch asphalt concrete wearing surfacing, Portland concrete curbs and gutters, a sidewalk along the West side thereof, and a storm drainage pipe with catch basins and manholes and outlet structure, and monuments. (c) The acquisition of an easement Northerly of and parallel to the Northerly line of South San Francisco Industrial Park Map No. 2-C, from the Westerly side of Littlefield Avenue to South San Francisco Pumping Station No. 3 on the East side of said Kimball Way and the construction therein of a sanitary sewer main, manholes and appurten- ances. (4) The relocation of spur railroad trackage along the South side of the Southern Pacific Railroad right-of-way necessary to permit the crossing thereof by said two streets. (e) The making of all acquisitions and the doing of all work necessary to complete the ,above. 18' :1.'82 (RESOLUTION NO. 3131 · WHEREAS, the costs and expenses o~ said contemplated and improvements are to be cha_geable upon an assessmen~.~dl~r,~ct, the exterior boundaries of which are ~,cl~ibed' as follO~: Commencing at a point which is about three hundred forty feet Northerly of the Northeast corner of the lands shown on the map of South San Francisco Industrial Park, Unit No. 2-D; thence Westerly along the Southerly line of the 17.5 acre parcel of land of the Utah Construction · Mining Co. to Littlefield Avenue; thence Westerly and Northerly along the Southerly and Westerly line of said 17.5 acre · parcel; thence Northerly and Easterly along the Westerly and Northerly lines of the 3.5 acre p~rcel of land of the Utah Con- struction & Mining Co. to the Northeast corner thereof; thence Northerly and Easterly along the Westerly and Northerly lines of the 3.8 acre tract of the lands of Klestadt to a point about one hundred feet Westerly of the Northeast corner thereof; thence Northerly North sixty feet across the Southern Pacific Railroad trackage; thence Northeast about one hundred forty feet on a curve to the bend in Littlefield Avenue; thence North easterly along the Westerly side thereof to East Grand Avenue; thence Southeasterly along the Southwesterly line of East Grand Avenue to the Northeast corner of the 0.3 acre parcel of land of Humbert; thence Southwesterly along the Southeasterly line thereof to the Southeasterly corner; thence Southerly about one hundred sixty feet; thence Easterly along the Southerly line of the land of the Southern Pacific Co. to a point two hundred feet East of the proposed Kimball Way cul-de-sac; thence South to the South line of the lands of Swift & Co.; thence West along the South line of said lands to said proposed cul-de-sac; thence Southwesterly along said proposed cul-de-sac to the East line of the 17.5 acre tract of the lands of the Utah Construction & Mining Co.; thence Southerly along the East line of said parcel to the point of beginning; ex- cepting therefrom, the lands of the Southern Pacific Railroad Co., except the 0.1 acre triangular parcel on the West side of Little- field ~venue North of the lands of Klestadt; exclusive of the parcel transversing the lands of Klestadt. WHEREAS, the public interest and convenience will be served by the taking of said.proceedings; NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED and ORDERED that all of the owners of more than 60% in area of the property subject to assessment for said proposed acquisitions and improvements have filgd with the City Clerk of this City a written petition for the construc- tion of improvements pursuant to appropriate special assessment and assessment bond acts, without further compliance with the provisions of Division ~ of the Streets and Highways Code. IT IS FURTHER FOUND, DETERMINED and ORDERED that said proceedings for the construction of said improvements shall be had pursuant to the Municipal Improvement Act of 1913 and the bonds upon the unpaid assess- ...ments thereof shall be issued pursuant to the Improvement Bond Act of ~1915. IT IS FURTHER FOUND, DETERMINED and ORDERED that th~ provisions of Division 4 of the Streets and Highways Code be, and they'.are here- by, dispensed with. South San Francisco Industrial Park, Unit No. R-D; thence Westerly' along the Southerly line of the 17.5 acre parcel of land of the Utah Construction & Mining Co. to Littlefield Avenue; thence Westerly and North?rly along the Southerly and Westerly line of said 17.5 acre '-parcel; thence Northerly and Easterly along the Westerly and Northerly lines of the 3.5 acre p~rcel of land of the Utah Con- struction & Mining Co. to the Northeast corner thereof; thence Northerly and Easterly along the Westerly and Northerly lines of the 3.8 acre tract of the lands of Klestadt to a point about one hundred feet Westerly of the Northeast corner thereof; thence Northerly North sixty feet across the Southern Pacific Railroad trackage; thence Northeast about one hundred forty feet on a curve to the bend in Littlefield Avenue; thence North easterly along the Westerly side thereof to East Grand Avenue; thence Southeasterly along the Southwesterly line of East Grand Avenue to the Northeast corner of the 0.3 acre parcel of land of Humbert; thence Southwesterly along the Southeasterly line thereof to the' Southeasterly corner; thence Southerly about one hundred sixty feet; thence Easterly along the Southerly line of the land of the Southern Pacific Co. to a point two hundred feet East of the proposed Kimball Way cul-de-sac; thence South to the South line of the lands of Swift & Co.; thence West along the South line of said lands to said proposed cul-de-sac; thence Southwesterly along said proposed cul-de-sac to the East line of the 17.5 acre tract of the lands of the Utah Construction & Mining Co.; thence Southerly along the East line of said parcel to the point of beginning; ex- cepting therefrom, the lands of the Southern Pacific Railroad Co., except the O.1 acre triangular parcel on the West side of Little- field ~venue North of the lands of Klestadt; exclusive of the parcel transversing the lands of Klestadt. WHEREAS, the public interest and convenience will be served by the taking of said.proceedings; NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED and ORDERED that all of the owners of more than 60% in area of the property subject t° assessment for said proposed acquisitions and improvements have filqd with the City Clerk of this City a written petition for the construc- tion of improvements pursuant to appropriate special assessment and assessment bond acts, without further compliance with the provisions of Division $ of the Streets and Highways Code. IT IS FURTHER FOUND, DETERMINED and ORDERED that said proceedings for the construction of said improvements shall be had pursuant to the Municipal Improvement Act of 1913 and the bonds upon the unpaid assess- .~ ments thereof shall be issued pursuant to the Improvement Bond Act of 1915. IT IS FURTHER FOUND, DETERMINED and ORDERED that th~ provisions of Division ~ of the Streets and Highways Code be, and they are here- by, dispensed with.
