HomeMy WebLinkAboutReso 3210-1961RESOLUTION NO. 3210 A RESOLUTION DETERMINING TO UNDERTAKE PROCEEDINGS PURSUANT TO SPECIAL ASSESSMENT AND ASSESSMENT BOND ACTS FOR T~E ACQUISITION AND CONSTRUCTION OF IMPROVES WITHOUT PROCEEDINGS UNDER DIVISION ~ OF THE STREETS AND HIGHWAYS CODE--MILLER AVENUE AND WILLOW AVENUE IMPROV~NTPRO~T RESOLVED, by the.City Council of the City of South San Francisco, California, that WHEREAS, all of the owners of more than 60~ in area of the property subject to assessment therefor have signed and filed with the City Clerk of this City a written petition for undertaking proceedings pursuant to special assessment and assessment bond acts, and to assess the costs thereof upon the properties benefited by said improvements, and waiving proceedings under Division 4 of the Streets and Highways Code, for the following acquisitions and improvements: (a) The improving of Willow Avenue from Grand Avenue to Dolores Avenue by grading, removing trees, bushes and existing structures within the right of way that would interfere with the proposed improvements, constructing base pavement and wearing surface, constructing standard curb, gutter and sidewalks, including driveway aprons, constructing storm drainage facilities at Grand Avenue and installing street signs. (b) The acquisition of easements necessary to achieve a uniform width of 60 feet along Miller Avenue from Chestnut Avenue to Willow Avenue and the improving thereof by grading and the construction of base pavement and wearing surface and the construction of standard curbs, gutters and sidewalks. (c) The construction of sanitary sewer mains, wye branches, cleanouts and manholes and appurtenances in Willow Avenue from Miller Avenue northeasterly about 950 feet. (d) The acquisition of all easements and the construction of all improvements auxiliary to any of the above and necessary to complete the same. WHEREAS, the costs and expenses of said contemplated acquisitions and improvements are to be chargeable upon an assessment district, the exterior boundaries of which are the composite and coterminous boundaries shown on the map thereof on file in the office of the City Clerk of said City; WHEREAS, the public interest and convenience will be served by the taking of said proceedings; NOW, T~EREFORE, IT IS HEREBY FOUND, DETERMINED and ORDERED that all of the owners of more than 60~ in area of the property subject to assessment for said proposed acquisitions and improve- ments have filed with the City Clerk of this City a written petition for the construction of improvements pursuant to appropriate special assessment and assessment bond acts, without further compliance with the provisions of Division 4 of the Streets and Highways Code. IT IS FURTHER FOUND, DETERMINED and ORDERED that said proceedings for the oonstruction of said improvements shall be had pursuant to the Municipal Improvement Act of 1913 and the bonds upon the unpaid assessments thereof shall be issued pursuant to the Improvement Bond Act of 1915. IT IS FURTHER FOUND, DETEP~tINED and ORDERED that the provisions of Division ~ of the Streets and Highways Code by, and they are hereby, dispensed with. I hereby certify that the foregoing resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held this 19th day of June, 1961, by the following vote: Ayes, Councilmen: Noes~ " Absent~ " G.
