A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN MRANCISC0
AUTHORIZING THE EXECUTION OF A CONTRACT WITH BETHLEHEM STELL COMPANY,
A CORPORATION
REGARDING CERTAIN TIDE LAND LOTS
BE IT RESOLVED by the City Council of the City of South gan Francisco that
execution of that certain agreement between the CITY OF SOUTH SAN FRANCISCO and BETHLEHEM
STEEL CORPORATION wherein City extends an offer to purchase and BETHLEHEM STEEL CORPORATION
granted City an option to purchase certain parcel of real p~operty described as Tide Land
Lots 3 and 4 in Section 23, Township 3 South, Range 5 West, Mount Diable Base and Meridian
and Tide Land Lots 28, 29 and 30 of Section 14, Township 3 South, Range 5 West, Mount Diablo
Base and Meridian is hereby approved and muthorized and the Mayor is authorized to execute
said contract on behalf of the City and the City Clerk to attest his signature thereto.
I hereby certify that the foregoing resolution was regularly introduced and
adopted by the City Council of the City of South San Francisco at an adjourned regular
meeting held this 17th day of November 19 ..~! , by the following vote:

AGREEMENT
THIS AGREEMENT made and entered into as of this day of 19
between the CITY OF SOUTH SAN FRANCISCO, a municipal corporation, hereinafter called, "C!TT",
and BETHLEHEM STEEL CORPORATION , hereinafter called, "OWNER".
W I T N E S S E T H:
IT IS AGREED AS FOLLOWS:
1. City hereby offers to purchase those parcels of real property, together with
the tenements, hereditaments and appurtenances~thereuuto belonging and iu any wise appertaining
as hereinafter described and said offer shall remain open and irrevocable for acceptance by
owner until 5:00 p.m., August 31, 1962, in consideration for owner agreeing to grant the
following easements:
(a) Channel and waterway easement as set forth in Exhibit 3a, attached hereto.
(b) Spoil area easements as set forth in Exhibit 3b and 3c, attached hereto.
(c) Slope easements as set forth ~n Exhibit 3d and 3e, attached hereto.
Owner does hereby agree to execute and deliver said Grants o~ Easement.
2. Owner in consideration for payment by City of the sum of
DOLLARS ($ ), receipt of which is hereby acknowledged does hereby grant to City
an exclusive option to purchase the parcels of real property, together with the tenements,
heredttaments and appurtenances thereunto belonging and in any wise appertaining thereto as
hereinafter described and said offer shall remain epen and irrevocable for acceptance by
owner until 5:00 p.m., August 31, 1962.
3- The said parcels of real property are described as follows:
Tide Land Lots 3 and 4 in Section 23, Township 3 South, Range 5 West, Mount Diablo
Base and Meridian and Tide Land Lots 28, 29 and 30 of Section 14, Township 3
South, Range 5 West, Mount Diablo Base and Meridian.
4- Terms: Should the offer be accepted by owner or option be exercised by City,
then the following terms shall be effective:
AGREEMENT (Continued):
A. Payment: City shall pay owner the following sums as full consideration for
said parcels of real property:
1. On the 1st day of September 1962 the sum of $25,000.00
2. On the 1st day of September 1963 the sum of $27,750.00
3. On the 1st day of September 1964 the sum of $31,500.00
On the 1st day of September 1965 the sum of $27,500.00
5. On the 1st day of September 1966 the sum of ~31,625.00
6. On the 1st day of September 1967 the sum of ~30,250.00
7. On the 1st day of September 1968 the sum of $28,875.00
B. Deed and Title Insurance: 0wuer shall execute and deliver to City a grant deed
conveying said parcels as agreed free and clear of encumbrances and shall furnish City at owner's
expense a title insurance policy evidencing good and marketable title.
5. Acceptance of Offer and Exercise of Option: Owner shall accept the offer by Riving
City written notice thereof by registered mail to City of South San Francisco, c/o City Clerk,
City Hall, South San Francisco, California. City shall give owner written notiee of exercise of
option by registered mail to , ,
