A RESOLUTION DETERMINING TO UNDERTAKE PROCEEDINGS PURSUANT TO
SPECIAL ASSESSMENT AND ASSESSMENT BOND ACTS FOR THE CONSTRUC-
TION OF IMPROVEMENTS WITHOUT PROCEEDINGS UNDER DIVISION 4 OF
THE STREETS AND HIGHWAYS CODE - SPRUCE AVENUE IMPROVEMENT PROJECT
RESOLVED, by the City Council of the City of South San Francisco, Cali-
fornia, that
WHEREAS, all of the owners of more than 60% in area of the property sub-
ject to assessment therefor have signed and filed with the City Clerk of this City
a written petition for undertaking proceedings pursuant to special assessment and
assessment bond acts, and to assess the costs thereof upon the properties benefited
by said improvements, and waiving proceedings under Division 4 of the Streets and
Highways Code, for the following acqulsitious and improvements:
The improving and realigning of Spruce Avenue from E1Camino Real to
South Canal Street by grading, removing trees, bushes, and existiu~ struc-
tures, scarifying and recompactin~ existin~ pavement, constructing base
pavement and wearing surface, concrete curb, gutter and sidewalk~ stone
rip rap, catch basins, storm drain pipes, storm drain structure and sani-
tary sewer mains, together with manholes, and appurtenances, retaining
walls, arch extensions, headwalls, junctions, wing walls and guard rails,
together with the doing of all work and the acquisition and abandonment
of all easements incidental to any of the above and necessary to complete
same all as more particularly set forth and shown in plans, profiles,
specifications and legal descriptions of properties to be acquired and
vacated, prepared by Louis H. Goss, Director of Public Works, and on file
iu his office and the office of the City Clerk.
WHEREAS, the costs and expenses of said contemplated acquisitions and im-
provements are to be chargeable upon an assessment district, the exterior boundaries
of which are the coterminous exterior boundaries of the composite and consolidated
area more particularly shown on the map thereof entitled "Assessment Diagram - Spruce
Avenue Improvements - Colma Creek to E1 Camiuo", on file in the offices of the Direc-
tor of Public Works and City Clerk.
WHEREAS, the public interest and convenience will be served by the taking of
said proceedings;
NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED and ORDERED that all of the
owners of more than 60% in area of the property subject to assessment for said pro-
posed acquisitions and improvements have filed with the City Clerk of this City a
written petition for the construction of improvements pursuant to appropriate special
assessment and assessment bond acts, without further compliance with the provisions
of Division 4 of the Streets and Highways Code.
IT IS FURTHER FOUND, DETERMINED and ORDERED that said proceedings for the
construction of said improvements shall be had pursuant to the Municipal Improvement
Act of 1913 and the bonds upon the unpaid assessments thereof shall be issued pur-
suant to the Improvement Bond Act of 1915.
IT IS FURTHER FOUND, DETERMINED and ORDERED that the provisions of Division
4 of the Streets and Highways Code be, and they are hereby, dispensed with.

I hereby certify that the foregoing resolution was regu-
larly introduced and adopted by the City Council of the City of
South San Francisco at a regular meetin~ held this 2nd day of
January, 1962, by the followin~ vote:
