HomeMy WebLinkAboutReso 3357-1962RESOLUTION NO. 3357 A RESOLUTION OF INTENTION TO ACQUIRE AND CONSTRUCT IMPROVEMENTS - SPRUCE AVENUE IMPROVEMENT PROJECT RESOLVED, by the City Council of the City of South San Francisco, Califor- nia, that in its opinion the public interest and convenience require and that it is the Intention of said Council to order the following acquisitions and improvements, to wit: 1. The improving and realigning of Spruce Avenue from E1 Camlno Real to South Canal Street by grading, removing trees, bushes, and existing structures, scarifying and recompacting existing pavement, constructing base pavement and wear- ing surface, concrete curb, gutter and sidewalk, stone rip rap, catch basins, storm drain pipes, storm drain structure and sanitary sewer mains, together with manholes, and appurtenances, retaining walls, arch extensions, headwalls, junctions, wing walls and guard rails, together with the doing of all work and the acquisition and abandon- ment of all easements incidental to any of the above and necessary to complete same all as more particularly set forth and shown in plans, profiles, specifications and legal descriptions of properties to be acquired and vacated, prepared by Louis H. Goss, Director of Public Works, and on file in his office and the office of the City Clerk. 2. Whenever any public way is herein referred to as running between two public ways, or from or to any public way, the intersections of the public ways re- ferred to are included to the extent that work shall be shown on the plans to be done therein. ?38 RESOLUTION NO. 3357 (Continued): 3. Said streets and highways are more particularly shown in the records in the office of the County Recorder of San Marco County, California, and shall be shown upon the plans herein referred to and to be filed with the City Clerk of said City. 4. Ail of said work and improvements a~e to be constructed at the places and in the particular locations, of the forms, sizes, dimensions and materials, and at the lines, grades and elevations as shown and delineated upon the plans, profiles and specifications to be made therefor, .as hereinafter provided. 5. There is to be excepted from the work herein described any of such work ~lready done to line and grade and marked excepted or shown not to be done on said plans, profiles and specifications. 6. Notice is hereby given of the fact that in many cases said work and improvement will bring the finished work to a grade different from that formerly existing, and that to said extent said grades are hereby chan~ed and that said work will be done to said changed grades. 7. Said Council does hereby adopt and establish as the official grades for said work the grades and elevations to be shown upon said plans, profiles and speci- fications. Ail such grades and elevations are to be in feet and decimals thereof with reference to the datum plane of the City of South San Francisco. 8. The descriptions of the acquisitions and improvements and the termini of the work contained in this Resolution are general in nature. Ail items of work do not necessarily extend for the full length of the description thereof. The plans and profiles of the work, and maps and descriptions as contained in the Engineer's report, shall be controllin~ as to the correct and detailed description thereof. 9. The City will make the following contributions to the project: (a) The difference between the cost of constructing a sixty-four foot (64') wide street and a forth foot (40') wide street. (b) One half the cost of construction of the storm drainage structure to be installed along the west side of Spruce Avenue from Mayfair Avenue to the Souther Pacific Railroad Valencia Branch Line plus $!2,036.75; or $73,236.75, which- ever is the lesser. (c) One half the cost of construction of the storm drain to be in- stalled along the south side of Spruce Avenue from E1 Camino Real to the southwest- erly line of the lands of the City and County of San Francisco (formerly the Market Street Railway right of way) less $12,328.75. !0. Said contemplated acquisitions and improvements, in the opinion of the Council, are of more than local or ordinary public benefit and said Council does hereby make the costs and expenses thereof chargeable upon an assessment district, which district said Council declares to be the district benefited thereby, the ex- terior boundaries of which district are the coterminous exterior boundaries of the composite and consolidated area more particularly shown on the map thereof entitled "Assessment~D!agram - Spruce Avenue Improvements - Colma Creek to E1Camino", on file in the offices of the Director of Public Works and City Clerk. 11. Said Council further declares that all public streets and highways within said assessment district in use in the performance of a public function as such shall be omitted from the assessment hereafter to be made to cover the costs and expenses of said acquisitions and improvements. 12. Notice is hereby given that serial bonds to represent the unpaid assessments, and bear interest at the rate of not to exceed six per cent (6~) per annum, will be issued hereunder in the manner provided in the Improvement Bond Act of 1915, Division 10 of the Streets and Highways Code, the last installment of which bonds shall mature not to exceed fourteen (~4) years from the second day of July next succeeding ten (10) months from their date. ~ 13. Except as herein otherwise provided for the issuance of bonds, all of sa~d ~m~ov~m~nts shall b~ don~ ~u~suant to the ~ov~s~ons of th~ Mun~e~na] Improve- and specifications to be made therefor, .as hereinafter provided. 5. Reference is hereby made to proceedings had pursuant to Division 4 of the Streets and Highways Code on file in the office of the City Clerk. 15. Said proposed acquisitions and improvements are hereby referred to the Director of Public Works, bein~ a competent person employed by said City for that pur- pose; and said Director of Public Works is hereby directed to make and file with the City Clerk of said City a report in writing, presenting the following: (a) Maps and descriptions of the lands and easements to be acquired; (b) Plans and specifications of the proposed improvements to be made pursuant to this Resolution of Intention; (c) Engineer's statement of the itemized and total estimated costs and expenses of said acquisitions and improvements and of the incidental expenses in connection therewith; RESOLUTION NO. 3357 (Continued): (d) Diagram showin~ the assessment district above referred to, and also the boundaries and dimensions of the respective subdivisions of land within said dis- trict as the same existed at the time of the passage of this Resolution of Intention, each of which subdivisions shall be given a separate number upon said diagram; (e) A proposed assessment of the total amount of the costs and expenses of the proposed acquisitions and improvements upon the several subdivisions of land in said district in proportion to the estimated benefits to be received by such subdivi- sions, respectively, from said acquisitions and improvements, and of the expenses in- cidental thereto. 16. If any excess shall be realized from the assessment it shall be spent for the maintenance of said acquisitions and improvements, unless the Council shall hereafter determine that said amount or any part thereof shall be applied as a credit to each assessment herein.
