HomeMy WebLinkAboutReso 3398-1962RESOLUTION NO. 3398 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO ORDERING VACATION OF PORTIONS OF CHESTNUT AVENUE TOGETHER WITH SLOPE EASEMENTS AND DRAINAGE EASEMENTS RESOLVED by the City Council of the City of South San Francisco, Califor- nia, and this Council does hereby find, order and determine that 1. The City Council did on the 5th day of February, 1962, adopts its Resolution No. 3381 of Intention to vacate portions of Chestnut Avenue to~ether with slope easements and drainage easements, more particularly hereinafter described. 2. Said Resolution recited that proceedings were undertaken pursuant to the Street Vacation Act of 1941. 3. Said Resolution of Intention was duly published as required by law, and notices of its passage entitled "Notice of proposed Vacation of street and ease- ments - Portions of Chestnut Avenue, Slope and Drainage easements" were fully posted in the time, manner and form provided by law, all as appear from the affidavit of publication and postin~ on file in the office of the City Clerk of said City. 4. Monday, the 5th day of March, 1962, at the hour of 8 P.M. in the Coun- cil Chambers, City Hall, Grand and Maple Avenues, South San Francisco, California, were fixed in said Resolution of Intention as the time and place when and where any and all persons interested in, or havin~ any objections to, said proposed vacation, may appear before said Council and be heard. 5. The portions of Chestnut Avenue to~ether with slope and drainage ease- ments to be vacated and described as follows: All that certain real property situate in the City of South San Francisco, County of San Mateo, State of California, more particularly described as follows: _ _ Ma of Survey BEGINNING at ~ranite monument designated as L-5 on ~ made for P. E. Iler, filed March 10, 1891 in Book "E of Maps at pa~e 79 in the office of the Recorder of the County of San Mateo, State of California, runnin~ thence South 84~° 28' 40" East 145.800 feet to the point of be~innin~ of the parcel of land to be des- cribed; thence South 840 28' ~0" East 106.936 feet to a point; thence Southwesterly on an arc of a curve to the right, the center of which bears North 78© 55' 15" West 30 feet from the last men- tioned point with a radius of 30 feet, a central an~le of 4© 28' 15", an arc distance of 2.341 feet; thence South 15° 33' West tangent to the precedin~ curve 67.222 feet to a point on a curve havin~ a ra- dius of 100 feet and whose center bears South 77° 10' 10" West from said last mentioned point; thence Northwesterly on an arc of a curve to the left with a radius of 100 feet, a central an~le of 71° 38' 50", an arc distance of 125.048 feet to the point of be- ginning. Said portion of Chestnut Avenue to be vacated is shown as Parcel A on that certain map entitled "Portion of Chestnut Avenue, South San Francisco, California, to be abandoned, Drawin~ No. 1 dated 5th day of February, 1962", on file in the of- fice of the City Clerk. All that certain real property situate in the City of South San Francisco, County of San Mateo, State of California, described as follows: BEGINNING at a ~ranite monument designated as L-5 on Map of Survey made for P. E. Iler, filed March 10, 1891, in Book "E" of Maps at pa~e 79 in the office of the Recorder of the County of San Mateo, State of California; runnin~ thence South 37° 38' 40" West 10.02 feet to the point of commencement of the parcel of land to be des- cribed; thence South 77° 27' 18'! East 46.007 feet; thence North 85Q 06' 18" East 30 feet; thence North 40° 06' 18" East 10.545 feet; thence South 84° 28' 40" East 47.065 feet to a point; thence South- easterly on anla'rc3' of a curve to the right, the center of which bears South 38° 02' West 340 feet from the last mentioned point with a radius of 340 feet, a central an~le of 26© 52' 19", an arc distance of 159.461 feet; thence South 150 33' West 189.179 feet to a point; 36c RESOLUTION NO. 3398: (Continued) thence Northwesterly on an arc of a curve to the left, the center of which bears North 81° 34' 25" West 260 feet from the last men- tioned point, with a radius of 260 feet, a central an~le of 58° 19' 17", an arc distance of 264.654 feet; thence North 49° 53' 42" West tangent to the precedin~ curve 113.010 feet to the point of commencement. RESERVING THEREFROM an easement 10 feet wide to construct, operate and maintain a drainage pipe, the center line of said 10 foot ease- ment is described as follows: BEGINNING at ~ranite monument designated L-5 on Map of Survey made for P. E. Iler, filed March 10, 1891 in Book "E" of Maps at pa~e 79 in the office of the Recorder of the County of San Mateo, State of California; runnin~ thence South 37° 38' 40'! West 10.02 feet; thence South 49° 53' 42" East 45.957ofeet to the point of be~innin~ of said center line; thence North 17 28' 10" East 21.342 feet. PROVIDED THAT, should City fail to use said easement for a contin- uous period of two years, said easement shall be deemed abandoned and all rights therein hereby reserved, shall be vested in owners. Said portions of Chestnut Avenue to be vacated are shown as Parcel B on that certain map entitled "Portions of Chestnut Avenue, South San Francisco, California, to be abandoned, Drawin~ No. 1 dated 5th day of February, 1962", on file in the office of the City Clerk. An easement for slopes, drainage pipes, ditches and appurtenances thereto described as follows: BEGINNING at a ~ranite monument designated L-5 on Map of Survey made for P. E. Iler, filed March 10, 1891 in Book "E" -of Maps at pa~e 79 in the office of the Recorder of the County of San Mateo, State of California; runnin~ thence South 84° 28' 40" East 75.825 feet; thence North 40° 06' 18" ~ast 68.565 feet; thence South 72° 31' 50" East 116.877 feet; thence Southeasterly and SouthwesterIy on an arc of a curve to the right, tangent to the precedin~ course with a radius of 30 feet, a central an~le of 88° 04' 50", an arc distance of 46.119 feet; thence South 150 33' West tangent to the precedin~ curve 129.740 feet to the point of be~innin~ of the slope easement to be described; thence continuin~ South 150 33' West 328 feet; thence North 63° 49' 41" West 57 feet; thence North 31° 18' 36" East 77.403 feet; thence North 15° 33' East 2~3 feet; thence South 74° 27' East 35 feet to the point of beginning. Said easement to be vacated and abandoned is shown as Parcel C on that cer- tain map entitled "Portions of Chestnut Avenue, South San Francisco, California, to be abandoned, Drawin~ No. 1 dated 5th day of February, 1962", on file in the office of the City Clerk. 6. No objections of any kind or character have been, or were, made or filed, a~ainst said proposed vacation. 7. It is to the interest and convenience of the City of South San Francisco that said portion of Chestnut Avenue and slope and drainage easements be, and are here- by vacated. 8. The City Clerk of said City shall cause a certified copy of this Resolu- tion and order, attested under the seal of said City, to be recorded in the office of the County Recorder of the County of San Mateo. I hereby certify that the foregoin~ resolution was regu- larly introduced and adopted by the City Council of the City of South San Francisco at a regular meetin~ held this 5th day of March, 1962, by the followin~ vote: Ayes, Councilmen G.
