HomeMy WebLinkAboutReso 3551-1962RESOLUTION 'NO. 3551 A RESOLUTION DETERMINING TO IR~DERTAKE PROCEED~GS PURSUANT TO SPECIAL ASSESSMENT AND ASSESSMENT BOND ACTS FOR THE CONSTRUCTI0~T OF IMPROVEMENTS I~.~ITHOUT PROCEEDINGS UNDER DIVISION ~ OF T~IE STREETS AND III GHI, LIYS CODE NORTH AIRPORT BOULEVARD CIRtB, GUTTER A>[D S IDE~'~ALK IMPR 0VEMETITS RESOLVED, by the City Council of the City of South San Francisco, Ca!~fornia, that WI~REAS, all of the owners of more than 60% in area of the property subject to assessment therefor have signed and filed with the City Clerk of this City a written petition for undertaking proceedings pursuant to special assessment and assessment bond acts, and to assess the costs thereof upon the properties benefited by said improvements, and waivin~ proceedings under Division 4 of the Streets and Highways Code, for the following improvements: (a) The improvement of the northwesterly side of North Airport Boulevard from Butler Road to Chapman Avenue by grading, the removal of existing sidewalks, curbs and driveway aprons not to proper line and grade, the construction and installation of Portland cement concrete curb, gutter, sidewalk and driveway approaches, and paving between the edge of asphalt paving installed in 1960 and gutter to be constructed. (b) The doing of all work auxiliary to any of the above necessary to complete the same, including conformation of existing driveways, walks and steps to new sidewalk grade. ~REAS, the costs and expenses of said contemplated improvements are to be chargeable upon an assessment district, the exterior boundary of which is the coterminous exterior boundary of the composite and consolidated area consisting of the several parcels of land abutting on said improvements, more particularly shown on a map thereof on file in the office of the City Clerk, which indicates by a boundary line the extent of the territory included in the proposed district and which shall govern for all details as to the extent of t~e assessment district; ~IEREAS, the public interest and cohvenience will be served by the taking of said proceedings; NOW, THEREFORE, IT IS t~REBY F0~D, DETERMINED A>~ ORDERED that all of the owners of more than 60% in area of the property subject to assessment for said proposed improvements who appear to be such on the Assessor's roll on the day that said petition was filed, or, in the case of transfers of land or parts thereof subsequent to the date upon which the last Assessor's roll was prepared, appear to be such on the records in the County Assessor's office which the County Assessor will use to prepare the next ensuing Assessor's roll, have signed and filed with the City Clerk a written petition for the construction of improvements pursuant to appropriate special assessment and assessment bond acts, without further compliance with the provisions of Division 4 of the Streets and Highways Code. 48O RESOLUTION NO. 3~1: (Continued) IT IS FURTHER FOUND, DETERMINED AND ORDERED that said proceedings for the construction of said improvements shall be had pursuant to the Municipal Improvement Act of 1913 and the bonds upon the unpaid assessments thereof shall be issued pursuant to the Improvement Bond Act of 191~. IT IS FURTHER FOUND, DETERMINED AND 0RDERED that the provisions of Division 4 of ' a the Streets and Hlghw ys Code be, and they are hereby, dispenmed with. I hereby certify that the foregoing resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a meeting held this 4th day of September,1962, by the following vote: AYES, COUNCILMEN Leo J.
