HomeMy WebLinkAboutReso 3572-1962RESOLUTION N0. 3~72 A RESOLUTION AUTHORIZING ATTORNEY OF RECORD TO EXECUTE STIPULATION FOR ENTRY OF JUDGMENT PERSON - SWA[[SON PROJECT RESOLVED, by the City Council of the City of South San Francisco, that: WHEREAS, Resolutio'm No. 3~21 was passed and adopted on August 6, 1962, authorizing settlement of Parcel 3 in that certain condemnation proceeding entitled CITY OF S~!TH SAN FRANCISCO vs. ROYCE, et al, Action No. 9~99 in the Superior Court of the State of Ca].ifornia, in and for the County of San ~ateo, in the sum of Seventeen Thousand ~ine Hundred and Mine Dollars (~)17,909.00); and W[~REAS, the aforesaid award was based on the assumption that Parcel 3 comprises a total area of 11,021 square feet when, in truth and in fact, Parcel 3 contains a total area of 11,1~1 square f~et; and W~REAS, the basis for the proposed settlement was paYment for said parcel at the rate of ~ii~1.62~ per square foot for a total s~ of Eighteen Thousand One Hundred Twenty and 35/100 Dollars ~ (~.~18,120.38), which includes severanc~ damage in the sum of One Thousand Thr~e Hundred and Seventy-Eight Dollars (~1,378.00). N~, ~[Et~FORE, IT IS FOIleD,DETERMinED and ORDERED that John E. Lynch of the ~aw firm of Wilson, Harzfeld, Jones & ~orton, attorneys of record with the City Attorney of the City of South San Francisco, in the aforesaid condemnation proceeding, be, and he is, h~reby authorized and directed ~o execute a stipulation for judgment in settlement of the taking of Parcel 3. in the sum of Eighteen Thousand One Hundred Twenty and 38/100 Dollars .~8,120.38), and to ex~cute and d~liver all of the documents, and to t~ke all action necessary to complete the acquisition of said parcel. RESOLUTION NO. 3572: (Continued) IT IS FURTHER ORDERED, that the City Cler~ be, and he is, hereby directed to draw his warrant, payable to V. G. JACOBSEN and ~.~0ND K. JACOBSEN in the additional sum of Two Hundred Eleven and 38/100 Dollars (!!~211.38), and to deliver said warrant to the attorneys of record aforesaid at 630 North San ~ateo Drive, San Mateo, California.
