HomeMy WebLinkAboutReso 38-2014RESOLUTION NO. 38 -2014 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA RESOLUTION SUPPORTING ASSEMBLY BILL 2727 (FRAZIER), WHICH WOULD INCREASE THE FEE DEPOSIT THAT MUST ACCOMPANY SUBPOENAS FOR NON - SAFETY LOCAL AGENCY EMPLOYEES WHEREAS, in 2012, the California Legislature unanimously passed Assembly Bill 2612 (Achadjian) which increased the fee deposit that must accompany subpoenas for safety employees from $150 to $275; and WHEREAS, the fee deposit that must accompany subpoenas for non - safety employees has not been increased since 1991, even though salaries and other expenses have significantly increased; and WHEREAS, it is common for costs associated with court appearances to exceed $150. While current law allows local agencies to invoice for the remaining expenses following the court appearance, these invoices often go unpaid. By doing the same for non - safety employees, Assembly Bill 2727 provides consistency in the administration of subpoenas for all local agency employees. The increase in the subpoena fee deposit provided in Assembly Bill 2727 will assist local governments in collecting expenses associated with court appearances. WHEREAS, the City Council finds that the adoption of Assembly Bill 2727 is in the public interest. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that the City Council does hereby declare its support of the State Legislature's adoption of Assembly Bill 2727. BE IT FURTHER RESOLVED that the City Council directs the Mayor to submit a letter of support of Assembly Bill 2727 on behalf of the City. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 9h day of April, 2014 by the following vote: AYES: Councilmembers Mark N.
