HomeMy WebLinkAboutReso 70-2014RESOLUTION NO. 70 -2014 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION ADOPTING A REPORT OF STORMWATER MANAGEMENT SERVICE FEES FOR FISCAL YEAR 2014- 2015; APPROVING STORMWATER MANAGEMENT SERVICE CHARGES FOR FISCAL YEAR 2014 -2015; AND DIRECTING THE SERVICE CHARGES TO BE COLLECTED ON THE OFFICIAL TAX ASSESSMENT ROLL WHEREAS, South San Francisco Municipal Code Chapter 14.04 enables the City of South San Francisco ( "City ") to establish a system of charges for the local portion of the San Mateo County Stormwater Management Program; and WHEREAS, pursuant to South San Francisco Municipal Code Chapter 14.04, City Council held a duly noticed public hearing, notices were published and a public hearing was held on June 11, 2014 as required for the enactment of the subject stormwater fees; and WHEREAS, the proposed local program budget for Fiscal Year 2014 -2015 is $1,830,000.00; and WHEREAS, the Stormwater Service Charges are maintained at the level established in Fiscal Year 1993 -94; and WHEREAS, pursuant to South San Francisco Municipal Code Chapter 14.04, City Council held a duly noticed public hearing was held on June 11, 2014; and WHEREAS, staff recommends that the City Council adopt the Finance Director's Report, determine the Stormwater Management Service charges for Fiscal Year 2014 -2015 for property within the City, and direct the charges to be collected on the official tax assessment roll. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of South San Francisco that the City Council of the City of South San Francisco, hereby takes the following actions: 1. Adopts the Finance Director's Report of Stormwater Management Service charges, attached hereto as Exhibit A. 2. Determines the Stormwater Management Service Charges for Fiscal Year 2014- 2015, attached hereto as Exhibit B. 3. Directs the Stormwater Management Service Charges for Fiscal Year 2014 -2015 to be collected on the official tax assessment roll, together with real property taxes, and that the amount shall constitute liens upon the properties which shall be effective at the same time and to the same extent as is provided for by law in the case of real property taxes, with like penalties for delinquencies. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 11`x' day of June, 2014 by the following vote: AYES: Councilmembers Mark N. Garbarino and Mayor KaMl Matsumoto NOES: None ABSTAIN: None ABSENT: None ATTEST: QAVy,, 0.v% 5� 01kS� Anna Brown, Deputy City Clerk EXHIBIT A REPORT OF STORMWATER MANAGEMENT SERVICE CHARGES FOR 2014 -2015 IN ACCORDANCE WITH CHAPTER 14.04.100 OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE In accordance with Chapter 14.04. 100 of the South San Francisco Municipal Code, the following report prepared as of May 28, 2014, is submitted. This report describes the procedure for charging those parcels of real property, which receive benefits of stormwater system services, and the amount of the annual charge, which will be imposed against each parcel for fiscal year 2014 -2015. Summary of Charges All single - family residential properties $ 124,017.48 All multi - family residential properties $ 67,857.58 (Including duplexes) All commercial/industrial $ 216,925.34 Parking lots $ 11,438.90 Vacant $ 5,927.38 TOTAL $ 426,166.68 This report refers to and incorporates by reference the report entitled "Notice of Proposed City of South San Francisco Stormwater Management Program Rate Structure" for fiscal year 2014 -2015 prepared by and on file in the Office of Environmental Compliance. That report summarizes the 2014 -2015 charges that will be proposed by the City Council on June 11, 2014. Upon adoption of the proposed charges, or amendments thereto, a report entitled "City of South San Francisco Stormwater System Charges," prepared by Engineering Data Services, Los Altos, California will be completed; it will describe the amount of annual charge imposed against each parcel, by Assessor's Parcel Number, for Fiscal Year 2014 -2015. All of these documents, including this report, shall be filed with the County Tax Collector or Auditor. Accompanying the filing of this report shall be the Clerk's endorsement that the report has been duly adopted by the City Council. Dated: G ii Jigateele rector of Finance -3- EXHIBIT B PUBLIC HEARING NOTICE OF PROPOSED CHARGES FOR FY 2014 -2015 CITY OF SOUTH SAN FRANCISCO STORMWATER MANAGEMENT SERVICE CHARGES NOTICE IS HEREBY GIVEN that the City Council of the City of South San Francisco, on Wednesday the 11th of June 2014, at 7:00 p.m., or as soon as possible thereafter, in the Community Room of the Municipal Services Building, 33 Arroyo Drive, South San Francisco, California, will consider the adoption of charges to be collected on the tax roll for the local portion of the San Mateo County Stormwater Management Program pursuant to Chapter 14.04 of the South San Francisco Municipal Code. Any and all interested persons may appear and be heard thereon. The Council may continue the hearing from time to time without further written notice. This is the same rate that has been in place since 1993. NOTICE IS FURTHER GIVEN that the written report containing a description of each parcel receiving stormwater management services and the proposed charge for each parcel has been filed with the City Clerk and is available for public review.
