CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION PLEDGING SEWER SERVICE CHARGES
REVENUE FROM THE SEWER ENTERPRISE FUND TO
PAYMENTS TO THE STATE WATER RESOURCES CONTROL
BOARD FOR LOAN REPAYMENTS TO FINANCE SANITARY
SEWER AND TREATMENT PLANT CAPITAL
IMPROVEMENTS
WHEREAS, on January 15, 2014, the City Council approved Resolution 07 -2014,
authorizing the submittal of a Financial Assistance Application for a financing agreement from the
State Water Resources Control Board for the planning, design and construction of Sanitary Sewer
and Treatment Plant Improvements and authorizing the City Manager to certify the City's compliance
with all applicable state and federal statutory and regulatory requirements related to any financing or
financial assistance received from the State Water Resources Control Board; and
WHEREAS, pursuant to Resolution 07 -2014, the City Manager executed said financing
agreement with the State Water Resources Control Board; and
WHEREAS, on May 28, 2014, the City Council approved Resolution 60 -2014, establishing a
three -year schedule of sewer rates that increases charges to support Sanitary Sewer and Treatment
Plant Improvements and to payment of the corresponding State Water Resources Control Board
financing; and
WHEREAS, on June 11, 2014, the City Council approved Resolution 68 -2014, adopting the
Fiscal Year 2014 -15 Capital Improvement Program, including $2,186,562 in Sewer Enterprise Fund
proj ects.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San
Francisco (the "Entity ") that the City Council hereby dedicates and pledges Sewer Service Charges
Revenue from the Entity's Sewer Enterprise Fund to payment of any and all financing from the State
Water Resources Control Board, including Clean Water State Revolving Fund ( "CWSRF ") and /or
Water Recycling Funding Program financing, for South San Francisco / San Bruno Water Quality
Control Plant Capital Improvements Projects, CWSRF Project No. 8033 (the "Project "). The Entity
commits to collecting such revenues and maintaining such fund throughout the term of such
financing and until the Entity has satisfied its repayment obligation thereunder unless modification or
change is approved in writing by the State Water Resources Control Board. So long as the financing
agreement is outstanding, the Entity's pledge hereunder shall constitute a lien in favor of the State
Water Resources Control Board on the foregoing fund and revenue without any further action
necessary. So long as the financing agreement is outstanding, the Entity commits to maintaining the
fund and revenue at levels sufficient to meet its obligations under the financing agreement.
I hereby certify that the foregoing Resolution was regularly introduced and adopted by the
City Council of the City of South San Francisco at a regular meeting held on the 9`h day of July, 2014
by the following vote:

Vice Mayor Richard A. Garbarino and Mayor Karyl Matsumoto
