CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION AUTHORIZING THE CITY RISK
MANAGER, THE CITY MANAGER AND THE CITY
ATTORNEY TO PERFORM CERTAIN FUNCTIONS
PERTAINING TO CLAIMS AGAINST THE CITY
WHEREAS, the California Tort Claims Act, Part 3 of Division 3.6 of Title 2 of the
Government Code of the State of California [Sections 900 et seq.] imposes certain enumerated
duties upon the City Council of the City of South San Francisco ("City Council") relating to
claims for money or damages which are presented to the City of South San Francisco ("City");
and
WHEREAS, Government Code section 935.4 authorizes the City Council, by resolution,
to delegate authority to employees of the City to perform the functions of its City Council
relating to the acceptance, rejection, compromise or settlement of such claims, provided such
authority is for dollar amounts equal to or less than fifty thousand dollars ($50,000); and
WHEREAS, authorizing the City Attorney and City Manager or his/her designee, the
Risk Manager, to perform certain related functions would relieve the City Council of the burden
to take routine, repetitious action regarding such claims at City Council meetings while ensuring
that each such claim will be processed in accordance with the requirements of applicable law.
NOW, THEREFORE BE IT RESOLVED that the City Council of the City of South San
Francisco hereby:
1. The City Council hereby authorizes the City Risk Manager to allow, compromise
and settle as the best interests of the City may dictate, any and all claims or
demands up to a maximum of twenty thousand dollars ($20,000.00) each, and to
take all appropriate steps to conclude any proceedings involving such claims.
2. The City Council hereby authorizes the City Attorney and the City Manager, in
conjunction, to allow compromise and settle as the best interests of the City may
dictate, any and all claims or demands up to a maximum of fifty thousand dollars
($50,000.00) each, and to take all appropriate steps to conclude any proceedings
involving such claims.
3. Settlement of claims exceeding fifty thousand dollars ($50,000) requires City
Council approval.
4. Rejection of claims or demands are handled administratively by the City Manager,
or his/her designee, and do not require City Council approval.
5. The City Manager, City Risk Manager and City Attorney are hereby authorized and
directed, on behalf of the City Council, to make all approvals and take all actions
necessary or appropriate to carry out and implement the intent of this Resolution.
I hereby certify that the foregoing Resolution was regularly introduced and adopted by
the City Council of the City of South San Francisco at a regular meeting held on the 10 day of
September, 2014 by the following vote:
AYES: Councilmembers Mark N. Addiego, Pradeep Gupta, and Liza Normandy
Vice Mayor Richard A. Garbarino and Mayor Karyl Matsumoto
