HomeMy WebLinkAboutMinutes 1928-10-22MINUTES 0~ SPECIAL ~,ii~ETING 0~~ TM CITY ~0UNCIL OF TH~ CITY OF SOUTH S~d~ FRANCISCO, HELD MONDAY, 0C TOBER 22ND, 1928. ~ursuant to call and notice, of which the following is a copy;- The undersigned being all the members of the City Council of the City of South San ~ran- cisco hereby call a special meeting of said Cil~ Council to be held in the Council Chamber in the City Hall in the 0ity of South San Erancisco, County of San Marco, State of California, on the 22nd day of October, 1928, at the hour of ?:30 o'clock P. M. for the purpose of hearing, considering and acting upon any and all objections to the work and improvement described in Resolution of Intention No. 64 entitled "A resolution of the City Council of the City of South San ~rancisco declaring its intention to improve a portion of Oak Avenue in the City of South San Erancisco", which resolution of in- tention was adopted by said City Cour~il on the 1st day of October, 1928, and, if upon the hearing of such objections to said work and improvement, the same shall be over- ruled by said City Council, for the additional purpose of Passing a resolution ordering the work described in said resolution of intention, snd for all such other purposes as may be incident to the purposes hereinbefore mentioned. The undersigned call said special meeting for the additional purpose of authorizing the N~yor and City Clerk of said City, for and in behalf of said City, to execute to South San ~rancisco Laud and Improvement Company a quitclaim deed conveying to said South San ~rancisco Land and Improvement Company the interest of said City of South San ~rancisco in all that certain tract or parcel of l~nd situate in the City of South San ~rancisco, County of San Mateo, State of California, and particularly de- scribed as fellows, to-wit: Tide Lot No. 29 in Section 27, Township ~ South, Range ~ West, M, D. B & containing ?.~4 acres as said ~ide Lot is shown on that certain map entitled "Map No. 1 of Salt Marsh and Tide lands situated in the County of Ssn Marco, State of CaIif- ornia" approved by the Board of Tide Zand Comissioners September 2~, 1871; addi~ional purpose of accepting a deed from said South San l~rancisco I~nd and Improve- ment Company conveying to said City of South San ~rancisco an easement in said land located in said South S~u ~rancisce, for garbage dumping purposes; and ~or the additional purpose of accepting an option to purchase all that certain tract or parcel of land sitaate in the City of South San ~rancisco, County of San Mateo, State of California, and particularly described as follows, to-wit: Beginning at the most westerly corner of that~certain twenty acre tract, conveyed by South San ~rancisco Land and Improvement Company to the City of South San Erancisco, by deed recorded May 1, 192~, in Volume 1~9 of Official Records of San Mateo County at page 462. Running thence from said Roint of beginning along the westerly boundary of said twenty acre tract North ~69 06' 36" East 10~6.27 feet to the northwesterly corner thereof; said point being distant 40 feet at right angles southerl~ from the southerly line of the right of way o~ the Southern Pacific Company (Baden branch); thenCe parallel with and distant 40 feet at right angles southerly from said right of way North ?4o 27' West ~19.?0 feet; thence on the arc of a curve to the left having a radius of 1081 feet, a distance of 242.14 feet: thence South 1~o SS' West 909.98 feet to a point distant 40 feet at right angles northerly from the northerly lin~ of the Southern Pacific right of way (Valencia Street Brauch); thence South ~ ~9' 10" East 178 feet to the point of beginning. CONTAINING ?.84 acres. Reserving an easement ~0 feet in'width, lying 2~ feet on each side of the following described certerline: Beginning at a point distant South ~6° 06' ~6" West 661.79 feet from the northeasterly corner of the above described parcel of land; running thence North ~9o 39' ~?" West ~$ feet moreor less to a point in the westerly boundary line of said parcel. The undersigaed hereby admit due service of notice of said meeting to consent to the holding thereof and the transaction of the business hereinbefore mentioned. Dated October 22, 1928. Minuc ci ani a special meeting of the City Council of the City of South San Francisco was held in the Council Chambers on Monday the 22nd day of October, 1928. There were present the following councilmen;- A.Hynding, Reese Lloyd, R.Tibbetts,M.Minucciani and A.J.Eschelbach. The meeting was c~l~ed to order at ?;J0 o'clock p.m. The reading of ~he minutes of the previous meeting w~as dispensed with. The matter of considering .~. ' .... protests a~vainst ~the improvement of a portion of 0~k Avenu was first taken up, this being the date set for such hearing. Four property owners on Oak Avenue submitted a communication to the council, agreeing to the pavement of Oak Avenue provided the city woul guarantee to continue the pavement to the Mission Road within two years. The City Council could not gusrantee'that this could be done and set ~'rtday morning at l0 a. m. October 26, as a date for a furthe hearing wltB the property §w~ers on ~he subject. A RESOLUTION SUERE~.~DERING OPTION IN GAHBAGE ~ITE 0~ ?.8A ACRES in Tide Lend Lot No.29,Section 27-3-5, in EXCHANGE FOR ?.84 ACRES 0£ LAND ADJOINING THE CITY's £O acre PAhK IN THE WILLOWS was introduced by,councilman hynding, as follows:- Whereas the City of South San Francisco has heretofore acquitted from Alfred E. Kau.ffmam and Aimee Eauffmaun, an option for the purchase of all that certain tract or pracel of land situate in the City of South San ~rancisco, 0ounty of Sau Nateo, State of California, and par%icularly described as follows, to-wit: Tide Lot No. 29 in Section 27, Township 3 South, Range 5 West, M. D. B. & M. containing 7.84 acres as said Tide lot is shown on that certain map entitled "Map No. 1 of Salt Marsh and Tide lands sitaated in the County of San ~ateo, State of California" approved by the Board of Tide Land Commissioners September 25, 1871; and WHEREAS Marchetti Patents Inc. has entered into an agreement with South San ~rancisco Land and Improvement Company for the purchase of land in the vicinity of the lsnd hereinbefore described and desires to purchase the land hereinbefore described and to useall said l~nd for the purpose of constructing and maintaining au industrial plant thereo~n;, and WHEREAS, in the' opinion of the City Council of said City of South San Francisco, such industrial plant will be beneficial to said City; and WHEREAS said 0ity of South San ~rancisco needs additional land for the pur- poses of the public park lying West of Orange AVenue and South of Railroad Avenue in said City,a~d South San ~raucisco I~nd and Improvement Company has offered said City of South San ~rancisco an option to purchase 7.84 acres of land lying adjacent to said public park, being the equit~alent in acreage of the land covered by the option first hereinbefore mentioned, on the condition that said City of South San ~rancisco shall surrender the option hereinbefore mentioned and transfer its rights in the land described therein to said South San ~rancieco L~nd and Improvement Company and accept from said South San Francisco Laud and ImProvement Company an option ~or the. purchase of the land hereinafter described for the total sum of Three Thousand Nine Hundred Seventy-eight and 15/100 Dollars ($3,978.15), being the amount unpaid on said first mentioned option; and _ WHEREAS Said Sou~h San ~rancisco Land and Improvement Company has also agreed to convey to said City an easement located in said City suitable for garbage dumping purp os es; NOW, THEREEORE, RESOLVED by ~the City Council of the City of South San ~rancisco that said City accept said option to purchase for the total sum of Three Thousand Nine Hundred Seventy-eight and 15/100 Dollars ($3,978.15), all that certain tract or parcel of land situate, in the City of South San ~rancisco, County of San Nateo, State of California, and described as follows, to-wit: Beginning at the most westerly comer of that certain twenty acre tract, conveyed by South San Erancisco I~nd and Improvement Company to the City of South San 2rancisco, by deed recorded May l, 1925, in Volume 159 of Official Records of San Mateo County at page 462. Running thence from said_point of beginning along the westerly boundary of said twenty acre tract North 36° 06' 36" East 1056.27 feet to the northwesterly corner thereof; said point being distant 40 feet at right angles south- erly from the southerly line of the right of way of the Southern Pacific Company (Baden branch); thence par~llelowith and distant 40 feet at right angles southerly from said right of way North 74 27' West 319.70 feet; thence on the arc of a curve to the left having a radisu of 1081 feet, a distance of 242.14 feet; thence South L5° 33' West 909.98 feet to a point distant ~40 feet at r. ight angle's norhterly f~r. om the north- erly line of the Southern Pacific right of way (Valencia Street Branch~, thence South 55° 59' 10" East 178 feet to the point of beginning. CONTAINING 7.84 acres. Attest: Daniel McSweeney 0ity Clerk The following resolution was introduced by Councilman Minucciani: RESOLUTION AUTHORIZING EXECUTION 0~ QUITCLAIM DEED TO TIDE LOT NO. 29 Sec. 27 Township 3 South R~nge 5 West, EE~0LVED by the City Council of thc City of South San i?rancisco, that said City of 'South San ~rancisco transfer and convey to South San ~ranc isco Ia~nd and Improvement Company, a corporation organized and existing under the laws of the State of California, all the right, title and interest of said City of South San ~rancisco in and to all that certain tract or parcel of land situate in the City of South San ~rancisco, County of San Marco, State of California, and particularly described as follows, to-wit: Tide Lot No. 29 in Section 27, Township 3 South, Range 5 West, M. D. B. & M. containing ,7.84 acres as said Tide lot is shown on that certain map entitled "Map No. 1 of Salt Marsh and Tide lands situated in the County of San M~teo, State of California"' approved by the Board of Tide Land Commissioners September 25, 18?l. The Mayor and City Clerk of said City of South San ~rancisco are hereby authorized snd directed in its corporate name and under its corporate seal to execute a quitclaim deed conveying said interest in said land to South San Francisco Land and Improvement Company. -0-0-0-0-0-0-0'-0-0- I hereby certify that the foregoing resolution was regularly passed and adopted by the City Council of the City of South San ~rancisco at a meeting held on the 2~nd day of October, 1928, by the followinf vote: Ayes, Councilmen Noes, Councilmen A.
