AGENDA REVIEW No changes CONSENT CALENDAR CONSENT CALENDAR 1. Motion to approve the minutes of the March 28, 2001 regular meeting 2. Motion to confirm expense claims of April 11, 2001 in the amount of $78,028.37 3. Resolution authorizing a lease agreement with Sprint PCS for renting space at 306 Spruce Avenue (472 Grand Avenue) Boardmember Gonzalez requested Item No. 3 be pulled from the Consent Calendar. Motion-Matsumoto/Second-Penna: To approve the Consent Calendar Item Nos. 1 and 2. Unanimously approved by voice vote. Abstain: Boardmember Penna, Item No. 1. Consent Calendar Item No. 3: In response to Boardmember Gonzalez, staffed clarified the addressing of the facility that has two addresses, 472 Grand Avenue and 306 Spruce Avenue. Agency Counsel Mattas explained Sprint's request to make a minor modification to the - ' draft agreement regarding the extension periods of the agreement. Vice-Chair Mullin discussed his concern that it may later be discovered that the cellular relay system has a health hazard associated with it. Counsel Mattas suggested modifying the language in Section No. 10, §6, termination provision, by adding City's right to terminate the agreement for health reasons. He stated that Sprint will be advised that this is a condition to the lease and with their approval the document will be signed by the City without coming back to the Agency. Motion-Mullin/Second-Penna: To approve Resolution No. 02-2001, approving a lease with Sprint Spectrum L.P. for the installation of personal communication service (PCS) facility at 472 Grand Avenue, subject to the modification of the lease agreement. Unanimously approved by voice vote. (Recess: 7:09 p.m. -10:20 p.m.) (Cassette Tape No. 2) CLOSED SESSION 4. Closed Session items: a) Pursuant to Government Code Section 54956.9(a): Conference with Legal Counsel Existing Litigation: South San Francisco Redevelopment Agency v. Alyea Entered into Closed Session: 10:20 p.m. Reconvened into Open Session: 10:33 p.m. Report from Closed Session: ..... Agency Counsel Mattas reported the following: a) (Kaul/Rizzetto) the Agency authorized a settlement of the condemnation matter for the land value in the amount of $1,020,000, and that amount results in a settlement of all issues except for the value for the good will claim; b) (Alyea) the Agency authorized a settlement in the amount of $542,000.
