CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION AWARDING A CONSTRUCTION
CONTRACT TO ALPHA BAY BUILDERS, INC. OF SAN
FRANCISCO, CALIFORNIA FOR THE FOUR PARKS
PLAYGROUND RENOVATION PROJECT IN AN AMOUNT
NOT TO EXCEED $687,404 AND AUTHORIZING THE CITY
MANAGER TO EXECUTE PURCHASE AGREEMENTS WITH
NICROS CLIMBING WALL SYSTEMS, WONDERSCAPES
RECREATION PRODUCTS, KOMPAN, AND LANDSCAPE
STRUCTURES, RESPECTIVELY, IN A COMBINED AMOUNT
NOT TO EXCEED $230,000 FOR PROCUREMENT OF PLAY
STRUCTURES.
WHEREAS, City of South San Francisco ("City") staff issued a Notice Inviting Bids for
the Four Parks Playground Renovation("Project") and on November 20, 2014, received three (3)
bids in response; and
WHEREAS, Alpha Bay Builders, Inc. of San Francisco, California, was the lowest
responsive and responsible bidder; and
WHEREAS, staff recommends awarding the total base bid construction contract to Alpha
Bay Builders, Inc. of San Francisco, California, in a total amount not to exceed $687,404; and
WHEREAS, the City intends to purchase the playground equipment directly, and provide
it to the selected contractor for installation, which will provide the City with overall cost savings;
and
WHEREAS, Section 4.04.040 of the South San Francisco Municipal Code ("SSFMC")
expressly authorizes the City to take advantage of valid contract terms that have been negotiated
by another governmental agency, where that agency had used a quote or bid process substantially
conforming with SSFMC Chapter 4.04 and State law; and
WHEREAS, City staff obtained quotes through the California Multiple Award Schedule
(CMAS) and U.S. Communities purchasing programs for the procurement of new playground
equipment; and
WHEREAS, City staff has verified that the CMAS and the U.S. Communities purchasing
programs bid processes and pricing agreements with the vendors substantially conform to
SSFMC Chapter 4.04 and State law; and
WHEREAS, staff recommends entering into separate purchase agreements with Nicros
Climbing Wall Systems, Wonderscapes Recreation Products, Kompan, and Landscape Structures
in a combined, not to exceed amount of$230,000 for the purchase of; and
WHEREAS, the Project is funded by a combination of General Funds, ADA Funds, and
Park-in-Lieu Funds (Zone 2 & 4) in the City of South San Francisco's 2014-2015 Capital
Improvement Program ("CIP")under Project Nos. pk1203, pk1204, pk1206 and pk1303; and
WHEREAS, additional funding will also come from unencumbered budget of the Alta
Loma Park Playground Renovation & Pathway Improvements Project (pkl 502) and the Willow
Gardens Playgrounds Replacement Project (pk1401).
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of South San
Francisco that the City Council hereby awards the total base bid construction contract for the
Four Parks Playground Renovation Project to Alpha Bay Builders, Inc. of San Francisco,
California, in a total amount not to exceed $687,404, conditioned on Alpha Bay Builders Inc.'s
timely execution of the Project contract and submission of all required documents, including but
not limited to, certificates of insurance and endorsements, in accordance with the Project
documents.
BE IT FURTHER RESOLVED that the City Manager is hereby authorized to execute the
total base bid construction contract documents with Alpha Bay Builders, Inc. on behalf of the
City upon timely submission by Alpha Bay Builders, Inc. signed contract and all other
documents, subject to approval as to form by the City Attorney.
BE IT FURTHER RESOLVED that the City Manager is hereby authorized to execute
purchase agreements with Nicros Climbing Wall Systems, Wonderscapes Recreation Products,
Kompan, and Landscape Structures, respectively, in a combined amount not to exceed $230,000
for the procurement of play structures to be installed during Project construction, upon timely
submission the signed purchase agreements and all other required documents, subject to approval
as to form by the City Attorney and as to content by the City Manager.
I hereby certify that the foregoing Resolution was regularly introduced and adopted by
the City Council of the City of South San Francisco at a regular meeting held on the 10th day of
December, 2014 by the following vote:
AYES: Councilmembers Pradeep Gupta, Karyl Matsumoto and Liza Normandy
Vice Mayor Mark N. Addiego and Mayor Richard A. Garbarino
