HomeMy WebLinkAboutReso 16-2015 RESOLUTION NO. 16-2015 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA RESOLUTION AMENDING THE PROFESSIONAL SERVICES CONTRACT AGREEMENT BETWEEN THE CITY OF SOUTH SAN FRANCISCO AND WEST COAST CODE CONSULANTS, INC., IN THE AMOUNT OF $80,000 FOR THE INTERIM CITY BUILDING OFFICIAL WHEREAS, on July 16, 2014, the City of South San Francisco ("City") and West Coast Code Consultants, Inc., (WC3) entered into a Consulting Services Contract Agreement for professional services with the Building Division at an hourly rate of$115.00 per hour(one hundred and fifteen dollars); and WHEREAS, the City and WC3 desire to further amend, modify or alter certain terms and conditions of the Agreement; and WHEREAS,this first amendment will extend the term of the contract through December 30, 2015 and will add an additional compensation amount of$80,000 (eighty thousand dollars) for continued professional services to the Building Division; and WHEREAS, City staff recommends approving the first Amendment and scope to the Professional Services Agreement ("Amendment")with WC3. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that the City Council hereby approves a first amendment with WC3 attached hereto as Exhibit A, and incorporated herein. FIRST AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF SOUTH SAN FRANCISCO AND WEST COAST CODE CONSULTANTS,INC. THIS FIRST AMENDMENT TO THE SERVICES AGREEMENT is made at South San Francisco, California, as of February 11, 2015 by and between THE CITY OF SOUTH SAN FRANCISCO ("City"), a municipal corporation, and West Coast Code Consultants, Inc., (WC3) ("Contractor"),(sometimes referred together as the"Parties")who agree as follows: RECITALS A. On July 16, 2014, City and Contractor entered that certain SERVICES AGREEMENT("Agreement")whereby Contractor agreed to provide professional services to the Building Division,per Exhibit A of the Agreement. A true and correct copy of the Agreement and its exhibits is attached as Exhibit A. B. City and Contractor now desire to amend the Agreement. NOW,THEREFORE, for and in consideration of the promises and other good and valuable consideration,the receipt and sufficiency of which are hereby acknowledged, City and Contractor hereby agree as follows: 1. All terms which are defined in the Agreement shall have the same meaning when used in this Amendment,unless specifically provided herein to the contrary. 2. Section 1. Section 1.1 of the Agreement shall be amended to extend the term of services through December 30,2015. 3. Section 2. Section 2 of the Agreement shall be amended such that the City agrees to pay Contractor a sum not to exceed$155,000.00. Contractor agrees this is the City's total contribution for payment of costs under the Agreement unless additional payments are authorized in accordance with the terms of the Agreement and said terms of payment are mutually agreed to by and between the parties in writing. 4. Scope of Services. The Scope of services is amended and attached as Exhibit A to this Amendment. All other terms, conditions and provisions in the Agreement remain in full force and effect. If there is a conflict between the terms of this Amendment and the Agreement,the terms of the Agreement will control unless specifically modified by this Amendment. These 1. Coordinates, and maintains the overall building inspection program for the City ensuring compliance with all applicable codes,ordinances,and regulations. 2. Interprets current building, housing, state-mandated,and other applicable codes adopted by the city related to the construction and life safety of buildings and its o axipants or enforced . 3. Ensures buildings are constructed in accordance with approved plans and in accordance applicable codes,regulations,and ordinances. 4. Meets with engineers,architects, contractors, business community, property owners,and the public to discuss and interpret codes,ordinances,and division policies, and resolve disputes and problems that cannot be resolved at other levels. 5. Performs plan checking,site inspections,and issues Certificate of Occupancy,as necessary. 6. Serves as secretary to the City's Building and Housing Appeals Board; prepares agendas, minutes, and reports;follows-up on action items. 7. Develops, implements, and conducts plan checking and building inspection training programs for department staff. 8. Provides technical assistance in the investigation of complaints related to building and other related matters. 9. Coordinates and supervises damage assessment teams and operations; inspects and collects field data;reports findings in time of disaster. 10. Represents the City at professional and technical meetings; provides comments and analysis concerning new and revised codes and standards. 11. Coordinates the preparation,training,and implementation of the adoption of new andfor revised codes, standards, ordinances, or other regulations applicable to the building, fire prevention, and code enforcement activities of the division.
