The regular meeting of the city council of the City of South San Francisco was held in th Cit~ Hall, Monday evening, March lst,194~. The meeting was called to order at 8 o'clock P.M. by Mayor D.W.Ratto. ROLL CALL. Roll call fonnd all the members of the city council present,as follows;- ~ouncilmen,V.Boido,George W.Holston,Reese Lloyd,~M.Minucciani,D.W.~atto. The minutes of the previous meeting were read. There being no errors or omissions they we approved as read. Dennis A.Heenan applied for the position of part-time Recreation Director at a salary of per month for 80 hours service,all hours in excess of 80 hours per month to be Paid for on s rata basis for which a claim shall be submitted endorsed by the Hecreation Commission. Mr.~ application was endorsed by the recreation commission signed by Chairman Helen Siebecker an~ Lura Sellick. Councilman Minucciani moved the offer be accepted.ihe motion was seconded by c an Holston and regularly carried. The salary of director Heenan to start March ~,1943. Congressman John Z.Anderson of this district answered the city's request to aid the sc of the erosion ~ifficulties at the head of Colma Creek in this city,stating appropriations this clas of assistance have been curtailed by the United States government during the War Emergency, but he would take the matter up with the Chief of the Erosion Control Section of Department of Agriculture for his advice and suggestions, and will advise the city when add~ information is received. Accepted and filed. Pacific Gas & Electric Company requested permission to make excavations in Hillside Boule at Grove & Highland Avenues for the purpose Of installing 2" gas mains to supply houses tha~ to be built by George Arthur & Sons. Referred to councilman Minucciani. A communication was received from L.C.Smith ,offering to disk and operate a tractor for ~ city in cutting weeds for the sum of $$5. 50 per hour. ~eferred to Fire Chief ~elte. Pete Dress applied for a permit to make alterations to his place at 224 Grand Avenue to ~ form it into a restaurant~at an approximate cost of $400.Building Inspector Wel~ reported approval. Councilman Holston moved the permission be granted. The mo~ion was seconded by co~ man Lloyd and regularly carried. Round California Chain Co. requested the payment of $14.81 paid to Wm.Minucciani for reps their water lin~ broken by our city workmen. Amount ordered paid. A written communication was received from Engineer U.S.Mzrshall demanding a written and ~ statement of the reasons for his suspension. ~ stetement of the reasons was submitted for ? city's record and a copy ordered sent to Mr. Marshall~ and the Personnel Board. Mr. Multier of Hotel Brayton reported he did not have to pay for a billboard sign ss~he ~ the owner of the lot on which the sign rests. City council disagreed with this view and stet he would have to pay. A communication was received from the Department of Notor Vehicles,Sacramento,Callfornia,~ answer to the city's letter requesting that the driver's examination service be restored to City of South San Francisco,stating he is in favor of it and will contact the Legislature f¢ the necessary~a~'~opriation. Accepted and f~led. Sanitary Inspector Schlaam submited a leng~$y~and~i~de~iledoreport on the condition of the Barsuglia Apartments,Bayshore Soulevard,near Lux Avenue showing most of~ the ten apartments t unsanitary and unfit to live~in. It was agreed that he and city attorney Coleberd ~e~ld co-operate in ~aving the places made sanitary or condemning the premises. The following appointments were submitted by chief of police Belloni as special policemen At Belair Shipyard;- Donald ~.Smith and Harry Blaine Gorman; At Western Pipe S. Steel Co.,- Vilman Patterson, Joseph Taddie,Fred W.Murray,Karl J.Hokans,Arthur Westing,Herbert B.Macom~ Ronald M.McPherson,Arthur J.Walkup, Anthoney J.Wina6el,John F.Kuhl and Berdeen O.Hill. Court( Holston moved the appointments be confirmed, without expense to the city. The motion was sec( by Councilman Lloyd~ and regularly carried. The monthly repo~s of the Sanitary Inspector,Chief of Police,Fire Chief,Building Inspecto~ master, city Judge and librarian were received for the month ending February 28, 1943.Counc3 MinucCiaD~ moved the reports be accepted as read. ORDINANCE NO.~ An ordinance repealing Ordinance No.201 entitled"AN ORDINANCE AMENDING SECTION 3 OF ORD~ ~66 OF THE CITY OF SOUTH SAN FRANCISCO ENTITLED'AN ORDINANCE H£GULATING AND RELATING TO TH! ERECTION,CONSTRUCTION AND MAINTENANCE OF ADVEHTISING STH.UUTUHES~ ~ND THE PLACING AND MAINTEN^NCE OF SIGNS IN THE CITY OF SOUTH SAN FRANCISCO; LICENSING AND REGULATING THE OCCUP~ OF OUTDOOR ADVERTISING,PROVIDING FOR THE ISSUANCE OF PERMITS AND P~S ~HEREFOR$ requiring t! PERMISSION OF THE OWNER OR LESSEE OF PROPERTY UPON WHICH ANY ADVERTISING STRUCTURES OR SIG! LOCATED,AND PROVIDINJ PENALTIES FOR THE VIOLATION OF THIS ORDINANCE,ADOPTED MARCH 8th,1934": introduced by councilman ~inucciani and had its first reading and laid over till the next m~ of the council. The City Clerk next presented a petition submitted to him requesting the city council t reconsider, and entirely repeal Ordinance No.O~V, whi ch ordinance amends Ordinance No.216,t Civil Service ordinance,or submit the ordinance to a vote of the people either at a speci~ election called for the purpose or at the next general municipal election. The city clerk certified there were V08 elegible names of voters on the petition, and therefore a sufficie~ number to qualify as voters to the petition. It was decided to place the proposition on the ballot At the municipal election in April,l~44. Mayor ~atto handed the clerk a list of charges against city engineer ~arshall and aske( that a record of them be written in the minutes of the meeting. There were 14 charges in th~ as follows;- CHARGES FILED AGAINST U. S. MARSHALL, CITY ENGINEER l$ Permitting contractor to lay sanitary sewer in Hillside Boulevard while water was in ditch. Resulting in poor joints and allowing seepage water to enter sewer. Failing to prepare plans for proper disposal of storm waters in Paradise Valley Subdivision, t. e., storm water sewers to carry water. Poor inspection of the construction of the pavements in Paradise Valley Sub- division, especially t~e oil and rock screening for surface. Permitting the shape of the finished pavements in Paradise Valley subdivision to be constructed so that after heavy rains, storm water continues to ~low on per month for 80 hours service,all hours in excess of 80 hours per month to be Paid for on a ; rata basis for which a claim shall be submitted endorsed by the Hecreation Commission. Permitting the shape of the finished pavements in Paradise Valley subdivision to be constructed so that after heavy rains, storm water continues to flow on the pavement instead of concrete gutter. This being very detrimental to the oiled wearing surface. Permitting release of contractor on Paradise Valley subdivision pavement, before the base and surface pavement on Randolph Avenue was fully com- pleSed. Lack of foresight regarding the maintenance of Colma Creek, in that ample provision should have been made for the deposit of the silt easterly from the~ end of the lined channel. This ~lure resulted in the flooding of Circle Cou~t homes, flooding Linden Avenue and flooding and depositing of several feet of sand in the City Park,~resulting in damage to shrubs, etc., and labor to the extent of $6,000~ Recommending to the City Council the payment to the Union Paving Company of $17§2.04 as due them on t~e construction of Linden Avenue. There was no basis for the recommendation other than the statement of tt~e Paving Company. Estimate furnished the City Council covering removal of rails and street widening project on East Grand Avenue. The cost of the projects was over twice the amount of the estimate. 4 gutters appearing Where rails were removed. Poor inspection of the construction of the pavement in Southwood subdivision. 10. The St~mp Deal. Whereby only $147.00 was deposited in the City Treasury in payment for the dumping of stumps in the city dump. Marshall report- ed the city was to be paid $1.00 for each stump. Over 1200 stumps were put in the dump. llo lye As a result of the poor handling of the Colma Creek p~oblem, the~ City is now defending itself against payment of damages for flooding or adjoin- ing property. Marshall's assault upon Councilman Ratto in the City Hall Council Chambers. 14, Faulty description of lands at the time Southwood was made a part of this city. Act of Legislature will probably be necessary to correct the error. Mayor Hatto requested that a copy of the charges he sent Mr. Marshall and a copy to the Personnel Board. In the matter of the amount of pay due engineer ~ia~shall it was decided that,.as he had reported for duty at the city hall Erom the 10th ~o 15th of February,he was entitled to six days pay. The result of the charges being submitted loRves engineer ~larshall suspended for 30 days after ~hic~ he may report ~or further action. At this juncture ~ouncilman Boido remarked it was a shame to suspend Mr. Marshall,that the one that ought to be suspended was Mr. Ratto because he collected rents from the city for property that he owned while a member of the board. Mayor Ratto retorted saying ,"If you say I own that property you're a liar,Come into my office and I'll show you all the ~papers co~necte~ with the ~eal,that is if you can understand them after you read them. Did you read the explanation-~t I put in the Enterprise?". Councilwoman Boido,in an angry tone of voice,told the Mayorthat if he called him a liar again he would take it out on him or words to that effect~that he was always trying to dictate and that it is time that the people should take some action against him. The Mayor stated he could take care of himself. Councilman H01ston stated that if the char£~es against. ~ngineer Marshall are sustained ~nd he is dismissed he will make a motion to revert to the Salar~ syStem~by the month instead of the fee system. Heferringto the Referendum petition to h~ve the people vote on civil service Mayor Ratto asxed ~i · city attorney Coleberd ~f the question of putting part-time employees on civil service could be placed on the ballot. Mr. Coleberd said it could. On question by Ma~or Ratto city attorney Coleberd ruled that the K~rkbride 8~ Wilson bill fora trying to break the ci6y's civil ~ervice ordinance is invalid. Mayor Hatto stated ~r. Coleberd was here at the time,& ,as city attorney,did he not think it was his duty to advise the council. Mr. Cole0erd stated the law was proven valid ~y the higher courts,and he could not go against his own ordinanoe which was backed by the courts,~end that he had not been asked to give,his advice, and belives the individual members of the board are responsible for the amount.He also stated the Wilson bill of $150 for the city's Rules and Regulations is exorbitant, that J~ of the rules are stock in the office of the League of California Cities, that he has them in his own office,and could have used them ~f he had been asked to, He declared the present set of Hules & Regulations will have to undergo a few changes to suit present conditions. The poundmaster reported the pound in very poor physical condition, a big hole in the rear where slus~ and mud come in and dogs run out,three escaping within a week. It was decided to repair the premises and the matter was referred to councilman Minucciani. Councilman Lloyd reported~planes from Mills Field flying low over factories and residences of the city and suggested a mild letter respecting tle situation be sent to Major Clo~R of the command. The suggestion being favored by the council he moved the clerk be so instructed. The motion was second- by councilman Holston and regularly carried. The recreation Chairman Helen Siebecker reported the tool house broken into and ~any tools stole$.~eferred to the police department. In the matter of the request of the Growers Rice Milling Company for road construction at their plane City Attorney Coleberd stated he would look up the title to the present road. Councilman Minucciani reporte~ 0.K on the request of the P.G.~ E., co.to place a gas m~in in ~00 feet of Butler Avenue. In the matter of the S.S.F.Land & Imp.Co's request to rettrrn ~7.300 on account of alleged non-filfullment of the city's contract with them on the construction of the South Industrial Area Sewer,the city attorney stated he would have advice on it next meeting.
