Ma2or George. ~.holston, being sick and unable to attend~councilman ~iinucciani nominated Charles K.£1der for the position of temporary kayos. Ir. Elder assumed the chair and called for the roll call,-.which was as follows;- Councilman, ~G.A.Anderson, Victor Boido, ~;harles K.Elder a~ k.~inucciani. Counctlmen,~bsent, Georse N.Holston. The city cl~rk havin~ forware~ copies of the previous meeting to all members, Acting ~a~.or Llder asked if anyone not, ced anF .~err~rs or omissions. Councilman ~[inucciani noticed that in the gasoline bids that of the Richfield 0il the bid should ~ave been for E~hyl ~0.116, and the bid was changed accordingly. A communication was received from ~r. Andrew Rocca,chairman of the Plannin~ Commission, together with mars of the new proposed zoning changes in the town . It was an.up to date program, and showed five districts affected. The maps were accepted by the city council and referred to citE attorneF Coleberd, who will prepare them for the city .~m~.~ as.soon as possible. ~cting~'ayor Elder .asked if there were any persons present who wished to protest against the annexation of 93.~38 acres of land of the 2urn-Burl Eomes to the City of South San Francisco. or anF Written protests against the same. There were none. 0RDIEANCE N0.~44. An ordinance ~f tt~e Cit~ o~ South Sa~ FranCisco approving the annexation of Duff-Burl [iomes to the City of South ~an ~'rancisco, had its second reading, as follows;- The City 5ouncil of the Cit~ of South San Francisco does ordain as follows; WHERFAS the City Council of the Oity of South San F~ancisco did, on the 26th day of December, 1945, receive a written petition from Buri-Burt Homes, Inc., a corporation organized and existing under the laws of the State of California, to annex to said City of South ~an Francisco the uninhabited territory, hereinafter described; and WHEREAS the territory hereinafter described is the territory sought, in said petition, to be included in said City of South ~an Francisco and is uni~zhabited territory, as the expression "uninhabited territory" is used in that certain act of the Legislature of the State. of California entitled~ "An act to provide for the alteration of the boundaries of incorporated t~wns and cities by the annexation of uninhabited territory thereto and for the incorporation of such annexed territory in and as a part of such municipality, and for the dis- ti-ictinE, government, and ~unicipal control of such annexed territory.", Chapter 297 of Statutes of 1939, as amended, and is cont. tguou~ to said City of South San Francisco; and WHEREAS, on the 26th day of December, 1945, said City Council did pass its certain resolution giving notice of the proposed annexation of the uninhabited territory hereinafter described to said City of South San Francisco, and did, in said resolution, fix Monday, the 21st day of January, 1946, at the hour of 8 o'clock p.m., in the Council Chamber in the City Hall of said Cit.v of South San Francisco'as the time and place when and where any persons owning real property within the territory hereinafter described, and so proposed to be annexed, and having any objection to the proposed annexation of said territory, may appear before said City Council and show cause why said territory should not be so annexed, and did, in said resolution, find that said corporation is the owner of more then one-fourth (1/4) of the area of the land hereinafter described and represents more tha~ one-fourth (1/4) of the assesst~d value of said property according to the last preceding equalized assessment roll of the County of San M~teo; and said City Council did, in said resolution, direct that the City Clerk of said city cause a copy of said resolution to be published once a week for two (2) succ- essive weeks pripr to the 21st day of January, 1946, in "The Fnterprise", a weekly newspaper of general cir- culation published in said City of South San Francisco; and WHEREAS said resolution was published in said "The Enterprise" on the following dates: The 2nd, 9th and 16th days of January, 1946; and WHEREAS no person has filed or made any written or other protest against the annexation of said territory, or any part thereof, to said City of South San Francisco; N~, THEREFORE, said City Council does ordain as follows: Section 1. Said Cit~ Council hereby determines that said Buri-~zri Homes, Inc., a corporation, is ~he owner of more than o'ne-fourth (1/4) of the area of the ]and hereinafter described and represents more than one- fourth (1/4) of the assessed value of said land according to the last preceding equalized assessment roll of said County of San Mateo and that said land is uninhabited territory and is contiguo~us to said City of South San Franc[ sco. Section 2. Said City Council hereby approves the annexation to said City of South San Francisco of the territory described as follows: The land hereinbefore described consists of all that certain tract or parcel of land ~ttuate in the County of San Mateo, State of California, and particularly described as follows: Begin at a point on the southwesterly line of the state highway known as E1 Cam~no Real, said line being the southwesterly corporate limits line of the City of South San Francisco, at the intersection of said line with the center line of Twelve Mile Creek, said point being the most easterly corner of that certain tract of land described as Parcel I in deed from Edward P. Murphy, Trustee, to California Pacific Title Insurance Company, dated October 9, 1945, and recorded October lO, 1945, Recor~er's file No. 67884F, Records of San Mateo County, California; ', Run'ning thence from ssd. d point of beginning northwesterly along said southwesterly line of E1 Camino Real the following courses and dihtances, on the arc of a cruve to the left, the cente~ of wkich bears South 51 degrees 13 minutes 43. seconds West 2967 feet from the point of beginning of this deocription, having a radius of 2967 feet and a central angle of 9 degrees 43 minutes 45 seconds, an arc distance of 503.81 feet; thence North 45 degrees 30 minutes West 647.53 feet to the intersection of said southwesterly line with the southwesterly production of the southeasterly line of Oak Avenue, as said Oak Avenue now exists in the City of ~outh ~an Francisco; thence North 53 degrees 06 minutes 45 seconds East, along said last mentioned line, which is also the corporate limits line ef the City of South San Francisco, 67.3~8 feet to the northeasterly line of E1 Camino Real; thence in a nort~mvesterly direction along said northeasterly line of E1 C~nino Real the following courses and distances: North 48 degrees 30 minutes West 2J~.20 feet to a point; thence on the arc of a curve to the left, tangent to said last mentioned course at said last mentioned point, having a radius of 1033 feet and a central angle of 7 degree 51 minutes, an arc distance of 141.53 feet to a point; th.ence North 56 degrees 21 minutes West l178.10 feet to a point; thence on the arc of a curve to the right, tangent to said ~ast mentioned course at said last mentioned ooint, having a radius of 767 feet and a central angle of 38 degrees 29 minutes 08 seconds, an arc dj'stance of' 515.19 feet to a point, said point being the intersection of said northeasterly line of E1 Camino Real with the northeasterly production of the northwesterly l~ne of the above described tract of land conveyed to California Padific Title Insurance' Company; thence leaving said northeasterly line of E1 Camino Real South 40 degrees 13 minutes 36 seconds West, along the northeasterly production of the northwesterly 'line of said tract of land conveyed to California Pacific Title Insurance Company and along the northwesterly line of said tract of land, 2376.59 feet to a point thereon; thence leaving said last mentioned line ,South 84 degrees 30 minutes East 930 feet; thence South 71 degree 30 minutes East 680 fact and South 64 degrees 59 minutes East 516.98 feet, more or less, to a point in the center line of Twelve Mile Creek, hereinbefore mentioned; thence in a general easterly direction down the center of said Twelve Mile Creek the following courses and distances: North 28 degrees 15 minutes 20 seconds East 231.65 feet; South 66 degrees 05 minutes 50 sedonds East 153.63 feet; North 80 degrees 14 minutes 30 seconds East 303.70 feet; South 63 degrees 45 minutes 40 seconds East 148.20 feet; South 89 degrees 42 minutes l0 seconds East 135.25 feet; South 64 degrees 19 minutes 40 seconds East 32.10 feet; North 34 degrees 15 minutes 40 seconds East 56.67 feet; North 75 degrees 24 minutes l0 seconds East 96.71 feet; South 73 degrees 55 minutes 50 seconds East 60,05 ~eet; North 79 degrees ll minutes 20 seconds East 155.50 feet; South 85 degrees 51 minutes 40 seconds East 376.60 feet; North 81 degrees 56 minutes 50 seconds East 68.86 feet: South 86 degrees O1 minute 50 seconds East 56.18 feet and North 81 degrees 48 minutes 35 seconds East 17~.26 feet to the point of beginning. Containing 93.938 acres of land, more of less, and being a portion of the hereinbefore described tract of land conveyed to CaLifornia Pacific Title Insurance Company and a portion Of the state highway known as E1 Camino Real. ~ection 3. This ordinance shall be published by one insertion in "The Enterprise", a weekly newspaper of general circulation printed and published in said City of South San Francisco and shall take effect and be in force upon the expiration of thirty (30) days £ollowing its passage. Introduced this 21 st day of January, 1946. Passed and adopted as ~.n ordinance of the ~mty of South San Francisco at a regular meeting of the City Council of the City of South San Francisco, this 28th day of January, 1946, by the following vote: Ayes, Councilmen Noes, Councilmen Absent, Councilmen V. W' Holstwn The foregoing ordinance is hereby approved by me, as Mayor of the City of South San Francisco, this 29th day of January, 1946. Councilm~n :inucciani so moved,and was seconded by councilman Boido and regularly carried. The cost of r~ifying the bonds will b~ · $ 5o. oo. kr. Cole:~:~erd stated he was working on the a'.:,atement of the hill side sign~ and stated he expected it will be some time before he gets it in line to su~t the city. Pie stated also that he has been in to~ch with ~arret 6~ Lilp, and ~equested authorization to proceed further with them in order to m~ke a settlerr~ent. Councilman l~inucciani moved the required m~thorit~ be granted ~r. Coleberd in negotiating with Oarrett & P. ilp in their settleme~ of the slough dispute. The motion was seconded by co~ncilm~n Anderson and re~ularl~ carried. ~ere appearing no furth~:~r business :~e'ore the board councilman Einucciani moved to adjou~ until ~onday, Peb. 4,1946, at 8 o'clock P~i.
