ORDINANCE NO. 450 AMENDING ZONING ORD. #353 (LEO LOMSKY - HORSE RANCH, INCo) ALIDA WAY IMPROVE- MENT - APPROVAL OF COST AND AUTHORIZATION SPRUCE AVENUE IMPROVEMENT: REMARKS OF COUNCILMAN CORTES RE GRADING I N CALLAN TRACT: ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO HELD MONDAY, AUGUST 8, 1960 5:00 p.m. Council Chambers, City Hall The meeting was called to order by Mayor Rocca at 5:07 p.m. Present: Councilmen Andrew Rocca, G. J. Rozzi, Emilio Cortesi, Leo J. Ryan and Patrick Eo Ahem Absent: None City Attorney Noonan explained the first item for Council's attention whic concerned a proclamation for "Social Security Week". After the explanatio Mayor Rocca proclaimed the week of August 12-19, 1960, as "SOCIAL SECURITY WEEK" in the City of South San Francisco. The City Attorney then explained the resolution which had been prepared ex pressing sympathy to the family of Charles Zipfel, after which Councilman Ryan introduced: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SA FRANCISCO EXPRESSING SYMPATHY TO THE FAMILY OF CHARLES ZIPFEL". Roll call vote was as follows: Ayes, Councilmen Andrew Rocca, G. J. Rozzi, Emilio Cortesi, Leo J. Ryan and Patrick E. Ahern. The next resolution was then explained by the City Attorney, after which Councilman Ryan introduced: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO EXPRESSING SYMPATHY TO THE FAMILY OF MICKEY CONTE". Roll call vote was as follows: Ayes, Councilmen Andrew Rocca, G. J. Rozzi Emilio Cortesi, Leo J. Ryan and Patrick E. Ahern. The last resolution was then explained by the City Attorney, after which Councilman Ahern introduced: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO PROVIDING FOR SALARY INCREASES, AND ADJUSTMENTS, AND SALARY SCHEDULES, SALARY CONVERSION TABLES AND CLASSIFICATION PLAN FOR FISCAL YEAR 1960-61". Roll call vote was as follows: Ayes, Councilmen Andrew Rocca, G. J. Rozzi, Leo J. Ryan and Patrick E. Ahern. No: Councilm~ Emilio Cortesi. Council then proceeded on to the matter of the public hearing concerning a proposed amendment to the Zoning Ordinance, rezoning Parcel 30, Assessor's Map of South San Francisco #1 from an R-1 to an R-3 District, this matter having been set for public hearing at this time. Mayor Rocca declared the public hearing open, asking if any written protests had been received, to which the City Clerk replied none had been received. He then asked if the~ were any oral protests or if anyone knew of any oral protests. There beint none, Mayor Rocca declared the public hearing closed. City Attorney Noonan then explained the second reading and adoption of the ordinance amending the Zoning Ordinance of the City, after which he ex- plained the form of motion Council could adopt. Councilman Ahern then mov, seconded by Councilman Ryan, that the reading in its entirety of the ordin- ance entitled "AN ORDINANCE AMENDING ORDINANCE NO. 353 ENTITLED 'ZONING ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO', PASSED AND ADOPTED AUGUST 1¢ 1954" be waived and that it have its second reading and be passed on the reading of title only. Roll call vote was as follows: Ayes, Councilmen Andrew Rocca, G. J. Rozzi, Leo J. Ryan and Patrick E. Ahem. Councilman Emilio Cortesi abstained from voting. City Attorney Noonan then explained the second motion which could be adopted in connection with the matter, afd which Councilman Hezzi moved, seconded by Councilman Ryan, that the ordina~ titled: "AN ORDINANCE AMENDING ORDINANCE NO. 353 ENTITLED 'ZONING ORDINANC! OF THE.CITY OF SOUTH SAN FRANCI~OO', PASSED AND ADOPTED AUGUST 10, 1954" be passed. Roll call vote was as follows: Ayes, Councilmen Andrew Rocca, G. J. Rozzi, Leo J. Ryan and Patrick E. Aherno Councilman Emilio Cortesi abstained from votinge City Manager Aiello at this time brought to Council's attention the matter of the improvement of Alida Way, askin~ if it was Council's desire to accept the plans for the work at this time. Explanation was given by Dir- ector of Public Works Goss concerning the method by which the cost would be borne for this improvement work, after which Councilman Ahern moved, seconded by Councilman Rozzi and regularly carried, that the plans and cost estimate be accepted and the circulation of the petition for the improvemer work authorized. City Attorney Noonan at this time brought up the matter of the Spruce Avenu improvement, recommending that the plan be discussed with Mr. Wilson of the firm of Kirkbride, Wilson, Harzfeld and Wallace before the petition was circulated so that in the event of a law suit, the petition and assess- ment proceedings would stand up in court. Discussion followed concerning the improvement work and the rezoming of the area, after which the City Attorney explained the motion which could be adopted by Council. Councilms Rozzi moved, seconded by Councilman Ryan, that the Director of Public Works confer with Ernest Wilson, the bond counsel, regarding the method of assess ment and det~mining if it met the requirements. Motion as made and sec- onded was regularly carried. Councilman Cortesi abstained from voting. City Manager Aiello at this time brought to Council's attention the matt of the improvement of Alida Way, asking if it was Council's desire to accept the plans for the work at this time. Councilman Cortesi at this time brought to Council's attention the matt, of the grading work now taking place in the proposed Callan tract which posed some grave conditions concerning the amount of tree limbs, loose ~ leaves and stumps and other debris which was in the area of the 12-Mile Creek, stating that if rain waters collected behind this material, a ca' trophe could very well take place. He suggested that these matters be brought to the attention of the Manufacturers Association in assisting' City, since they would be directly affected by this danger as well. MEETING WITH ENGINEERS RE CALLAN TRACT GRADING: Discussion followed, at which time, Director of Public Works Goss explained the meeting which was to be held the following day at 1:30 with Mro Chapman engineer for the City of Daly City, and Mr0 Theodore Tronoff, engineer for Callan, on the site itself. Mr. Goss explained that he had requested the presence of Mr. Callan but was informed that Mr° Tronoff would be represent. ing him. Mr. Goss at this time explained the photographs which had been taken of the area. City Attorney Noonan suggested that information be com- piled and notice be sent by registered mail to the City of Daly City and the subdivider, Mr. Callan, forwarding the photographs, placing them on notice concerning the dangerous conditions which would damage our facilitie~ as well as public and private properties. He further stated that he would prepare the notice which was to be forwarded to Mr. Callan and the City of Daly City. ADJOURNMENT: There being nothing further, Councilman Rozzi moved, seconded by Councilman Ahern and regularly carried, that the meeting be adjourned to 8 p.m. on August 15, 1960.
