Council Chambers, City Hall CALL TO ORDER: The meeting was called to order by Mayor Rocca at 8:00 p.m. PLEDGE OF ALLEGIANCE AND INVOCATION: Pledge of Allegiance to the Flag was recited after which no invocation was given because of the absence of the Reverend R. Eugene Linamen of the HilLside Church of God. ROLL CALL: Present: AbsenJ: Councilmen Andrew Rocca, Patrick E. Ahern, Emilio Cortesi, G. J. Rozzi, and Leo J. Ryan. None. MINUTES: At this time Mayor Rocca asked if there was a motion approving the minutes of the regular meeting of March 6, 1961 as submitted. Councilman Ahern moved, seconded by Councilman Rozzi and regularly carried, that the minutes of the regular neeting of March 6, 1961 be approved as submitted. CLAIMS: Mayor Rocca then asked if there was a motion approving the regular claims as submitted for payment. Councilnan Rozzi moved, seconded by ..................................................... Councilman Ahern and regularly carried, that the regular claims totaling $31,982.08 be approved for payment. PARKING DISTRICT CLAIMS: Parking District No. 1 Claims: Penna's Hardware Claim dated March 2, L961 in the amount of $1.48 for hack saw blades. Haaker Insurance Agency Claim dated March 8, 1961 in the amount of $11.20 for additional insurance. Standard Oil Company of California Claim dated March 1, 1961 in the amount of $50.00 for lot rental for the month of March, 1961. City of South San Francisco Claim dated March 9, 1961 in the amount of $395.69 for labor, equipment, and material - Lot No. 5. Councilman Rozzi moved, seconded by Councilman Ryan and regularly carried, that the claims as submitted for Parking District No. 1 be approved for payment. SSF INDUSTRIAL PARK UNIT 2-C, ZONE 2 CLAIM: SoutL San Francisco Industrial Park Unit 2-C, Zone 2 Claim: DaLe Williams, Inc. Claim dated February 28, 1961 in the amount of $600.00 for final payment on work done on fire alarm system. CouncLlman Ahem moved, seconded by Councilman Rozzi and regularly carried, that the claim be approved for payment as submitted. CALLAN PARK PUBLIC HEARING (PLANNED COMMUNITY AMENDMENT) Proceeding on to public hearings, Mayor Rocca stated that the matter of the Callan Park annexation was continued from the last regular meetkng of the Council held on March 6, 1961 and before proceeding on with ~he public hearing Council first would consider action on Planning Commission item No. 5 (a) -- memorandum dated March 15, 1961 from 5he Planning Commission requesting that Ordinance Amendment for the Planned Community be returned to them for further study with a public hearing to be conducted. The Mayer further stated that the action of Council at this meeting would be concerning the annexation of the area only. At this time Councilman Ahem stated that he felt as elected individ- uals they should express their views concerning the matter and he had prepa'red a statement in regard to the Callan Park annexation, which he requested be distributed to those present and from which he read. This s~atement was entitled, "Callan Park Annexation". After having completed his prepared statement Councilman Ahern moved, seconded by Councilman Rozzi, that the recommendation of the Planning Conunission as contained in their memorancum of March 15, 1961 be approved and accepted and the Ordinance Amendment for the Planned Community be returned to the Planning Cor.mission. Brief discussion followed, after which the motion as made & seconded was regularly carried. Mayor Rocca at this time remarked that if there was anyone present who wished to speak further on the matter of the Callan Park annexation, they could do so at this time. The following persons then spoke: CALLAN PARK PUBLIC HEARING (CONTINUED): John Canepa, president of the Winston Manor Home Owners' Association read from a prepared statement, remarking nhat his group feels the property should be annexed for purposes of control, the matter of the Planned Community Town Houses should be referred back to the Planning Commission, the Planning Commission should spend an amount of money necessary to have an architect prepare a model of the proposed develop- ment and also should educate the public concerning Town House develop- ment. Els group went on record as favoring annexation. Josepk Powers, president of the Serra Highlands Improvement Associa- tion, remarked that his group was one of the first to prepare a resolution to Council recommending the undertaking of a constructive course of action. He stated that his organization favors annexation. Mr. C~neron, a resident of the Buri Buri s~bdivision, commended the action of Council and stated that he would like to have explained now or at a later date by the City Manager, the Director of Public Works, the PLanning Commission, Planning Consultant Spangle, and the Callans the matter of the new ORDINANCE on the planned subdivision of 60 or more ~cres, how the City would benefit by the ORDINANCE, and have Mr. CaLlan explain his plans for the development of the 650-acre tract. He likewise favored annexation. CounciLman Ryan suggested that these matters be deferred until the Planning Commission can meet later but further discussion was generally agreed upon. Don P]-eston, 432 Railroad Avenue, briefly discussed the matter of Town HoLses and Green Belt development, stating that he favors annexa- tion of the area. Mario Bregante, 568 Miller Avenue, remarked that the development would create new jobs and more work, which woul~ benefit the economy of the City. He likewise favored annexation. Harry Snith, 304 Gardenside Avenue, remarked that in speaking to the people mn his area about 75% favor the anrexation since the area is within ~he school boundaries of the City; he also favored annexation. Theodore Everson, Hillside Boulevard, remarked that after the previous meeting he came to the City Hall and received the information he sought from ~e City Manager and the City Attorney. Mario Gagliolo, 760 Grand Avenue, suggested and stated that he favors the placement of the matter of annexation on the ballot for decision by the voters. At the request of Councilman Ryan, the City Attorney explained the details which would have to be followed if the matter were placed be- fore ~ne voters. Harry Snith asked City Attorney Noonan concerning the matter of place- ment on the ballot, after which he (Smith) stated that although he was in full favor of due processes of law, in order to protect the City theys~uld annex without benefit of voting by ballot. Further explanation was given by the City Attorney, after which Alfred Figone, representing the Carpenters' Unior., remarked that there are three factors to consider: 1. civic responsibility, 2. economic factor, 3. social factor. He further stated that he opposed the annexation to Daly City because he felt the land belongs in South San Francisco and favors such annexation. Betty Hammon, 633 Del Monte, felt that if the development was to occur, the City should have control and she favors annexation. R. P. Lyons, attorney at law, commented on the loss of subventions, grants, and revenues which would be realized by the City from the State if the area was not annexed and remarked ~hat as a resident and taxpayer he favors annexation. Recess was declared at 9:35 p.m. for a tape change on the recorder and the meeting recalled to order at 9:43 p.m. Victor 3oido, Orange Avenue, suggested the City move ahead with the development on a 50-foot lot basis. Bart Connolly, 119 Duval Drive, stated that he concurred with the Winston Manor Home Owners' Association concerning the matter of annexa- tion and suggested that the City assess a fund of money for studies which would be adequate to explain to the citizens the development of the area. George Stagnaro remarked that he presently and for some time has been living in a home built on a 25-foot lot, similar to the Town House, and he is very happy with the type of home in which he now lives. He favors annexation. CALLAN PARK PUBLIC HEARING (CONTINUED): ORDINANCE -- CALLAN PARK ANNEXATION... 1ST READING: KARL PETTERSON PUBLIC HEARING: Thomas Ritchie, 232 Dundee Drive, stated that the City has its elected Council representatives and heads to do a job and a thorough study has been nade of the matter so he felt Council should vote on it at this time, whether or not annexation is desired. Mr. Worbenberg remarked that he favors annexation and the matter of the Town ~ouse be referred back to the Plannirg Commission. Morris Skulsky, 807 Second Lane, remarked that he is not opposed to the annexan~on but had been opposed to the method by which it was being handled. He also said that he favors annexation to the City. Marlo Gagliolo then suggested continuance of the matter to the next meeting and in the meantime the City Attorney prepare a statement concernLng the losses which would be suffered by the City by not annexing that could be publicized so those not at the meeting could be no~ified and could be present the next time. There being no further comments, Mayor Rocca extended his thanks to everyone for their part in this discussion, for the business-like manner in which the meeting was conducted, and expressed that he was pleased to hear it is the general feeling Council had approached the matter on a studious basis, that it had been studied for a long time and Council would continue to study it. At this time Mayor Rocca declared the public hearing on the matter of Callan Park annexation as closed. City Attorney Noonan then stated that, if Council wished, they could proceed to the matter of introduction and first reading of the ORDINANCE on Callan Park Annexation. Councilman Ahern moved, seconded by Councilman Ryan, that the Council proceed to the matter of introduction and first reading of the ORDI- NANCE. The roll call vote was as follows: Councilman Ryan "aye". Councilman Rozzi requested clarification ~s to his status of voting, stating that at the previous meeting mention was made of Mr. Poletti's name, a realtor, and Mr. Poletti who is his employer a year or two ago sold · one-sixth interest in a 40-acre parcel which is now included in the C~llan Park area; he requested of the City Attorney whether or not it wo~ld be in order for him to vote. City Attorney Noonan replied that inasmuch as his investigation disclosed Mr. Poletti still holds a mortgage on the property, he recommended that Councilman Rozzi abstain from voting. Councilman Rozzi then stated that although he would like to cast his vote, he would absnain from voting at this time. Councilman Ahern voted "aye". Councilman Cortesi asked if any member of the Council has any interest in the development of Callan Park, stating if Councilman Rozzi did not vote, he likewise would not vote and that he would not vote unless all five Council members voted. Councilman Cortesi voted "nay". Mayor Rocca remarked that before voting he wished to state he does not have an interest in Callan Park or is he connected in any way as an owner; he voted "aye". City Attorney Noonan then explained the O~DINANCE which had been pre- pared for Council's attention and was ready for its first reading and introductioa. He stated that a motion could be adopted by Council that reading of the ordinance in its entirety be waived and that it have its first reading and introduction by the reading of title only. Councilman Ryan so moved, seconded by Councilman Ahern and regularly carried. Councilman Rozzi abstained from voting and Councilman Cortesi did not vote. City Attorney Noonan then stated that a mo~ion could be adopted that an ordinance entitled: "AN ORDINANCE APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY DESIGNATED 'CALLAN PARK' TO THE CITY OF SOUTH SAN FRANCISCO" be introduced and have its first reading -- reading in its entirety having been duly waived. Councilman Ryan so moved, seconded by Councilman Ahern and regularly carried. Council- man Cortesi voted "no" and Councilman Rozzi abstained from voting. Proceeding on to public hearings, Council took up the amendment petition of Karl Petterson to rezone property located on E1Camino Real near the Kinney Shoe Store from a "U" to a "C-I" district. Mayor Rocca declared the public hearing open and asked if any written protests had been received, to which the City Clerk replied that none had been received by his office. He then asked if anyone present wishec to register an oral protest. There being none, Mayor Rocca declared the public hearing closed. Councilman Cortesi briefly left the meeting being held in Council Chambers. fi? PROCLAMATION -- FINE ARTS WEEK MARCH 20 - 27: Proceeding on to resolutions and proclamations, City Attorney Noonan explained the proclamation which had been 'prepared designating March 20--27, 1961 as "Fine Arts Week". Mrs. Robert Whitehead, 1st vice president of the South San Francisco Woman's Club, present in the audience, explained how "Fine Arts Week" will be conducted and extended an invitation to everyone to attend and view the displays. Mayor Rocca then proclaimed "Fine Arts Week" on the dates mentioned. RESOLUTION NO. 3149 REZONING PARCELS FROM "U" TO "C-l" DI STRI CT: Proceeding on to resolutions, City Attorney Noonan explained the first which had been prepared, after which Councilman Ahern introduced: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO APPROYZNG RECOMMENDATIONS AND REPORT OF TiE PLANNING COMMISSION FORWARDED BY RESOLUTION NO. 1361 OF SAID OOMMISSION REZONING CERTAIN PARCELS THEREIN AND HEREIN DESCRIBED TO A C-1 DISTRICT". Roll call vote was as follows: Ayes, Courcilmen Andrew Rocca, Patrick E. Ahern, G. J. Rozzi, and Leo J. Ryan. Noes, none. A0sent, Councilnan Emilio Cortesi. RESOLUTION NO. 3150 The C~'ty Attorney then explained the second resolution which had been COMMENDING prepared, after which Councilman Ahern introduced: "RESOLUTION OF JOSEPH LEONARD THE CLTY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO COMMENDING (RESIGNED) -- JOSEPH LEONARD FOR HIS SERVICES TO THE CITY AND AUTHORIZING THE RECREATION COMMISSION: ISSUANCE OF A CERTIFICATE OF RECOGNITION". ~ O O ~ Roll call vote was as follows: Ayes, Councilmen Andrew Rocca, Patrick E. RESOLUTION NO. 3151 AUTHORIZING UTAH AGREEMENT -- REPAIRS SSF INDUSTRIAL PARK UNIT NO. 1: City Attorney Noonan then explained the third resolution ready for the actio~ of Council, after which Councilman Ryan introduced: "A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO AUTHORIZING AN AGrEeMENT WITH UTAH CONSTRUCTION AND MZNING COMPANY, A DELAWARE CORPORATION, AND THE CITY OF SOUTH SAN FRANCISCO, A MUNICIPAL CORPORA- TION, R~GARDING REPAIRS IN SOUTH SAN FRANCISCO INDUSTRIAL PARK UNIT NO. 1". Roll call vote was as follows: Ayes, Councilmen Andrew Rocca, Patrick E. Ahern, and Leo J. Ryan. Noes, none. Absent, Councilmen Emilio Cortesi and G. J. Rozzi. RESOLUTION NO. 3152 COUNTRY CLUB CENTER TERRITORY ANNEXA- TION & PUBLIC HEARING NOTICE: City Attorney Noonan then explained the fourth resolution which had been prepared, after which Councilman Ryan introduced: "RESOLUTION GIVI~ NOTICE OF PROPOSED ANNEXATION TO CZTY OF SOUTH SAN FRANCISCO OF UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED 'COUNTRY CLUB CENTER TERRITORY', AND GIVING NOTICE OF TIME AND PLACE FOR HEARING OF PROTESTS THERETO". Roll call vote was as follows: Ayes, Councilmen Andrew Rocca, Patrick E. Ahern, and Leo J. Ryan. Noes, none. Absent, Councilmen Emilio Cortesi and G. J. Rozzi. ORDINANCE NO. 459 ESTABLISHING PARKING PLACE COMMISSION: The next item taken up by Council concerned the second reading and adoption of ORDINANCE NO. 459 regarding Parking Place Authority for the City, which was explained by City Attorney Noonan. He stated that a motion could be adopted by Council if they so desired that reading of the ordinance in its entirety be waived and that it be passed and adopted by the reading of title only. Councilman Ryan so moved, seconded by Councilman Ahem and regularly carried. City Attorney Noonan then remarked that a motion could be adopted by Ceancil that the ordinance entitled: 'AN ORDINANCE OF THE CITY OF SOUTE SAN FRANCISCO PURSUANT TO SECTION 35550.1 OF THE STREETS AND HIGH~%YS CODE PROVIDING FOR THE APPOINTMENT, REMOVAL, QUALIFICATIONS, TERM OF OFFICE AND NUMBER OF MEMBERS OF TIE PARKING PLACE COMMISSION FOR SOUTH SAN FRANCISCO" be read for the second time by title and be passe([ and adopted, the reading in its entirety having been duly waive([. Councilman Ryan so moved, seconded by Councilman Ahem. Roll call vote was as follows: Ayes, Councilmen Andrew Rocca, Patrick E. Ahern, and Leo J. Ryan. Noes, none. Absent, Councilmen Emilio Cortesi and G. J. Rozzi. Councilman Rozzi at this time returned to the Council Chambers and remakned for the balance of the meeting. ORDINANCE -- AMENDING ZONING ORD. NO. 353 (PARCEL FROM "U" TO "C-I" DIST.): City Attorney Noonan then explained the ordinance which had been prepared for Council's attention and was ready for its first reading and introduction. He stated that a motion could be adopted by Council that ~eading of the ordinance in its entirety be waived and that it have ±ts first reading and introduction by the reading of title only. Councilman Ryan so moved, Seconded by Councilman Ahern and regularly carried. (Councilman Cortesi absent.) Council then proceeded on to the matter of new business. Letter of March 10, 1961 was received from the South San Francisco Woman's Club requesting the week of March 20 - 27, 1961 be designated as "Fine Arts ~eek". This matter having been taken care of earlier under "ProcLamations", no further action was taken at this time. Letter of March 6, 1961 was received from the South San Francisco Woman's Club advising they will sponsor a "Best Photo" contest for the Wild ~r~s, official flower of the City of South San Francisco. There being no Objections, Mayor Rocca requestec the communication be acknowledged and placed on file. Letter dated March 6, 1961 was acknowledged from R. DeNardi, asking to file final completion notice on the Alta Vista Subdivision, South San Francisco. City Attorney Noonan remarked that, as requested by Council, he had prepared the following motion: "Move to accept the improvement in accordance with the recommendation of ~he Director of Public Works, said acceptance to become effective on the filing of a maintenance bond as required by paragraph 9 in Agreement between the City and developers, executed as of the 17th of August, 1960". Councilman Ryan accepted the motion as gi?en by the City Attorney, so moving, seconded by Councilman Ahern and regularly carried. (Councilman Cortesi absent.) Letter of March 15, 1961 received from the Santo Cristo Society requesting permission to hold a dance on Saturday, May 6, and a parade on Sunday, May 7, for their two-day celebration (asking the City to decorate as in the past); also received tSeir oral request to hold a bazaar and some rides on the premises to be conducted by the'Santo Cristo Society. Letter dated March 16, 1961 from the Santo Cristo Society was received, requesting waiver of license fee for the Nolding of a carnival by the West Coast Shows in conjunction with their annual two-day celebration. City Attorney Noonan stated that in accordance with Council's earlier request the following motion had been prepared: "That approval be giver the requests and the usual license fee for the holding of the carnival be waived subject to the following conditions -- 1. That there be filed with the City the required insurance certificates, holding the City harmless; 2. Further requirement of Police Chief Fabbri that the carnival be subject to inspection and approval of all activities on the grounds thereof and two police officers to be on duty during such hours that the grounds are open to the public (~he police officers to be paid ~t the expense of the West Coast shows)" Councilman Rozzi so moved, seconded by Coancilman Ahern and regularly carried. (Councilman Cortesi absent.) At this time Councilman Cortesi returned to the meeting and remained for its duration. Variance Permit Application No. 1361 was received from the Planning Commission recommending~proval of the request of Sam and Betty Sapp~ngfield for a 2-foot encroachment into required 20-foot rear yard and ~5% lot coverage instead of 40% at 142 South Magnolia Avenue, Lot 25, Block 7, Mayfair Village No. 2. Councilman Rozzi moved, seconded by Councilman Ahern and regularly carried, that the recommendation of the Planning Commission be approved and ~ccepted. Variance Permit Application No. 1362 was received from the Planning Comm~ssion recommending approval of the request of Frank J. Bachle for ~ 6-foot encroachment into required ~O-foot rear yard at 742 CircLe Court, Lot 25, Block 1, City Park Addition. CounciLman Rozzi moved, seconded by Councilman Ahern and regularly carr~ec, that the recommendation of the Planning Commission be approved and accepted. Variance Permit Application No. 1363 was received from the Planning Commission recommending approval of the request of Eda Fiorentini for permission to eliminate required side yard for residential use in a commercial zone to permit 5'3" x 15' addition at 811 Linden Avenue, N. 25' Lot 23, Block 129, South San Francisco. Councilman Rozzi moved, seconded by Councilman Ahem and regularly carried,, that the recommendation of the Planning Commission be approved and accepted. Use Permit Resolution No. 1365 was received from the Planning Commis- sion, recommending permission be granted for the request of Jose ~. Ramirez to erect a second single family dwelling on the rear of 34£' Lux Avenue, Lot 11, Block 126, subject to certain conditions. Councilman Rozzx moved, seconded by Councilman Ahem and regularly carried,I that the recommendation of the Planning Commission be approved and accepted. Use Permit Resolution No. 1366 was received from the Planning Commis- sion, recommending permission be granted for the request of Vincent Tammaro, Jr. to establish a business for distributing all types of patio, garden and building materials and supplies at the Northwest corner of Spruce and Mayfair, subject to certain conditions. Counciluan Rozzx moved, seconded by CounciLman Ahern and regularly carried, that the recommendation of the Planning Commission be approved and accepted. Use Permit Resolution No. 1367 was received from the Planning Commis- sion, recommending permission be granted for the request of the Sociedad Mutualista Mexicana Morelos, Inc. to erect a building to serve as a lodge for a mutual aid society, 221 Miller Avenue, Lot 15, Block L39, South San Francisco. CounciLman Rozzi moved, seconded by Councilman Ahem and regularly carrieC, that the recommendation of the Planning Commission be approved and acceFted. Use Permit Resolution No. 1368 was received from the Planning Commis- sion, rec~ommending permission be granted for the request of Don & Margie Preston to erect a 6-unit apartment instead of a 4-unit as previously approved by Use Permit No. 1329, at the rear of 432-434 Railroad Avenue, Lot 8 and W 25' Lot 7, Block 119, South San Francisco. Councilman Rozz~ moved, seconded by Councilman Ahem and regularly carried, that the recommendation of the Planning Commission be approved and accep.ted. Use Permit Resolution No. 1369 was received from the Planning Commis- sion, recommending permission be granted for the request of E. T. DaPont de Nemours & Company to erect ~dditional letters "Lucite" to exis:ing roof structure as per sketch, 160 South Linden Avenue, South San Francisco. Councilman Rozzi moved, seconded by Councilxan Ahern and regularly carried~ ~hat the recommendation of the Planning Commission be approved and accepted. CALLAN PARK ANNEXATI ON ORDINANCE -- READING At that time City Attorney Noonan stated he would read the annexation ORDINANCE for Callan Park in its entirety a~d asked for a reading and reintrocuction on that basis. Mayor Rocca ordered the reintroduction and rescing of an ORDINANCE entitled: "AN ORDINANCE APPROVING THE ANNEXAT]CN OF CERTAIN UNINHABITED TERRITORY DESIGNATED 'CALLAN PARK' TO THE CITY OF SOUTH SAN FRANCISCO', in its entirety by the City Attorney for the Council, after which the City Attorney read said ORDINANCE in full to the City Council. Councilman Ryan moved and was seconded by Councilman Ahem that the reintroduction and reading of an ORDINANCE entitled: "AN ORDINANCE APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY DESIGNATED 'CALLAN PARK' TO THE CITY OF SOUTH SAN FRANCISCO", as read in full by the City Attorney, pursuant to the Mayor's order, be approved. Roll call vote was as follows: Ayes, Councilmen Andrew Rocca, Patrick E. Ahern, and Leo J. Ryan. Abstaining were Councilmen Emilio Cortesi and G. J. Rozzi. Absent, none. GOOD AND WELFARE: There being nothing further, Mayor Rocca asked if any Council member had anything to offer under Good and Welfare. Angelo Canziani of Pine Terrace asked the City to take some action in removing earth (a result of rain action) which covered one of the City sign letters on Sign Hill. There being no objections, City Man- ager Aiello was requested to take care of the matter.
