COuncil Chambers, City Hall The meeting was called to order by Yayor Ryan at 8:02 P.M. Pledge of Allegiance to the Flag was recited. Present: A~sent: Councilmen Leo J. Ryan, Petrlck E. Ahern, Emilio Cortesi, Andrew Rocca, and G. J. Rozzi. None. There bein~ no objections, Mayor Ryan continued the Public H~arings on the Tidewater 0il Company Use Permit for a sign and the Highlands Baptist Church Annexation. S[ty Manager Aiello reported on the water pollution report w~th reference to the improvement of the Sewage Treatment Plant. He ~ave a brief summary on the cost o~ the improvement, l~ss the amount to be borrowed from the State, and the amount that we have in the Sewer Rental Reserve Fund. He stated that the November Election would be the latest posslble time that w~ could bring this to a vote of the people. COuncilman Rocca moved, seconded by Councilman Ahern and regu- larly carried, that the City hire tLe firm of Wilson, Harzfeld, J~nes and Morton to prepare the necessary papers for the pro- ceedings for the bond election. COuncilman Cortes1 asked City Manager Aiello if we had any a~r~m~nt with San Bruno with reference to the Sewage Treatment Plant. A lengthy discussion followed. AFter the discussion, Councilman Cortesi rescinded his vote and s~ated that he wished to abstain from voting. At this time M~yor Ryan called for a roll call vote on the motion made by COuncilman Rocca. Roll call vote was as follows: Ayes, Councilmen Leo J. Ryan, P~trick E. Ahem, Andrew Rocca, and G. J. Rozzi. Noes, none. Abstained, Councilman Emilio Cortes~. Councilman Rocca stated that if this action was not taken at this time that we could lose the $250,000.00 State loan. At this time City Attorney Noonan read excerpts from the Ordi- nance re~arding nuisances, after which he had Inspector Klemme o£ the Po ' ~ _ 1~, Department play back a tape recordin~ of noises wihich eminated from the Colonial Bakery as a result of their o~eration during the hours of !1:00 P.M. and 6:00 A.M., the riecordlng reportedly being a typical night. City Attorney Noonan then called on Mrs. Ralph Gomez of 539 I'~rtle Avenue, a resldent of the area. Mrs. Gomez stated that t!he recording was made from her bedroom and that the noise has ciontinued for five years now but was gettin~ worse all the time. She was asked if the people affected by this noise had ever ciontacted th,~ Colonial Bax~ry-~ and s~e stated that they had and t',he noise seemed to decrease to some extent but that the noises ~re much louder now. Mr. Noonan asked her what effect this had on their home, if any. She answered that it is very difficult f~or the whole family, as they are not gettin~ their proper rest, e~tc. She stated that the other nei[hbors felt the same. City Attorney Noonan then called on ~r..~ Norv:.~.. Goss of 535 ~!yrtle Aw~nue. Mrs. Goss stated that her beclroom wlndow is in a direct line with the loadin? door of Colonial Bakery. said the nolaes from there vibrate the house. She also stated ~hat all of the nei?hbors hear thes~ noises. Mrs. Goss also Stated that she has called Mr. Hem of Colonial Bakery several 8imes but he would not speak with her. Each time she called She was told that he was not in. Councilman Rozzi moved, seconded by Councilman Ahem and ~egu- t'arty carr-~ed, that this matter b~ continued and placed on the a~enda for the next Council meetin~, with instructions to the ~ity Manager and City Attorney to confer with Colonial Bakery representat~ ~ _v~s in order to effect voluntary abatement of the ~uisance, and failing that, to return to Councll for further ~rder. 'Victor Doido then spoke concerning the Sewer Treatment ]?!ant, askinD whether San Bruno had their own bonds or if they w~re included with ours. Mayor i-lyan stated that San Bruno had :~eir own bonds. We control the land. Mr. Boido asked how m~ch land would be used for the improvement to the plant and was told about one acre. Mr,. Boido also brought up the question of the noises from the COlonial Bakery. He stated that if they were to speak with Mr. Cullen, the owner of Colonial Bakery, he was sure that he w~uld try to do all he could to do away with the complaint. Mr. Boido asked what the San Francisco ScavenDer Company was ~s!n~= to do with the property they purchased by Crocker Es- sate. He wanted to know whether they were goin~ to use this land for a dump. Mayor Ryan stated that this was somethin~ we had no jurisdiction over. Councilman Rocca moved, seconded by Councilman Ahem, that the meeting be adjourned to Monday, August 27, 196~, at 8:00 P.M.
