Ahern at 8:05 p.m. Pledge of Allegiance to the Flag was recited, after which the invocation was given by Reverend A1Engelmann of ImmanUel Bap- tist Church. : Present: Councilmen Patrick E. Aheru, Frank Bertucelli, Emilio Cortesi, Andrew Rocca, and Guido J. Rozzi. Absent: None. Mayor Ahern at this time asked if there was a motion approvin~ the minutes of the regular meeting of September 21, 19~, and- the adjourned regular meeting of Seotember 22, 1964. ~ Councilman Rozzi moved, seconded by Councilman Bertucelli and regularly carried, that the minutes of the regular meetin2 of September 21, 1964, and the adjourned regular meeting Of ~ep- tember 22, 1964, be approved as submitted. Mayor Ahem then asked if there was a motion approving the reg- ular claims as submitted for paymeno. Councilman Bertucelli moved, seconded by Councilman RoGca and regularly carried' that the regular claims totaling $31,91~.29 be approved for payment. : Mayor Ahem then asked if there was a motion approving'claims for Parking District No. 1 as submitted for payment. Councilman Rocca moved, seconded by Councilman Rozzi a~d regu- larly carried, that the claims as sAbmitted for Parking Dis- trict No. 1, totaling $89.81, be approved for payment.. Butler Road Assessment District Claims: (a) The Lowrie Pavin~ Co., Inc. claim dated Septemberi29, 1964, iu the amount of-$30,293.10 for work performed to'August 31, 1964, on the Butler Road Improvement Project.I (b) Enterprise-Journal claim dated September 16, 196~ in the amount of $14.80 for legal advertising. Councilman Bertucelli moved, seconded by Councilman RoZzi and regularly carried, that the claims as submitted for the Butler Road Assessment District be approved for payment. I Cabot, Cabot & Forbes Industrial Park, Unit No. I Claim: Enterprise-Journal claim dated September 23, 1964~ in the amount of $13.40 for legal advertising. ' Councilman Rocca moved, seconded by Councilman Rozzi and regu- larly carried, that the claim as submitted for Cabot, Cabot Forbes Industrial Park, Unit No. I be approved for Payment. Cit~ of South San Francisco Municipal Improvement Bond~ of 1963 -- Construction Fund Claims: (a) Victor S. Swanson and Annie J. Swanson claim dated Septem- ber ~, 1964, in the amount of $100.00 for acquisition for sewer right of way. (b) Brady Constructors claim dated September 29, 1964' in the amount of $~8,634.76 for Progress Billing No. 18 for Waste Pumping and Treatment Works Enlarmement ($36,816.71 to be paid by South San Francisco and $~1,818.05 ~o be paid by San Bruno). Councilman Rozzi moved, seconded by Councilman Bertucelli and regularly carried, that the claims as submitted for the City of South San Francisco Municipal Improvement Bonds of 1963 -- Construction Fund be approved for payment. 662 PUBLIC HEARING -- CHANOES/~IODI~ ICATIONS BUTLER ROAD IMPROV.: RESOLUTION NO. 4059 CHANGE S/MOD IF I CAT10NS BUTLER ROAD IMPROV.: RESOLUTION -- PARKS & PARKWAYS MAINTENANCE DISTRICT WEST PARK UNIT NO. 1: RESOLUTION NO. 4060 ADDITIONAL INDEMNITY TO SURVIVORS - POLI CEMEN/F IREMEN: RESOLUTION NO. 4061 WATER POLLUTION CONTROL REPORT: RESOLUTION NO. 4062 AWARD OF CONTRACT DREDGING COLMA CREEK AND TRIBUTARIES: RESOLUTION NO. 4063 AWARD OF CONTRACT DREDGING COLMA CREEK AND TRIBUTARIES: Mayor Ahem opened the Public Hearing on Changes and MOdifica- tions to the Butler Road Improvement Project, as authorized by Resolution No. 40~6, asking if any ~ritten protests had been received, to which the City Clerk replied none had been re- ceived by his office. The Mayor thsn asked if anyone present wished to register au oral protest. There being none,I Mayor Ahem declared the Public Hearing closed. City Attorney Noonan explained the first resolution which had been prepared for Council action. He requested that the record show the amended report had been filed. It was so ordered. Councilman Rocca then introduced a resolution entitled~ "A RESOLUTION ORDERING CHANGES AND MODEFICATIONS -- BUTLER ROAD IMPROVEMENT PROJECT" : Roll call Vote was as follows: Ayes, Councilmen PatriCk E. Aheru, Frank Bertucelli, Emilio Cor~esi, Andrew Rocca, and Guido J. Rozzi. Noes, none. Absent, none. The next item for Council attention was a resolution entitled: "A RESOLUTION OF INTENTION TO FORM WEST PARK UNIT NO. i PARK~ AND PARKWAYS MAINTENANCE DISTRICT". Also, Inter-Office Memo- randums from the City Attorney and uhe City Manager concerning the formation of West Park Unit No. I Parks and Parkways Main- tenance District. There being no objections, Mayor Ahem continued this resolu- tion to the next meeting and asked ~hat the developer be re- quested to furnish an estimate cost of the improvement~ Also, that plans and specifications for the improvement be submitted to the Park and Recreation Director for study and report. City Attorney Noonan explained the next resolution, afSer which Councilman Bertucelli introduced: "CITY COUNCIL, CITYiOF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA -- A RESOLUTION PROVIDING FOR ADDITIONAL INDEMNITY TO SURVIVORS OF POLICEMEN AND iFIREMEN". Mr. Goss then summarized the bids received, recomuending award be made to the M & K Corporation. Use Permit Resolution No. 1703 from the Plauuin~ Commisisiou, recommending approval for the request of Oliver-O. Allen to erect a 14-unit apartment building in an unclassified districlt on Alida Way (Lot 2, Parcel C, Block A, Country Club Park - Asseissor's No. 13-145-17), subject to the following conditions: (1) Tlhat the common driveway easements that are to be shared b~ this~ and the ~wo adjoining properties be established in the property! deeds as irrevocable; (~) That ap~plicant comply with the recommendations of the Director of Public Works and the Commission's Arlchitec- ~ural Committee on the method of haltin~ the erosion of the bank ou this and his adjoining properties; (~) That the prop!osed driveways be located at least 3 feet from the fire hydrant adja- cent to this property or that the hydrant be moved at tihe appli- cant'~s expense to a position to be designated by the B~reau ~f Fire Prevention. Blume & Associate~, Engineers, for extra com- pensation for work done iu the Person and Swanson InduStrial rrac t. iBrief discussion followed, at which time City Attorney Noonan re- quested a continuance to the next regular meeting during which time a conference could be held in an attempt to reach ia conclu- sion. There being no objections, Mayor Ahem deferred the matter to the next regular meeting. ~ Claim against the City in the amount of $500.00 as filed by Elizabeth Jane Withers of 5046 Willbams Road, San Jose Calif- ornia , alleging injuries as a result of a fall at the Orange Avenue tennis courts. Councilman Rocca moved, seconded by Councilman Rozzi a~.d regu- larly carried, that the claim be denied and referred t( the in- surance carrier for the City. Letter dated September 23, 196~, from Wilsey, Ham & Bls.ir re- questing minor bayward relocation of existing bulkhead lines and reclamation of launching basin on behalf of the Americsn Bridge Division of the United States Steel Corporation. There being no objections, Mayor Ahem referred this matter to the Planning Commission for study and report. ' Letter dated September 23, 196~, from Wilsey, Ham & Blair sub- mitring revised Engineer's Report and reduction of assessment for Cabot, Cabot & Forbes Industrial Park, Unit No. 1. Councilman Rozzi moved, seconded by ~ouncilman Rocca and reyular- ly carried, that the recommendation of the Planning Commiss{on be approved and accepted. ' USE PERMIT Resolution No. 1783 received from the Planning Commis- sion recommending permission be granted for the request[to add an additional building at 509 Mawfair Avenue in a PCM District, subject to the following conditions: (1) The new building be used to provide a cover for existing open storage area Utilized by Associated Pipelines, Inc.; (2) The old building adJ~inium the proposed new building be painted to match the new o~e; (~) The balance of fence extending south from proposed new building will be replaced with a 6 foot rustic fence, the color $o match the new building. Inter-Office Memorandum dated September 30, 1964, received from z~e Plannin~ Commission recommendiu~ approval for the request of Welch an~ Smith to amend Use Per'it Resolution No. 16182 so a? ~o provide additional amusement iu the Pee Wee Golf Course shack, subject to the following conditions: (1) All games, equipment or o~her similar devices are to be for the means of entertainment only; (2) If any of the games are coin-operated, they are not to be of a type of multi-play, which me~ns more than one coin for each play, or constitute any type of games of chance; (3!) All of o'~e games, vending machines, or other similar devices ar~e to comply with the provisions of City Ordinance No. 261, Sections 8.14 and 8.15, and properly licensed; (4) The Police Department, noon presenting proper facts, have i~the authority to havei removed any games or similar devices that are constituting a pollice or community problem. ONE MOTORCYCLE: MONTHLY REPORTS: GOOD AND WELFARE: AD JOURNMEN T: Znter-0ffice Memorandum dated September 30, 1964, received from ~he Planning Commission recommending approval for the request of San Bruno Volkswagen to amend Resolu;ion No. 1665 to allow out- door light standards, subject to the following conditions: (1) That the five light standards placed in the planting area do not disturb the plantiu~ area; (2) That ;hey do not shine into the residential area; (~) That the applicant enter into a "hold harm- less" agreement with the City for the use of the City'siplanting strip along the Country Club Drive and E1Camiuo Real boundaries of the car lot. ~ Councilman Rozzi moved, seconded by Councilman Rocca and regular- ly carried, that the recommendation of the Planning Commission be apprOved and accepted. ~ Inter-Office Memorandum dated September 30, 1964, received from the Planning Commission submitting letter of resiguation from Peter A. Martinez of the Planning Commission. There being no objections, Mayor Ahem ordered the Memorandum and letter of resignation accepted and filed. He then explained the reason for the resignation of Commissioner Martinez was due to his son's accident, after which Councilman Rozzi suggested the resolution and Certificate of Merit be prepared for delivery to Mr. Martinez. Inter-Office Memorandum dated September 30, 1964, receiged from the Planning Commission concerning Planning Commission reorgan- ization with nomination of ~sw officers for the year as[follows: Warren Steinkamp as Chairman, Marie Raffaelli as Vice-Chairman, and Anita Robertson as Secretary. There being no objections, Mayor Ahem ordered the Memorandum accepted and placed on file. .Dompilation of bids received for two police vehicles received from Chief of Police Fabbri. ~ity Manager Aiello explained the bid received, commenting that it was the recommendation of the Police Chief that the ~ward be made to Arata Pontiac. He further commented that he concurred ih this recommendation .~ouncilman Bertucelli moved, seconded by Councilman Roccla and regularly carried, that the recommendation be approved ~nd ac- cepted. Compilation of bids received for one police motorcycle ~eceived from Chief of Police Fabbri. , City Manager Alello explained the bl~ received, commenting that _; was the recommendation of the Police Chief, in which ,he con- c~vred, that the award be made to Dudley Perkins. ~ Councilman Rocca moved, seconded by Councilman Rozzi audi regu- larly carried, that the recommendation be approved and alccepted. Monthly Report for August, 1964, was received from San ~ateo County Department of Public Health arid Welfare - Sanitat~ion Sec- ~aere being uo objections, Mayor Ahem ordered the report ac- cepted and placed on file. T~ere being nothing further, Mayor A~.ern asked if any me~ber of ~e City Council had anything they wished to offer under! Good and Welfare. There being none, he tken asked if anyone !in the audience had anything they wished to offer.
