Ahem at 8:04 p.m. Pledge of Allegiance to the Flag was recited. Due to the absence of Reverend Ecwin C. Urban of Brentwood Orthodox Presbyterian Church, no invocation was ~iven. Present= Ab sent: Councilmen Patrick E. Ahem, Frank Bertucelli, Emilio Cortesi, Andrew Rocca, and Guido J. Rozzi. None. ~ayor Ahem at this time asked if there was & motion approving the minutes of t~e adjourned regular meeting of December 23, 1964, and the regular meeting of January 4, 1965. Councilman Rozzi moved, seConded by Councilman Rocca and regularly carried, that the minutes of the adjourned regular meeting of December 23, 1964, and the regu- lar meeting of 3anuary 4, 1965, be approved as submitted. Mayor Ahem then asked if there was a motion approving the regular claims as submitted for payment. Councilman Rocca moved, seconded by Councilman Bertucelli and regularly carried, that the regular claims totaling $35,548.88 be approved for payment. ~ayor Ahem then asked if there was a motion approving the claims for Parking Eistrict No. 1 as submitted for payment. Councilman Bertucelli moved, seconded by Councilman Rocca and regularly carried, that the claims for Parking District No. 1, totaling $67.91, be approved for payment. Butler Road Assessment District Claims: (a) California Water Service Company claim dated December 9, 1964, in the amount of $88.20 for charges to install three fire hydrants on Butler Road between Edwards Wire Company and Eccles Avenue. California Water Service Company claim cated December 28, 1964, in the amount of $961.37 for installation of three fire hydrants between Wildherg Chemical Company and the South San Francisco Rod and Gun Club. Includes water main extension. Councilman Rozzi moved, seconded by Councilman Rocca and regularly carried, that t~e claims as submitted for the Butler Road Assessment District he approved for payment. Cabot, Cabot & Forbes Industrial Park, Unit No. 1 Claim: Baldwin Warren Company, Inc. claim dated January 4, 1965, in the amount of $40,377.78 for Progress Billing No. 3. Councilman Rocca moved, seconded by Councilma3 Rozzi and regularly carried, that the claim as submitted for Cabot, Cabot & For3es Industrial Park, Un:it No. 1 he a33roved for payment. C~¥ of. South San Francisco Municipal Improvement Bonds of 1963 - Construction Fund Claim: Jenks & Adamson claim dated December 28, 1964, in the amount of $1,500.00 for engineering services for steam boiler installation at Sewage Treatment Plant ($1,135.51 to be paid by South San Francisco and $364.49 to he paid hy San Bruno). Councilman Bertucelli moved, seconded by Councilman Rocca and regularly carried, th&t the claim as submitted for City of South San Francisco Municipal Improve- ment Bonds of 1963 - Construction Fund he approved for payment. Mayor Ahern opened the Public Hearing on the Notice of Appeal on Planning Com- mission Resolution No. 1807 entitled "A RESOLJTION OF THE PLANNING COMMISSION O? THE CITY OF SOUTH SAN FRANCISCO RECOMMENDING TO THE CITY COUNCIL DENIAL OF THE AMENDMENT PETITION OF ROSE GIANNINI SO AS TO REZONE TWO AND A HALF ACRES ON HOLLY AVENUE, BOOK 11, PARCEL 5, BLOCK 231, SJNSHINE GARDENS, FROM AN R-1 DIS- TRiCT TO AN R-3 DISTRICT". He asked if any written protests had been received, to which the Deputy City Clerk replied none had been received by the Clerk's office. However, a letter dated December 4, 1964, was received from the office of Demanes & Barrick, Attorneys at Law, requesting that the date for hearing of said Appeal be set not earlier than January 18, 1965. The Mayor then asked if anyone present in the audience wished to register an oral protest. No protest was registered. However, Mr. Floyd A. Demanes, attorney for the petitioner, requested the matter he referred back to the Planning Commission. M&yor Ahem closed the Public Hearing and referred the matter back to the Plan- ning Commission as requested. 705 PUBLIC HEARING - A~ENDING ZONING ORDINANCE NO. 353: (TO DELETE 4.44(f) RESOLUTION NO. 4122 BIDS - NEW LIBRARY BUILDING: RESOLUTION NO. 4123 STREET NAME CHANGES WESTBOROUGH UNITS 1-A AND l-C: RESOLUTION NO. 4124 DESTRUCTION OF TREASURE ISLAND ELECTION MATERIAL: Mayor Ahem then opened the Public Hearing o~ the amendment of Zoning Ordinance No. 353, as amended, Section 4.4 Planned Co~-nercta! and Light Industria! or District to delete Section 4.44(f). He asked if any written protests had been received, to which the Deputy City Clerk replied none had been received by the CLerk's office. --he Mayor then asked if anyone present in the audience wished to register an oral i)]~otest. ~. Curtis M. Caton, attorney with Heller, Ehrman, White & McAuliffe of San Fran- cisco spoke, stating he represented Mr. Tavares who has an interest in the land which would be affected by the change in the ordinance -- an area located in the P.C.M. District and partially in the City of San Bruno. Councilman Rocca asked if plans were availab.e at this time. Mr. Caton replied ahat he did not have the plans at the meeting but that the Planning Commission is aware of them, which are in accordance wi=h the Master Plan. Councilman Rocca then asked if the portion i~ our City is "commercial", and it w~s pointed out by Mr. Caton that his client wants to apply for conditional residentlial use. U~.ere was further discussion and mention was made that at a joint meeting of the Council and the Planning Commission development of the P.C.M. areas was discussed. At'~h~'time a preference was indicated to the development of more commercial areas rather than residential. ~yor Ahern then declared the PublicHearing ~closed. City Attorney Noonan explained the first resolution which had been prepared for Council's attention. (This resolution was accompanied by a letter from Paul D. ~.arkling, Architect) Mayor Ahem at this time commended the Libra=y Board members, presemt at the meeting. He also expressed the wish that Miss Rue Clifford could have seen com- pletion of the new library for her dedicatior to this project. Mrs. Lenore Varni, chairman of the Library Board, read the title of the resolu- tion authorizing the work: "CITY COUNCIL, C~TY OF SOUTH SAN FRANCISCO, STATE CF CALIFORNIA - A RESOLUTION APPROVING PLANS AND SPECIFICATIONS, AUTHORIZING THE WORK AND CALLING BIDS FOR THE NEW LIBRAR~ BUILDING". She thanked Council, the City Manager, the architect, the head librarian and her staff, and anyone · ho had helped with this project. At this time Mayor Ahem said the names of Miss Clifford and members of the Library Board would he inscribed on a plaque for presentation at the dedication. City Manager Aiello explained what was mentioned by the architect; that 50% of this facility was being financed hy the State because of the Emergency Operating Center which will he located in the building. He stated that actual approval has not come because Civil Defense officials are not available at this particular ti~e due to the flood disaster in northern C~lifornia, and this resOlution must be contingnet upon obtaining the approval of the United States Gove~.nment and the State. Co'~ncilman Rozzi then introduced the resolution entitled "CITY COUNCIL, CITY OF SDJTH SAN FRANCISCO, STATE OF CALIFORNIA - A RESOLUTION APPROVING PLANS AND S3~CIFICATIONS, AUTHORIZING THE WORK AND CALLING BIDS FOR THE NEW L~BRARY BUILD- I~G". Roll call vote was as follows: Ayes, Councilmen Patrick E. Ahern, Frank B~rtucelli, Emilio Cortesi, Andrew Rocca, anc Guido J. Rozzi. N~es, none. Absent, none. C[=y Attorney Noonan then explained the next resolution, after which Councilman B~rtucelli introduced: "CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO - STATE OF CALIFORNIA - A RESOLUTION ORDERING THE CHANGE OF NAMES OF STREETS IN WESTBOROUGH Ui~T NO. 1-A AND l-C". Roll call vote was as follows: Ayes, Councilaen Patrick E. Ahern, Frank Bertucelli, Emilio Cortesi, Andrew Rocca, and Guido J. Rozzi. Noes, none. Absent, none. Cizy Attorney Noonan explained the next resolution, after which Councilman Rozzi i~=roduced: "CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA - A RESOLUTION APPROVING AND AUTHORIZING DESTRUCTION OF ELECTION RETURNS AND SUP- PLIES FOR THE TREASURE ISLAND ANNEXATION ELECTION OF FEBRUARY 5, lg63". Absent, none. 7O$ RESOLUTION NO. 4125 AWARD OF CONTRACT DIGESTER CLEANING SEWAGE TREATMENT PLANT: RESOLUTION NO. 4126 AWARD OF CONTRACT SLUDGE LAGOONS SEWAGE TREATMENT PLANT: ORDINANCE -- AMENDING ORDINANCE 297 - SIZE AND SHAPE OF LOTS: 2nd Reading/Adoption ORDINANCE -- AMENDING ORDINANCE NO. 297 - ESTABLISHING STREET STANDARDS: let Reading/Introduction ORDINANCE -- AMENDING ZONING ORDINANCE NO. 353 SECTION 4.44, 1st Reading/Introduction FINAL ACCEPTANCE 1964 STREET IMPROVFL~NT PROJECTs CONTRACT COMPLETION DATE - BRADY CONSTRUC- TORS - SEWAGE TREATN~NT PLANT ENLARGEMENTS~ Director of Public Works Louis Goss read the bid received for the cleaning of digesters at the Sewage Treatment Plant and recommended the contract he awarded to the R & L Digester Cleaning Company of Sar Francisco. City Attorney Noonan then explained the resolution, after which Councilman Rocca introduced: "CITY COUNCIL, CITY OF SOUTH SA~ FRANCISCO, STATE OF CALIFORNIA - A ~ESOLUTION OF AWARD OF CONTRACT - CLEANING OF DIGESTF~RS - SH-WAGE TREATMENT PLANT". Roll call vote was as follows, Ayes, Councilmen Patrick E. Ahern, Frank Eertucelli, ~milio Cortesi, Andrew Rocca, an¢ Guido J. Rozzi. hoes, none. Absent, none. The Director of Public Works read the bids received for the earth dike lagoons at the Sewage Disposal Plant and recommended the contract be awarded to the lowest responsible bidder, Cima Construction Company, Inc. City Attorney Noonan then explained the resolution, after which Councilman Rozzi introduced: "CITY COUNCIL, CITY OF SOUTH SAM FRANCISCO, STATE OF CALIFORNIA - A RESOLUTION OF AWARD OF CONTRACT - EARTH DIKE LAGOONS FOR DISPOSAL OF SLUDGE - S~WAGE TREATMENT PLANT". ~oll call vote was as follows, Ayes, Councilmen Patrick E. The next item for Council's attention was the second reading and adoption of the ordinance entitled: "AN ORDINANCE AMENDING ORDINANCE 297, AS A~NDED, ENTITLED 'AN ORDINANCE ESTABLISHING SUBDIVISION REGULATIONS FOR THE CITY OF SOUTH SAN FRANCISCO' ADOPTED ON MAY 8, 1960". There being no objections, and at the reques~ of the City Attorney, Mayor Ahem Ceferred this item to the next regular meetimg. The next item for Council's attention was the first reading and introduction of ~n ordinance entitled= "AN ORDINANCE A~NDI~ ORDINANCE NO. 297, AS A~NDED, P~TITLED 'AN ORDINANCE ESTABLISHING SUBDIVISION REGULATIONS FOR THE CITY OF SCUTH SAN FRANCISCO' ADOPTED MA~ 8, 1960". There being no objections, and at the request of the City Attorney, Mayor Ahern ceferred this item to the next regular meetimg. City Attorney Noonan explained the ordinance which had been prepared and was zeady for its first reading and introduction, stating that if Council wished a motion could he adopted that reading of the ordinance in its entirety be waived ~nd that it have its first reading and introcuctton hy the reading of the title only. Councilman Rozzi so moved, seconded by Councilman Bertucelli and regu- larly carried. City Attorney Noonan then stated that a motion could be adopted that an ordinance entitled: "AN ORDINANCE OF THE CITY OF SOU~[ SAN FRANCISCO AMENDING ORDINANCE NO. 353 AS AMENDED ENTITLED 'ZONING ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO' PASSED AND ADOPTED AUGUST 10, 1954, AND IN P~RTICULAR AMENDING SECTION 4.44 Tk~EOF" be introduced, reading in its entirety having been duly waived. Councilman Bertucelli so moved, seconded hy Councilman Rocca. Roll call vote was as follows, Ayes, Councilmen Patrick E. Ahern, Frank ~ertucelli, Emilio Cortesi, Andrew Rocca, and Guido J. Rozzi. Noes, none. Absent, none. Irter-Office Memorandum dated December 16, 1964, received from the Director of P~blic Works recommending final acceptance of work on the 1964 Street Improve- ment Project and authorization to file Notice of Completion. Councilman Rozzi moved, seconded by Councilm~n Rocca and regularly carried, that the recommendation of the Director of Public Works he approved and accepted. Letter dated December 16, 1964, received fron Brady Constructors requesting ex- tension of contract completion date for Sewage Treatment Works Enlargements. Letter dated July 27, 1964, from Jenks & Adanson recommending completion date be set at July 17, 1964. Irter-Office Memorandum dated July 29, 1964, from the Director of P~blic Works ~lso recommending July 17, 1964, as completion date of contract. Councilman Rozzi proposed the following motions "That the sum of $190,220.97, the retained lO%of the contract price less 55,200.00, he paid to the contractor, 5rady Constructors, after the expiration of che lien period and that the sum of $5,200.00 he retained as recommended by the City Manager in his Inter-Office ~iemorandum dated January 18, 1965, and in accordance with the contract documents; w~ich sum shall satisfy the liquidated damages provisions of the contract docu- ments unless a review of the monthly statements and change orders warramt$ a modification". Councilman Rocca offered the following amendnent: "And, if recommended, such modification shall be approved hy the Cities of South San Franciscoand San BrunoV. Councilman Rozzi moved, seconded by Councilean Rocca and regularly carried, that the recon~endation of the Planning Commission be approved and accepted. VARIANCE Resolution No. 1828 received from the Planning Commission recommending oermission be granted for the request to encroach 10.5 feet into required 20 foot rear yard and for 43.5~ lot coverage instead of permitted 40~ iai 13 Clara Avenue. Councilman Rozzi moved, seconded by Councilman Rocca and regularly carried, that ;~e recommendation of the Planning Con~nissioq be approved and accepted. Compilation of bids received for vehicles for various departments. City Manager A:ello declared the bids, stating that he concurred with the recommendation of ~he Automotive Maintenance Supervisor that oontracts be awarded to :the lowest :esponsible bidders, as followss Sedan for the Fire Department - Fred Lautze Pickup for the Engineering Department - Fred Lautze Pickup for the Park Department - ;Lrata Pontiac Dump Truck for the Street Department - Arata Pontiac Pickup for the Sewer Department - Arata Pontiac. Councilman Rocca moved, seconded by Councilman Rozzi and regularly carried, that the recommendations of the City Manager and Automotive Maintenance Supervisor be a~proved and accepted. .~onthly Reports were received from the followings City Clerk - November, 1964 Parking District No. 1 - November, 1964 Building Inspection Department - December, 1964 Fire Department - December, 1964. There being no objections, Mayor Ahern ordered the reports accepted and placed ~n file. ~ayor Ahern at this time proclaimed the week of February 14, 1965, as "NATIONAL 3=-AUTY SALON WEEK". T~ere being nothing further, Mayor Ahern asked if any member of the Council wished to offer something under Good and Welfare. There being none, he then asked if anyone in the audience had something to offer under Good and Welfare. drs. Varni of the Library Board introduced t~e other members of the Board who were present in the audience. They were: ~rs. Ruth Boyd, Mrs. Ednia deLarios, ;Ar. Victor Robinson, Mr. Jack Ferro, and head librarian, Miss Lauretta Hussar.
