Bertucelli at 8:00 p.m. Pledge of Allegiance to the Flag was recited, after which the invocation was given by Reverend Norman Hugh Barbour, St. Elizabeth's Episcopal Church Present: Absent: Councilmen Frank J. Bertucelli, Patrick H. Ahem, Emilio Cortesi, Andrew Rocca and Guido J. Rozzi. None Mayor Bertucelli at this time asked if there was a motion aporoving the minutes of the special meeting of June 28, 1965 and regular meeting of July 6, 1965. Councilman Rozzi moved, seconded by Councilman Ahem and regularly carried, that the m~nutes of the special meeting of June 28, 1965 and regular meetin~ of July 6, 1965 be approved as submitted. Mayor Bertucelli then asked if there was a motion approvin9 the regular claims as submitted for payment. Councilman Ahem moved, seconded by Councilman Rocca and regularly carried, that the regular claims totaling $57,694.64 be aporoved for payment. Mayor Bertucelli then asked if there was a motion approving the claims for Parking District No. 1 as submitted for oayment. Councilman Rocca moved, seconded by Councilman Ahem and regularly carried, that the claims for Parkin9 District No. 1, totaling $1,579.25, be approved for payment. City of South San Francisco Municipal Imorovement Bonds of 1963 - Construction Fund Claims: Schlegel Mechanical Contractors claim dated March 25, 1965 in the amount of $3,532.70 for retention of South San Francisco Sewage Treatment Plant ($3,179.43 to be paid by South San Francisco and $353.27 to be paid by San Bruno). Councilman Ahem moved, seconded by Councilman Rozzi and regularly carried, that the claim as submitted for the South San Francisco Municipal Improvement Bonds of 1963 - Construction Fund be approved for payment. Cabot, Cabot & Forbes Industrial Park, Unit No. 1 Claims: (a) Baldwin Warren Company, Inc. claim Jated June 29, 1965, in the amount'~ of $60,703.71 for Progress Billing ~o. Nine (9). (b) California Water Service Company claim dated June 17, 1965, in the amount of $706.P0 for installing two fire hydrants. Councilman Rozzi moved, seconded by Coun:ilman Rocca and regularly carried, that the claims as submitted for Cabot, Cabot & Forbes Industrial Park, Unit No. 1, be approved for payment. Lowrie-Bothin-Swanson Project Claims: (a) Wilsey, Ham & Blair claim dated May 28, 1965 in the amount of $260.00 for basic engineering services for Lowrie Avenue Improvement District. Councilman Ahem moved, seconded by Councilman Rocca and regularly carried, that the claims as~bmitted for the South San Francisco Public Library be ap?roved for payment. The next item for Council attention was the Public Hearine on Notice of Hearing with respect to collecting Sewer Rentals on Municipal Real Property Tax Rolls. Mayor Bertucelli declared the Public Hearing opened, asking if any written protests had been received, to which the City Clerk replied none had been received by his office. He then asked if anyone present in the audience wished to register an oral protest. There being none, Mayor Bertucelli declared the Public Hearing closed. The next item for Council attention was the Public Hearing on Notice of Hearing of amended assessment - Harbor Way Assessment District. Mayor Bertucelli declared the Public Hearing opened, asking if any written protests had been received, to which the City Clerk replied none had been received by his office. He then asked if anyone oresent ~n the audience wished to register an oral protest, There being none, Mayor Bertucelli declared the Public Hearin~ closed. The next item for Council attention was the Public Hearing on Notice of Hearing appealing denial of Planninm Commission for a pole sign at 103 ~ondercolor Lane. Mayor Bertucell~ declared the Public Hearing opened, asking if any written protests had been received, to which the City Clerk replied none had been received by his office. He then asked if anyone present in the audience wished to register an oral protest. There being none, Mayor Bertucel]i continued the Public Hearing and referred the matter back to the Planning Commission to consider revised plans and report back to Council. City Attorney Noonan explained the first resolution which had been prepared for the a±tent~on of Council, after which Coancilm~n Rozz~ introduced: "A R~SOLUTION AUTHORIZING EXECUTION OF A CONTRACT WITH CABOT~ CABOT g FORBES CALIFORNIA PRO- PERTIES, I~. FOR THE ACQUISITION OF THE PUBLIC IMPROVEMENTS TO BE MADE ON CABOT, CABOT & FORBES INDUSTRIAL PARK UNIT NO. P." Councilman Ahem asked City Attorney Noonan if this was the same matter whlch he had voted "No" on at an earlier meeting, +o which the City Attorney replied +bat it was. The next resolution for Council's attention was a resolution entitled: "A RESOLUTION ACKNOWLEDGING ASSIGNMENT OF MONIES AND CO.MSEN/ING THERETO CABOT, CABOT g FORBES INDUSTRIAL PARK UNIT NO. 2.." Inter-Office Memorandum, dated July 7, 1965, from the Director of Public Works submitting compilations of bids received for the 1965 Interceptor Sewer Project and recommending award to The Lowrie Paving Company, Inc. City Manager Aiello declared the bids received after which he remarked that it was the recommendation of the Director of Public Works that the award be made to The Lowrie Paving Company, Inc., as t~e low bidder. City Attorney Noonan then explained the resolution, after which Councilman Rocca introduced: "A RESOLUTION OF AWARD OF CONTRACT CIRC!.S COURT AND CHESTNqJT AVENUE INTERCEPTOR o:~,~RS." City Attorney Noonan then explained +.he resolution which had been prepared, after which Councilman Rozzi introduced: "A RESOLUTION GRANTING A GRADING PERMIT TO CABOT, CABOT & FORBES CALIFORNIA PROPERTIES, Roil call vo+e was as follows: Ayes, Councilmen Frank J. Grading Permit A~nlication as filed by Healy Tibbitts Construction Co., to fill Tide Lot 27 and a portion of Tide Lot 26, accompanying this is an Inter-Office Memorandum, da~ed July 8, 1965, from the Director of Public Works submitting his recommendation. City Attorney Noonan then explained the resolution which had been prepared, entitled: "A RESOLUTION GRANTI~ A GRADING PERMIT TO HEALY TIBBITTS CON- S/RUCTION COMPANY-PROFIT SHARING PLAN, AND CROCKER CITIZENS NATIONAL BANK, TRUSTEE." There being no objections, Mayor Bertucelli ordered the matter continued to the new reqular meeting for review of Soils Report. City Attorney Noonan explained the next resolution, after which Councilman Rozzi introduced: "A RESOLUTION ADOPTING REPORT OF ANNUAL SEWER RENTALS AND CHARGES FOR 1965/66 PURSUANT TO ORDINANCE NO. 396." Roll call vote was as follows: Ayes, Councilmen Frank J. Bertucelli, Patrick 5. Ahem, Emilio Cortesi, Andrew Rocca, and 3uido 3. RozZi. Noes, none. Absent, none. City Attorney Noonan explained the next resolution, after which Councilman Rocca introduced: "A RESOLUTION AUTHORIZING EXECUTION OF AGREEMENI REGARDING EXCHANG~ OF LANDS - STONEGATE RIDGE." Roll call vote was as follows: Ayes, Councilmen Frank J. Bertucelli, Patrick E. Ahem, Emilio Cortesi, Andrew Rocca, and 'Juido 3. Rozzi. Noes, none. Absent, none. City Attorney Noonan explained the ordina:]ce which was ready for second reading and adoption, stating that a motion could be adopted by Council if they so desired that reading of the ordinance in its entirety be waived and that it be passed and adopted by reading of the title only. Councilman Ahem so moved, seconded by Councilman Rocca and regularl'! carried. City Attorney Noonan then remarked that a motion could be adopted by Council that the ordinance entitled: "AN ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO AMENDING ORDINANCE NO. 353, AS AMENDED, ENTITLED 'ZONING ORDINANCE OF TH5 CITY OF SOUTH SAN FRANCISCO' PASSED AND ADOPTED AUGUST 10, 1954, AND ESTABLISHING ZONING DISTRICT CLASSIFICATION FOR THE PR~ERTY HEREIN DESCRIBED~" (Mantegani) be read for the second time by ti+lc and be passed and adopted, the reading in its entirety having been duly waived. Noes, none. Absent, none. The next ~t~m for Council's consideration concerned ~he Ordinance with regard to the adoption oF the Uniform Plumbing Code as requested by +.he Chief Building Inspector. ORDINANCE - PLUMBING CODE (UNIFORM) 1st Reading/Introduction (CONTINUED) BERKY BEAR PHOTO USE PERMIT P.C. RESO. NO. 1927: FLOOD CONTROL PROJECT COLMA CREEK: ozS- G. R. D. NO. 1932: HUNTINGTON DRIVE P.O. RE$O. NO. 1933: City Attorney Noonan suggested a motion to the City Council to comply with Section 50022.3 Government Code. Councilman Rozzi moved that the title of the Ordinance be read and the ±itle of the Code to be adopted thereby be read, and that said reading shall constitute the first reading and introduction of said Ordinance and that a Public Hearing be set for the 16th day of August, 1965. The motion was seconded by Councilman Rocca and regul, ar]y carried. Thereupon, the City Attorney, in accordance with the motion and instructions, read the Ordinance entitled: "AN ORDINAN3E OF THE CITY OF SOUTH SAN FRANCISCO ESTABLISHING RULES, REGULATIONS AND STANDARDS FOR INSTALLATION OF PLUMBING FIXTURES AND APPLIANCES IN SAID CITY; PROVIDING FOR ISSUANCE OF PERMITS AND COLLECTION OF FEES; PROVIDING PENALTIES FOR VIOLATIONS THEREOF; REPEALING ORDINANCES NUMBERED 188 AND 508; AND ADOPTING BY REFERENCE THE WESTERN PLUMBING OFFICIALS' PLUMBING CODE - 1964 EDITION," and the title of the Code adopted thereby - THE WESTERN PLUMBING OFFICIALS' PLUMBING CODE - 1964 EDITION. The next item for Counci].'s attention was the continued Use Permit Resolution No. 1927 of the Planning Commission recor~nending denial to erecting a pole sign at 103 Wondercolor Lane. There beino no objections, Mayor Bertuce]li referred the matter back to the Planning Commission for study of revised plans and report back to Council. Communication, dated July 1, 1965, received from the County of San MateD En- gineering and Road Department together w~th a copy of letter, dated May 20, 1965 from U.S. Army Enoineer District, San Francisco Corps of Engineers, concerning the matter of the Flood Control Project on Colma Creek. Councilman Rozzi moved, seconded by Councilman Ahem and regularly carried, that the matter be referred to the City Manager with instructions to meet w~th the developers, City staff and County to resolve the problem and control of soll erosion. VARIA~CE Resolution No. 1998 received from the Planning Commission recommendin permission be granted to permit a 2 ft. eave encroachment into required front setback at 644 Commercial Avenue. Councilman Rocca moved, seconded by Councilman Rozzi and reoularly carried, ~.ha. the recommendation o~ the Plannin9 Commission be approved and accepted. USS PERMIT Resolution No. ]929 received from the Plannino Commission recommend!n9 permission be denied to establish a pizza hut to be located within 100 ft. of a residential district at 609 West Orange Avenue. Accompanying this is commu- nication, dated July 1, 1965, received from Theodore Long appealing the decision of the Planning Commission and communication, dated June 3, 1965, from the Southwood Women's Club registering a protest aoainst a permit for a pizza parlor with liquor license. No objections having been reoistered, Mayor Bertucelli set the Public Hearing for the next regular meeting of Aug%~c2, 1965. USE PERMIT Resolution No. 1931 received from the Planning Commission recommending permission be granted to permit construction of an office building in a U and C-1 district, within 200 ft. of an R distric± on a portion of Lot 4, Block A, Country Club Park, Assessors No. 13-145-18 and 2C subject to conditions: (1) That a fire hydrant, (Greenberg #76) be installed 30C feet from ~he existing f~re hydrant on E1Camino Real. Councilman Rocca moved, seconded by Councilman Ahem and reoularly carried, that the recommendation of the Planning Commission be approved and accepted. Councilman Rozzi abstained from voting. USE PERMIT Resolution No. 1932 received from the Planning Commission recommending permission be granted to erect a 72 sq. ft. sign at 352 Shaw Road in an M-2-H district in addition to 156 sq. ft. of e~isting sign area subject to the following condition: (1) That the sign be non-scirtillatin9, non-revolving, non-flashing. Councilman Rozzi moved, seconded by Councilman Rocca and regularly carried, that the recommendation of the Planning Commission be approved and accepted. Resolution No. 1933 received from the Planning Commission entitled: "RESOLUTION OF THE PLANNING CON~ISSION OF THE CITY OF SOUTH SAN FRANCISCO RECONW~ENDING TO THE CITY COUNCIL ACCEPTANCE OF DEDICATIOY OF HUNTINGTON AVBkrOE ACCORDING TO THE MAP AND DETAILED PLANS AS LISTED BELOW A~,D REQUESTED BY TAVARAS CONSTRUCTION COMPANY (TANFORAN)" recommendin9 approval to the acceptance of dedication of Huntington Drive, subject to the followirg conditions: (1) That the firm of Wilsey, Ham & Blair shall submit the three drawings listed in Resolution No. 1933 to the City Council for consideration and to become part of the official documents of accepting this dedication and (2) A grant of easement for Huntington Avenue be prepared by Tavaras Construction Co. and be approved by the City Council (3) An agreement for the construction anc installation of the street improvements in accordance with plans and specifica+ions, the performance of which will be secured by a corporate surety bond; and an agreement to provide for dedication and construction of a street between Hun~inoton Avenue and E1 Camino Real along the southerly boundary limits of the City of South San Francisco in accordance ~i.~h plans considered by the Planning Commission and nresented to the City Council. NO. 1935: MONTHLY REPORTS: GOOD AND BRAVERY COMMENDATION PAN AMERICAN WORLD AIRWAYS Councilman Rocca moved, seconded by Councilman Ahern and regularly carried, that the recommendation of the Planning Commission be approved and accep,+ed and in addition the further condition that a suitable arrangemen± be made between +he developer and the City for the installation of traffic signals at the inter- section of Spruce Avenue and Hunting±on [five and that the improvement plans and dedication nlans be satisfactory to the office of the Director of Public Works. Resolution No. 1934 received from the Planning Commission entitled: "RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SOUTH SAN FRANCISCO RECOMMENDING TO THE CITY COUNCIL APPROVAL OF CHANGING THE NAME OF LIMERICK BOULEVARD TO GELLERT BOULEVARD IN WES/BOROUGH" recommending approval to the street name change. Accompanying is communication, dated June 3, 1965, from Suburban Realty Company requesting street name change and communication, dated June 7, 1965, from the City of Daly City recommending street name change as it affects the Serramonte Development in their city. Councilman Ahem moved, seconded by Councilman Rozzi and regularly carried, that the recommendation of the Planning Commission be approved and accepted. USE PERMIT Resolution No. 1935 received from the Planning Commission recommending permission be granted to permit construction of a commercial planned unit development in a P.C. District for a shopping center and service station in West Park No. 1. There being no objections, Mayor Bertucelli continued the matter to the next regular meeting as an Unfinished Item, it requiring additional information and reports from the Planning Commission. Monthly Reports were received from the followlno: Building Inspection Department - June, 1965 Library - June, 1965 San Mateo County Department of Public Health and Welfare - Sanitation Section - April, May and June, 1965 There beina no objections, Mayor Bertucelli ordered the reports accepted and placed on file. There beine nothino further, Mayor Bertucelli asked if any member of the Council had anything they wished ,+o o~fer under Good a~d Welfare. There be~n? none, Mayor Ber+ucelli brought to the attention of fhe City Council three ]_et,+ers which he had received. The first wes a communication, dated July 2, 1965, from the Office of Governor Edmund G. Brown~ concerning his !965 ~rogram o~ "The Young American Medals for Bravery in Service" which were awarded annually by the United States A±+orney G~nera] through an Act o~ Congress in 1950 to a boy or girl prior ,+.o their lqth birihday for any act of bravery or service performed during the previous year. He requested the City's support in this program by submitting the names of any youngster who oerformed such an act, qivln9 a full statement and documentation of the act, includin9 the time and place and supportin9 statements. Mayor Bertucelli requested the Police Chief to make a research as to whether or not the City had any nominees, also requestino press releases by the various Fenin- sula newspapers. The next two communications concerned the matter of the recent Pan American air craft which became disabled over the City, losing part of its fusilage and scattering parts over a wide area. The first was from the Federal Aviation Agency and the second from Pan American %Vorld Airways, both of which commended the Police Chief and his staff for their assistance in gathering the evidence coordinating with the neighboring communLties and collecting all of the evidence at one location which was the local Poli.:e Department. They ].ikewise commended the Fire Chief and his staff for their assistance in the recent incident. There bein9 nothing further, Mayor Bertu:elli then asked if anyone present in the audience had anything they wished to offer under Good and ~elfare.
