Rozzi None Mayor Bertucelli at this time asked if there was a motion approving the minutes of the regular meeting of February ?, 1966 and the regular meeting of February 21, 1966. CoJncilman Ahern moved, seconded by Councilmar Rocca and regularly carried, that the minutes of the regular meeting of February ?, 1966 and the regular meeting of Fe3ruary 21, 1966 be approved as submitted. Mayor Bertucelli then asked if there was a motion approving the regular claims as su3mitted for payment. CoJncilman Rozzi moved, seconded by Councilman Ahern and regularly carried, that the regular claims totaling $33,591.98, be approved for payment. Mayor Bertucelli then asked if there was a motion approving the claims for Parking District No. 1 as submitted for payment. CoJncilman Rocca moved, seconded by Councilmar Rozzi and regularly carried, that the claims as submitted for Parking District ~'o. 1, totaling $12.47, be approved for payment. Ga3ot. South San Francisco Public Library Claims Enterprise-Journal claim dated February iL, 1966 in the amount of $75.00 for Notice to Contractors. Councilman Rozzi moved, seconded by Councilman Rocca and regularly carried, that the claim as submitted for the South San Francisco Library and Emergency Operating Center be approved for payment. Butler Road Assessment District Claims Claim of February 15, 1966 in the amount of $200.00 for 2 Fire Alarm Boxes installed 0 $100 - Credit to Trust Deposits - Central Station Fire Alarm Equipment Deposits. Councilman Rocca moved, seconded by Councilman Ahern and regularly carried, that the claim as submitted for Butler Road Assessment District be approved for payment. The next item was the Public Hearing on Westborough Units l-A, l-B, 1-C and 2 - prooosed zoning change establishing these units as single family residential districts. This matter having already been acted on by Council at a previous meeting, no further action was necessary or taken. The Mayor announced that this was the time and ~lace fixed for the hearing on the Connur Street and Dianne Court Project, and declared the hearing open, asking the City Clerk if any written protests had been received; to which the City Clerk replied tha~ he had received one written protest filed ~y Ford F. Frazier and Dorothy A. Frazier regarding Diagram and Assessment No. 112. The City Clerk then read the pro, est in full. The Mayor then asked if there was anyone presen; who wished to register an oral pro;est. Mr. Frazier addressed the City Council reviewing his seven reasons as con;ained in his letter of protest commenting t~at some assessments were in the amount of $1,061.90, whereas the per-lot equivalent on his property was $4,840.00. He further stated that if it was figured that his property could be divided into five lots, his assessment was $5,843.00 per lot, whereas, the highest assessment on the other side was $3,992.00 per lot. His assessment worked out to $78.00 per foot and represented 1/3rd of the total assessment. Mr. Frazier stated that in his opinion his property would he worth $6,000 per lot as At stands without the proposed improvements. Mr. Kenneth Jones of the law firm of Wilson, Jones, Morton & Lynch, special counsel for the City in the project, then addressed the Council. He presented and read a written statement addressed to the City Council and signed by Marvin W. Wolff, Engineer of Work, outlining the methods used in spreading the assessment, and stated that in Mr. Wolff's opinion, the assessment had been distributed in pro- portion to benefits. He also presented and read a written appraisal, dated March 4, 1966, signed by Con T. Shea, real estate appraiser in San Francisco, stating that in Mr. Shea's opinion the fair or reasonable market value as ef March 4, 1966 of 16,250 square feet would be $1.70 per square foot, or $27,600.00, this figure being Mr. Shea's opinion as to the value of Conmur Street to be acquired in the project. Also presented were three letters, signed by Peter G. Gray, Realtor; James M. Petty, Realtor; and Leo A. Cortesi, Realtor, stating v~rious opinions as to value of lots in t~e project with improvements in. Mr. Jones then stated that the bids for the project had come in somewhat over the Engineer's estimate, and that an agreement had been signed and would be presented whereby Diane Lawrence, Inc. agreed to sell the Conmur Street right-of-way for an amouqt not to exceed $27,000 with $25,785.52 payable upon receipt of bond proceeds, and any additional amount available from contin~encies after the work was entirely complete at the end of the project. The effect of this agreement is to absorb the higher construction cost in a lower acquisition cost. Mr. Jones then asked Mr. Wolff to make a statement regarding the cost of Dianne Cour=. Mr. Wolff stated that the entire cost of improving Dianne Court had been spread against the west side areas, and that no part had been assessed against Mr. Frazier's property. Mr. Jones then pointed out that the appraisals and letters above meferred to estaolished the value of lots after the improvements are in at a minimum of $13,000 each, and that according to Mr. Frazier's own statement, the present value of his property is in the range of $6,000 per lot. The effect of the project is therefore to create a benefit of approximately $7,000 per lot, which would mean a minimum of $28,000 of benefit for a minimum of four lots. There is actually enough area in Mr. Frazier's property to create six lots. He then explained the first resolution which had been prepared for Council's attention after which Councilman Rocca introduced= "A RESOLUTION OVERRULING PROTESTS ON RESOLUTICN OF INTENTION NO. 4332 CONMUR STREET AND DIANNE COURT." The next item for CoUncil's attention was the resolution entitled~ "A RESOLUTION OF INTENTION TO MAKE CHANGES AND MODIFICATIONS CO~UR STREET AND DIANNR COURT." Mr. Ken Jones commented that the resolution was not needed, having been prepared in case it were necessary to make changes or modifications. The next resolution for Council's consideration was entitled= "A RESOLUTION ORDERING REDUCTION OF ASSESSMENTS CONMUR STREET AND DIANNE COURT." Mr. Ken Jones commented that the resolution was not needed, having been prepared in the event it was necessary to order a reduction of assessments. The next item was the Inter-Office Memorandum dated February 17, 1966 from the Director of Public Works Louis Goss regarding proposed Amendment No. 1 to the Agreement for Maintenance of State Highways ir the City of South San Francisco. Director of Public Works Louis Goss briefly e~plained the matter. After an explanation by City Attorney Noonan, Councilman Rozzi introduced: "A RESOLUTION APPROVING AMENDMENT NO. 1 TO AGREEMENT FOR MAINTENANCE CF STATE HIGHWAY IN THE CITY OF SOJTH SAN FRANCISCO." At the request of Councilman Ahern, the Director of Public Works explained the research which had been done as a result of a League of California Cities' letter concerning the State of California suing various water pipe manufacturers on anti- tr~st suits and which requested cities to joir in this suit for which they would pay a proportionate share. Discussion followed concerning damages which would be recovered. City Attorney Noonan then explained the resolution after which Councilman Rozzi introduced= "A RESOLUTION AUTHORIZING THE ATTORNEY GENERAL OF CALIFORNIA TO CONDUCT LEGAL PROCEEDINGS." The next item for Council's attention was the communication dated February 24, 1966 from the Southwood Women's Club requesting permission to erect a Mission Bell at the entrance of Southwood. Councilman Ahern moved, seconded by Councilman Rocca and regularly carried, that the request he approved and that the mattez be referred to the City Manager to work out the necessary details. VARIANCE Resolution No. 2028 received from the Planning Commission recommending permission be granted to erect an ll'x21' patio-type structure to encroach 9' into the existing 14' rear yard at 91 Calvert Avenue. Councilman Rocca moved, seconded by CounciLman Rozzt and regularly carried, that the recommendation of the Planning Co,=nissfion he approved and accepted. VARIANCE Resolution No. 2029 received from the Planning Commission recommending permission be granted to construct a 15'x30'4" garage addition to encroach 2' into the required 19' garage setback from inside edge of sidewalk so as to main- tain existing building line and also to encroach 15' into required 20' rear yard at 1320 Crestwood. Councilman Rocca moved, seconded by CounciLman Rozzi and regularly carried, that the recommendation of the Planning Commiss:on he approved and accepted. USE PERMIT Resolution No. 2030 received from the Planning Commission recommending permission he denied to establish a car sa_es lot at 12 Linden Avenue. He requested that Council consider referral back to the Planning Commission for a further study and report after which Council can then pass on /he matter. Mayor Bertucelli asked if the date of April 4, 1966 would be a convenient Public Hearing date to which Mr. Gaudio replied that it was. Councilman Rocca moved, seconded by Councilman Rozzi and regularly carried, that in accordance with the applicants' request, the matter set for Public Hearing on April 4, 1966. SIGq USE PRPJ~IT Resolution No. 2031 received from the Planning Commission recommending permission be granted to erect a free-standing sign to be located on City property; sig~ to have 160 sq. ft. advertising space and an overall height of 55', subject to the following conditions~ (1) That the sign he removed hy the applicant or at his cost, at such time as the City requires the right-of-way on which it is located for street improvement purposes. (2) That the applicant enter into a hold-harmless agreement with the City. Councilman Rocca moved, seconded by Councilman Rozzi and regularly carried, that the recommendation of the Planning Commission be approved and accepted. The next item for Council's attention was the I~ter-Office Memorandum from the Director of Public Works requesting authorization to widen the existing Conmur Street from NorthwoOd Drive to Alta Vista Subdivision No. 3. This matter having been acted upon by Council earlier under resolutions, no further action was taken at this time. The next item was the Inter-Office Memorandum dated February 17, 1966 from the Director of Public Works recommending approval ~o Change Order No. 14 - Cabot, Cabot & Forbes Industrial Park, Unit No. 1. Accompanying was communication from Wilse¥, Ham & Blair dated February 15, 1966 suhnitting copies of Contract Change Order No. 14. Councilman Rozzi moved, seconded by Councilman Rocca and regularly carried, that the recommendation of the Director of Public Works be approved and accepted. Inter-Office Memorandum dated February 16, 1966 from the Director of Public Works advising completion of work on the 1965 Traffic Signal Installation and Related Street Work and recommending acceptance of work and authorization to file Notice of Completion - Steiny and Mitchel, Inc., was next considered. Councilman Ahern moved, seconded by Councilman Rocca and regularly carried, that the recommendation of the Director of Public Works be approved and accepted. The ~ext item was the Inter-Office Memorandum d&ted February 16, 1966 from the Director of Public Works advising completion of all work on the 1965 Street Improve- ment Project and recommending acceptance of work and authorization to file Notice of Completion - Lowrie Paving Company. Councilman Rocca moved, seconded by Councilman Ahern and regularly carried, that the reco,w, endation of the Director of Public Works be approved and accepted. Monthly Reports were received from the followinc~ Police Department - January, 1966 San Mateo County Dept. of Public Health Sanitation Section - January, 1966 There being no objections, Mayor Bertucelli ordered the reports accepted and placed on file. Department of Alcoholic Beveraqe Control: Application as filed by George and Clarine Loratne Ridenbaugh for Off Sale Beer & Wine at 130 So. Spruce Avenue. There being no objections, Mayor Bertucelli ordered the report filed. Mayor Bertucelli at this time brought to Council's attention the matter of contacting the State Employeeg Retirement Board in order that further information might he obtained in regard to increased payments to retired City employees. After brief discussion, Councilman Rocca moved, seconded by Councilman Ahern and regularly carried that a letter he addressed to ~he State Retirement Board requesting an estimate of cost of amending State Employees' Retirement System contract to in- clude benefits set forth in Section 21251.6 of ti~e Government Code and requesting the recessary documents to affect the amendment. There being nothing further, Mayor Bertucelli asked if any member of the City Council had anything they wished to offer. ADJOURN~ENT~ RESPECTFULLY SUBMITTED, Councilman Rocca brought to Council's attention the rapid growth to the west side of the City, stating that some thought should 3e given to the establishment of fi:e facilities and therefore moved that the City Manager be instructed to consult wi;h the Fire Chief and determine the status of fire protection in the Westborough area, and what date a station in the area should be constructed and manned, and whether or not any other arrangements should be entered in to during the interim period, also to consult with architects quaiified in fire station requirements. Councilman Ahem seconded the motion which was regularly carried. There being nothing further from any member of the City Council, Mayor Bertucelli asked if any member of the audience had anything they wished to offer. Mr. Warrender requested information on the status of his garage with relation to the widening of Conmur Street, to which the Director of Public Works replied that the City, on the widening, would restric;~parking to one side only in lieu of lowering his garage. This was satisfactor? to Mr. Warrender. Mr. Roland then asked if Northwood Drive was :o be widened as a result of Conmur Szreet Extension, to which the Director of Public Works replied that there was no widening at Northwood Drive anticipated. There being nothing further, Councilman Rocca moved, seconded by Councilman Rozzi and regularly carried, that the meeting be adjourned to the next regular meeting.
