Bertucelli, Emilio Cortesi, Andrew Rocca and Guido J. Rozzi. Councilman Patrick E. Ahern T~e first item for Council's attention was the Public Hearing on the Report and Recommendation of the Planning Commission set forth in Planning Commission Reso- l'~tion No. 2075 passed July ll, 1966, and orcering endorsements affixed to said report and recommendation. Mayor Bertucelli declared the Public Hearing opened asking if any written protests had been received to which the City Clerk replied none had been received by his office. He then asked if anyone present in the audience wished to offer an oral protest. There being none, Mayor Bertucelli declared the Public Hearing closed. T%e next item was the Public Hearing on Planring Commission Resolution No. 2080 e3titled= '% RESOLUTION OF THE PLANNING COM~.ISSION OF THE CITY OF SOUTH SAN FRAN- CISCO RECOMMENDING TO THE CITY COUNCIL APPROVAL OF THE AMENDMENT PETITION OF CAESAR-CALLAN HOMES, INC., SO AS TO REZONE A5 APPROXIMATELY 180-ACRE PARCEL OF LAND FROM A "U" DISTRICT TO A "PC" DISTRICT.' Mayor Bertucelli declared the Public Hearing opened and at the request of the City Attorney, the Public Hearing was continued to the next regular City Council meeting. City Attorney Noonan explained the first resolution after which Councilman Rocca i~troduced: '~ RESOLUTION APPROVING THE REPORT AND RECOMMENDATION OF THE PLANNING CDM~IISSION SET FORTH IN PLANNING COMMISSION RESOLUTION NO. 2075, PASSED JULY 11, 1966, AqDORDERING ENDORSEMENTS AFFIXED TO SAID REPORT AND RECOMMENDATION." Roll call vote was as followss Ayes, Councilmen Frank J. Bertucelli, Andrew Rocca nad Guido J. Rozzi. Noes, none. Abstaining, Councilman Emilio Cortesi. Absent, Councilman Patrick E. Ahem. Mayor Bertucelli ordered the title of the orcinance read. The title of the ordinance was read. City Attorney Noonan then explained the ordinance and advised the Council regarding procedure for introduction. Councilman Rocca moved that reading of the ordinance in its entirety be waived and that the ordinance be introduced and read for the first time by reading title only, seconded by Councilman Rozzi and passed by a unanimous vote. Councilman Rocca moved that the ordinance enzitled, "AN ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO AMENDING ORDINANCE ~0. 353, AS AMENDED, ENTITLED 'ZONING ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO' PASSED AND ADOPTED AUGUST 10, 1954, AND ESTABLISHING ZONING DISTRICT CLASSIFICATION FOR THE PROPERTY HEREIN DESCRIBED," the entire reading of which has been duly waived, be iniroduced, seconded by Coun- cilman Rozzt and passed by the following roll call vote. Roll call vote was as follows~ Ayes, Councilmen Frank J. Bertucelli, Andrew Rocca and Guido J. Rozzi. Noes, none. Abstaining, Councilman Emilio Cortesi. Absent, Councilman Patrick E. Ahern. Mayor Bertucelli ordered the title of the or¢tnance head. The title of the ordinance was read. City Attorney Noonan then explain-d the ordinance and advised the Council regarding procedure for adoption and passage. Councilman Rozzi moved reading of the .ordinance in its entirety be waived and zhat the ordinance be passed and adopted by reading title only, seconded by Councilmam Rocca and passed by unanimous vote. Councilman Rozzi moved that the ordinance entitled~ "AN ORDINANCE IMPOSING A TAX UPON THE PRIVILEGE OF TRANSIENT OCCUPANCY AND PROVIDING FOR THE COLLECTION THEREOF," the entire reading of which has been duly waived, be passed and adopted, seconded by Councilman Rocca and passed by the following roll call vote. Roll call vote was as follows~ Ayes, Councilmen Frank J. Bertucelli, Emilio Cortesi, Andrew Rocca and Guido J. Rozzi. Noes, none. Absent, Councilman Patrick E. Aborn. City Attorney Noonan explained the next resolution after which Councilman Rozzi intro- cuced: "A RESOLUTION FIXING THE AMOUNT OF REVENUE REQUIRED FRO~ PROPERTY TAXES FOR THE FISCAL YEAR 1966-67." Roll call vote was as followss Ayes, Councilmen Frank J. Bertucelli, Emilio Cortest, Andrew Rocca and Guido J. Rozzi. Noes, none. Absent, Councilman Patrick E. Ahem. RESOLUTION NO. 4520 FIXING TAX RATE 1966-67: City Atto=ney Noonan explained the next resolution after which Councilman Rocca introduced: "A RESOLUTION FIXING THE TAX RAT~- FOR THE FISCAL YEAR 1966-67." Roll call vote was as follows: Ayes, Councilaen Frank J. Bertucelli, Emilio Cortesi, Andrew Rocca and Guido $. Rozzi. Noes, none. Absent, Councilman Patrick E. Ahern. RESOLUTION NO. 4521 ESTABLISHING SALARY F~HEDULES AND INCREASES 1966-67: CLty Attorney Noonan explained the next resolution which had been prepared for Council's attention after which Councilman Rozzi introduced: "A RESOLUTION ESTABLISHING SALARY SCHEDULES AND INCREASES FDR THE FISCAL YEAR 1966-67." Roll call vote was as follows: Ayes, Councilaen Frank J. Bertucelli, Emilio Cortesi, Andrew Rocca and Guido J. Rozzi. Noes, none. Absent, Councilman Patrick E. Ahern. RESOLUTION NO. 4522 City Attorney Noonan explained the next resolution after which Councilman Rocca FIXING NV~UNT OF REVENUE introduced: "A RESOLUTION FIXING THE AMOUNT 3F REVENUE REQUIRED FROM PROPERTY FROM PROPERTY TAXES IN TAXES IN THE WEST PARK PARKS AND PARKWAYS NL~INTENANCE DISTRICT FOR THE FISCAL WEST PARK PARKS AND Y3AR 1966-67." RESOLUTION NO. 4523 City Attorney Noonan explained the next resolution which had been prepared after FIXING TAX RATE 1966-67 which Councilman Rozzt introduced: "A RESOLL~ION FIXING THE TAX RATE FOR THE WEST PARK PARKS AND FISCAL YEAR 1966-67--WEST PARK PARKS AND PARKWAYS ~AINTENANCE DISTRICT.~ PARKWAYS ~AINTENANCE DIST.: ~ I ,~Q,O Roll call vote was as follows: Ayes, Councilman Frank J. Bertucelli, Emilio Cortesi, GOOD AND WELFARE: DISCUSSION CONCERNING CON,ION GREEN AREAS IN WEST PARK NO. 1 AND NO. 2 AND FUTURE NO. 3: A~drew Rocca and Guido J. Rozzi. Noes, none. Absent, Councilman Patrick E. Ahern. There being nothing further, discussion followed at which time the City Attorney explained the matter relating to the Common Green areas as they presently existed in West Park No. 1 and No. 2 and the Common G=een areas which were to be established in the future West Park No. 3. He first explained the method the City employed with regard to the Common Greens in West Park No. 1 and No. 2 which had been done by the execution of an agreement and the posting of a bond, stating that the developer now requested to know if an alternate method coul~ be pursued in West Park No. 3. Mr. Noonan szated that if Council had no objections, he would explore the method of equal security and if this alternate could not be found, an agreement and bond would be necessary. At the request of Councilman Rocca, the City Attorney explained the alternate methods which could he explored, stating that Ken Jones of the firm of Wilson, Jones, Morton & Lynch had presented eight proposals. Mr. Jones, present in the audience, commented on the holding agreement which was mentioned by the City Attorney, stating that it was their desire to work out the methods and then present them to Council for their future consideration. City Attorney Noonan then further explained to Council the future development of West Park No. 3 and the matter of the installation and completion of the Common Greens. He stated that a request had been made to exp_ore means by which they could be done in units. He likewise commented on the development of the fire house station site and p[rk site which were %o be dedicated to the C~ty free and clear of encumberances, remarking that he would like the City to firs~ have dedication to the sites and an aqreement on another site promised to the City, prior to any rezoning taking place. He remarked that the earlier agreement which had been executed by the developers called for deeds to be executed by October 1st of this year. M[yor Bertucelli at this time asked as to how much time would be involved to conclude this matter. Mr. Tom Callan, representing the developers, concurred with the statements of the City Attorney, stating that it was true that an agreement had bean executed with the City for the dedication of certain parcels of property to the City. From the maps on display, he explained these dedications, remarking that problems had arisen in the development of these areas which made it impossible %o effect a dedication in the time promised, requesting Council's consideration =ohaving the agreement which had been executed amended to provide for a continuance of six months. He also requested the zoning at this time of the areas where the fire station site and the park site were to he dedicated, again asking Council's consideration to the extension of time on tYeir agreement. Mayor Bertucelli stated that once the areas had been rezoned, their values would n~turally he increased and that the City was waiting for deed and title to the property mentioned. Mr. Callan at this time displayed a map which had been approved by the County of San Mateo in 1962, stating that the area at that =ime contained a higher density and that the present map to be considered contained less in density. He remarked that if it was the City's desire at this time to have deeds =o the properties, this could be done but would be a hardship on them. Mayor Bertucelli answered that it was not the desire of the City Council to hold up development or cause hardship hut that the Ci;y was only requesting what it had been promised, remarking that the fire department was desirous of developing the site and the homeowners in the area were requesting a park. GOOD AND WELFARE~ (CONTINUED) AEUOURNMENT~ At the request of Councilman Rozzi, City Attorney Noonan explained the position of the City in granting the extension of time. In answer to Councilman Rocca's inquiry, Mr. Callan stated that they would be willing to convey the property at this time but that there existed a blanket en- cumberance over all of the property which woutd present difficulty in conveying clear title. C/fy Attorney Noonan stated that if Council wished to consider the granting of an extension of time, he would puruse this request. Brief discussion followed at which time there being no objections, Mayor Bertucelli requested the City Attorney to see if all matters pertaining to the development of these areas could be worked out by October 1st and that if difficulties were experienced, to explore the matter of an extension of time. There being nothing further, Councilman Rozzi moved, seconded by Councilman Rocca and regularly carried that the meeting be adjourned to September 6, 1966.
