HomeMy WebLinkAboutReso 63-2015 RESOLUTION NO.63-2015 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION MAKING FINDINGS AND CONSIDERING THE 2015 ADDENDUM TO THE 1996, 1998/99 AND 2005/06 SUPPLEMENTAL ENVIRONMENTAL IMPACT REPORTS AND 2000, 2006, 2008, AND 2012 ADDENDA TO THOSE REPORTS FOR THE 2015 TERRABAY (CENTENNIAL TOWERS) PROJECT WHEREAS, Myers Development Company, LLC ("Applicant") owns property commonly known as Terrabay Phase III of the Terrabay Specific Plan, which is located at One and Two Tower Place in South San Francisco, California; and, WHEREAS, the Terrabay project has an extensive planning history, dating back to the early 1980s; and, WHEREAS, in 1982 the City Council of South San Francisco ("City Council"), pursuant to the California Environmental Quality Act ("CEQA"), certified an Environmental Impact Report ("EIR") for the Terrabay project and adopted a Mitigation Monitoring and Reporting Program (MMRP); and, WHEREAS in 1996, 1998/99 and 2005/2006, respectively, the City adopted Supplemental Environmental Impact Reports ("SEIR") which each analyzed the environmental impacts of the Terrabay project and its modifications, including the potential impacts of development of Terrabay Phase III; and, WHEREAS, the City Council considered the 2000 Addendum to the 1998/99 SEIR by Resolution #147-2000 and approved the 2000 Plan Amendment by Resolution #148-2000 representing the Mitigated Plan Alternative identified in the 1998/99 SEIR; and, WHEREAS, the City Council considered the 2008 Addendum and approved the 2008 Plan Amendment to the 2006 Final Terrabay Specific Plan, in July of 2008 by Resolution #s 88- 2008 and 09; and, WHEREAS, the City Council certified the 2005/06 SEIR, which built upon the certified 1998/99 SEIR, 1996 SEIR and 1982 EIR, and adopted a Mitigation Monitoring and Reporting Program ("MMRP") for Terrabay Phase III by Resolution 81-2006, all of which remain in effect; and, WHEREAS, the City Council also considered the 2006 Addendum by Resolution #81- 2006 and approved the 2006 Plan Amendment on October of 2006 by Resolution 82-2006; and, WHEREAS,pursuant to consideration of the 2000 and 2006 Addenda and certification of the 1998/99 and 2005/06 SEIRs, for those impacts of the 2006 Plan Amendment and Final Terrabay Specific Plan that would remain significant and unavoidable, the City adopted a Statement of Overriding Considerations; and, WHEREAS, the Applicant now requests an amendment to the Final Terrabay Specific Plan and Precise Plan in order to permit a second development option consisting of Research and Development("2015 Project"); and, WHEREAS, environmental analysis was conducted pursuant to CEQA, included as Exhibit A to this resolution and incorporated by reference, to determine if additional environmental review was required for the 2015 Project, pursuant to CEQA Guidelines Section 15162; and, WHEREAS, based on the analysis conducted, the City determined that the potentially significant effects of the 2015 Project were previously and adequately addressed in the prior CEQA documents, including the 2000, 2006, 2008 and 2012 Addenda, the 2005/06 SEIR, the 1998/99 SEIR, 1996 SEIR and 1982 EIR; and, WHEREAS, the 2015 Project remains subject to all previously adopted mitigation measures applicable to the Project and Project site; and, WHEREAS, pursuant to Section 15162 of the CEQA Guidelines, no subsequent EIR shall be prepared for the 2015 Project, as no substantial changes have been proposed to the project or the conditions under which the project will be carried out that require major revisions to the previous EIRs. No new significant environmental impacts have been identified and no substantial increase in the severity of previously identified impacts has been discovered. The 2015 Project remains subject to all previously adopted mitigation measures, as applicable; and, WHEREAS, pursuant to CEQA Guidelines Section 15164, an Addendum, included as Exhibit A to this resolution and incorporated by reference ("2015 Addendum"), was prepared for the 2015 Project, which identifies the project changes and their relationship to the analysis in the previous Addenda, SEIRs, and EIR; and, WHEREAS, the Planning Commission held a properly noticed public hearing on June 4, 2015, at which time interested parties had the opportunity to be heard, to review the 2015 Project including the environmental findings, as well as supporting documents, prior to making a recommendation on the 2015 Project; and WHEREAS, a Staff Report dated June 4, 2015 was submitted to the Planning Commission analyzing the 2015 Project and recommending approval of the 2015 Addendum and the project applications; and WHEREAS, the Planning Commission exercised its independent judgment and analysis, and considered all reports, recommendations and testimony before making a recommendation on the 2015 Addendum and the 2015 Project. NOW THEREFORE, based on the entirety of the record before it, which includes without limitation, the California Environmental Quality Act, Public Resources Code §21000, et seq. and the CEQA Guidelines, 14 California Code of Regulations §15000, et seq.; the South San Francisco General Plan, and General Plan Environmental Impact Report; the South San Francisco Municipal Code; the Final Terrabay Specific Plan, as amended in 2000, 2006, 2008, 2012 and proposed for amendment in 2015; the 2005/06 Certified Supplemental Environmental Impact Report and 2000, 2006, 2008 and 2012 Addenda and Mitigation Monitoring and Reporting Program; the 1998/99 Certified Terrabay Supplemental Environmental Impact Report, which includes the 1982 Certified Terrabay Environmental Impact Report; the Certified 1996 Terrabay Supplemental Environmental Impact Report and Addendum to the 1998/99 Certified Terrabay Supplemental Environmental Impact Report; all site plans, and all reports, minutes, and public testimony submitted as part of the Planning Commission's duly noticed June 4, 2015 meeting, and Planning Commission deliberations; all reports, minutes, and public testimony submitted as part of the City Council's duly noticed public hearing on June 24, 2015, and City Council deliberations; and any other evidence (within the meaning of Public Resources Code §21080(e) and §21082.2), the City Council of the City of South San Francisco hereby finds as follows: 1. The foregoing Recitals are true and correct and made a part of this Resolution. 2. The City Council, pursuant to CEQA Guidelines section 15164, subsection (d), has considered the Addendum prepared for the 2015 R&D Project including the related Initial Study and Mitigation Monitoring and Reporting Program, attached hereto as Exhibit A, and incorporated herein by reference along with the previously certified EIRs and SEIRs. 3. Upon consideration of the Addendum, the City Council finds that the proposed 2015 Project, consisting of a Research and Development option, will not result in any of the conditions identified in CEQA Guidelines section 15162 that would require further environmental review through preparation of an EIR. 4. A second development alternative permitting Research and Development uses in the Centennial Towers will not create any new significant impacts or substantially more severe impacts as compared to those already identified and analyzed in the 2000, 2006, 2008 and 2012 Addenda and the 2005/06 SEIR, 1998/99 SEIR, 1996 SEIR and 1982 EIR. Further, the City Council finds that there is no new information of substantial importance that demonstrates new or substantially more severe significant effects, as compared to those identified in the prior CEQA documents. Nor are any new or additional mitigation measures required to mitigate any impacts of the 2015 Project. 5. Accordingly, the City Council finds that CEQA Guidelines section 15162 does not require any further CEQA review, and that an addendum, pursuant to CEQA Guidelines section 15164, is the appropriate environmental document for approval of the 2015 Project. BE IT FURTHER RESOLVED that the City Council of the City of South San Francisco does hereby: 1. Consider the 2015 Addendum, including the related Initial Study and Mitigation Monitoring and Reporting Program, as described in Exhibit A and incorporated herein by reference. 2. Find that pursuant to CEQA Guidelines section 15162 the 2015 Project does not require any further CEQA review, and that the Addendum prepared, pursuant to CEQA Guidelines section 15164, is the appropriate environmental document for approval of the 2015 Project. BE IT FURTHER RESOLVED that the Resolution shall become effective immediately upon its passage and adoption. * * * * * I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 24th day of June 2015 by the following vote: AYES: Councilmembers Karyl Matsumoto and Liza Normandy Vice Mayor Mark N.
