Councilman Rocca moved, seconded by Councilnan Ahem and regularly carried, that the minutes of the regular meeting of February 20, 1967 be approved as submitted. Mayor Bertucelli then asked if there was a motion approving the regular claims as submitted for payment. Councilman Rozzi moved, seconded by Councilnan Rocca and regularly carried, that the regular claims totaling $61,795.40 be approved for payment. Mayor Bertucelli asked if there was a motion approving the claims for Parking District No. 1 as submitted for payment. Councilman Ahem moved, seconded by Councilman Cortesi and regularly carried, that the claims as submitted for Parking Distric~ No. 1 totaling $73.87 be approved for payment. Cabot. Unit No. 1 Claim= Wilsey & Ham claim dated February 21, L967 in the amount of $461.74 for Engineering Services in connection with the Baldwin-Warren Co., claims against Assessment District. Councilman Rocca moved, seconded by Councilnan Rozzi and regularly carried, that the claim as submitted for Cabot, Cabot & Forbes Industrial Park, Unit No. 1 be approved for payment. Cabot, Cabot & Forbes Industrial Park, Unit No. 2 Claim= Carlisle & Co., claim dated February 6,, 1967 in the amount of $620.89 for Leaf Books - Cancelled Bonds & Coupons. Councilman Rozzi moved, seconded by Councill~an Rocca and regularly carried, that the claim as submitted for Cabot, Cabot & Forbes Industrial Park, Unit No. 2 be approved for payment. Conmur Street and Dianne Court Assessment District Claim= Pacific Gas and Electric Company claim dated February 6, 1967 in the amount of $2,170.65 for relocation of electric facilities. Councilman Rocca moved, seconded by Councilnan Rozzi and regularly carried, that the claim as submitted for Conmur Street and Dianne Court Assessment District be approved for payment. Marina Construction Account Claims Delta Electric Co., claim dated February 6, 1967 in the amount of $164.03 for services and material. Councilman Rozzi moved, seconded by Councilman Rocca and regularly carried, that the claim as submitted for Marina Construction Account be approved for payment. Stoneqate Ridqe Assessment District Unit No. 1 Claim= Carlisle & Co., claim dated February 6, 1967 in the amount of $723.80 for Leaf Books - Cancelled Bonds & Coupons. RESOLUTION NO. 2080~ The next item was the continued Public Hearin~ on Planning Commission Resolution No. 2080 entitled: "A RESOLUTION OF THE PLAN~ING CO~t~ISSION OF THE CITY OF SOUTH SAN FRANCISCO RECO~NDING TO THE CITY COUNCIL APPROVAL OF THE A~F~DMENT PETITION OF CAESAR-CALLAN HOMES, INC., SO AS TO REZONE AN APPROXIMATELY 180-ACRE PARCEL OF LAND FROM A 'U' DISTRICT TO A 'PC' DISTRICT." There being no objections, Mayor Bertucelli continued the Public Hearing. There being no objections, Mayor Bertucelli continued the Public Hearing. The next item was the Proclamation designatin~ March 12 - 19, 1967 as "INTERNATIONAL DEMOLAY WEEK." Mayor Bertucelli so proclaimed. The next item to be considered was the Proclamation designating Max;h 8, 1967 as "DAY IN OOURT." Mayor Bertucelli so proclaimed. The next item for Council's attention was the Supplement to Pe~tion - Cabot, Cabot & Forbes Industrial Park, Unit No. 2. City Attorney Noonan requested that the recorcs show the filing of the Supplement to Petition before the resolution approving the Supplement to Petition is adopted. Mayor Bertucelli so ordered. City Attorney Noonan explained the resolution after which Councilman Ahern introduced: "A RESOLUTION APPROVING SUPPLEMENT TO PETITIO~ - CABOT, CABOT & FORBES INDUSTRIAL PARK UNIT NO. 2." Roll call vote was as follows: Ayes, Councilnen Frank J. Bertucelli, Patrick E. Ahern, Emilio Cortesi, Andrew Rocca and Guido J. Rozzi. Noes, none. Absent, none. RESOLUTION NO. 4634 AWARD OF CONTRACT - WEST PARK COMMON~ GREENS MAINTENANCE. The next item was the compilation of bids for the maintenance of West Park Common Greens - West Park Park and Parkways Maintenance District No. 1. City Manager Aiello declared the bids received, stating that the lowest bidder was Munkdale Bros., with a bid of $19,594.80. City Attorney Noonan explained the resolution awarding the contract to Munkdale Bros., as lowest responsible bidder after which Coun,;ilman Rocca introduced: "A RESOLUTION OF AWARD OF CONTRACT MAINTENANCE FOR WEST PARK COMMON GREENS." Roll call vote was as follows: Ayes, Councilnen Frank J. Bertucelli, Patrick E. Ahern, Emilio Cortesi, Andrew Rocca and Guido J. Rozzi. Noes, none. Absent, none. RESOLUTION NO. 4635 AUTHORIZING EXECUTION OF AGREEMENT BETWEEN CITY AND DIV. OF FORESTRY, STATE OF CALIFORNIA ~3TAL FIRE PROTECTION. The communication dated February 10, 1967 fron the Department of Conservation, Division of Forestry, concerning existing Agreement for mutual fire protection aid was the next item for Council's attention. Accompanying was the Inter-Office Memorandum dated February 16, 1967 from Fire Chief John Marchi recommending renewal of Agreement. City Attorney Noonan explained the resolution which had been prepared after which Councilman Rozzi introduced: "A RESOLUTION AJTHORIZING THE ~XECUTION OF AN AGREEMENT BETWEEN THE CITY OF SOUTH SAN FRANCISCO AND Ti~E STAT~ OF CALIFORNIA, DEPARTMENT OF NATURAL RESOURCES, DIVISION OF FORESTRY FOR MJTUAL FIRE PROTECTION." RESOLUTION NO. 4636 CHANGE OF NAME OF STREET FREEWAY STREET TO PRODUCE AVENUE~ City Attorney Noonan explained the next resolution after which Councilman Ahem intro- duced: "A RESOLUTION ORDERING CHANGE OF NAME OF A STREET FROM FREEWAY STREET TO PRODUCEAVENUE." Mayor Bertucelli asked if everyone Jn the audience understood the change. There being no dissent, roll call vote was taken. Roll call vote was as follows: Ayes, Councilmen Frank J. Bertucelli, Patrick E. Ahem, Emilio Cortesi, Andrew Rocca and Guido J. Rozzi. Noes, none. Absent, none. RESOLUTION INTENTION TO LEVY SUPPLE- MENTAL ASSESSMENT CONMUR ST. AND DIANNE CT.~ RESOLUTION NO. 4637 City Attorney Noonan suggested the resolution entitled: "A RESOLUTION OF INTENTION TO LEVY SUPPLEMENTAL ASSESSMENT - CONMUR STREET AND DIANNE COURT~" dropped from the agend~ There being no objections, Mayor Bertucelli ~rdered the resolution dropped from the agenda City Attorney Noonan explained that this resolution would be in order approving the AGREEMENT FOR CONSTRUCTION execution of the agreement providing for a :m&diad:~!~ fence instead of the closing of OF OVERPASS - JUNIPERO SERRA Clay Avenue entrance and provide for a portion of the cost on a 50-50% basis, and AND CLAY AVENUE~ suggested the motion that (1) the Resolution passed by the South San Francisco Unified School District on January 9, 1967, agreeing to tender to the City Council $7,000, ~ / ~ ! payable when construction of said overpass is completed by said Council, be incorporated in the minutes; (2) the Board of Trustees be advised that based upon the representations made in the Resolution, the City of South Sar Francisco will execute a contract with the State of California and upon completion of the overpass submit a statement for $7,000. Councilman Rozzi so moved, seconded by Councilman Rocca and regularly carried. RESOLUTION NO. 46375 (CONTINUED) PARCEL ~AP 11 CAESAR-CALLAN HO~ES: In answer to Mrs. Mary Ortner's question concerning the closing of Clay Avenue, City Attorney Noonan stated that paragraph 6 of the Agreement provides for a median fence to be installed in the planter strip on Junipero Serra and that prior to construction, plans must be approved by the City and there would be no closing of Clay Avenue. City Attorney Noonan explained the resolution after which Councilman Rocca introduced= "A RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT WITH THE STATE OF CALIFORNIA DE- PARTMENT OF PUBLIC ~DRKS, DIVISION OF HIGHWAYS, FOR CONSTRUCTION OF OVERPASS AT JUNIPERO SERRA BOULEVARD AND CLAY-AVENUE (STATE HIGH~AY ROUTE ~280)." Roll call vote was as follows= Ayes, Councilmen Frank J. Bertucelli, Patrick E. Ahern, Emilio Cortesi, Andrew Rocca and Guido J. Rozz!. Noes, none. Absent, none. The next item for Council's consideration was :he Parcel Map 11 as applied for by Caesar-Callan Homes, Inc., for the subdivision of land located at the northwesterly corner of Junipero Serra and Westborough Boulevards. Discussion followed and in answer to Mrs. Mary Ortner's (32 Escanyo Drive) question if this Parcel Map had anything to do with the Westborough Expressway, City Manager Aiello explained that this was a map filed by & firm other than Caesar-Callan for the purpose of dividing a larger parcel into smaller parcels for commercial purposes and was in no way connected with the pending Parcel Map 7. Mrs. Beverly F°tos, 48 Escanyo Drive, spoke from the audience concerning the dust which would be blowing about. Mayor Bertucelli reassured.'~ Mrs. Fotos that this would be taken care of. City Attorney Noonan stated that this would be included in the Grading Permit. City Attorney Noonan continued in response to a question of bond posting that a bond is required to cover any work that is left from the grading. Mrs. Ortner asked as to a performance bond which would cover any dangerous or difficult work resulting from grading by stating that dust condition was a dangerous situation and that fifty claims were filed against the contractor because of dust from Junipero Serra Freeway. Mrs. Ortner continued by stating her own personal experiences with the dust problem. Councilman Rocca reassured Mrs. Ortner that Parcel Map 7 would not be acted upon until these matters are concluded satisfactorily. Mr. Anthony Montoya, 1125 Miller Avenue, inquired if there wasn't a surety bond put up by each one of these contractors for certain amount of monies that would be reim- bursed under certain conditions. City Attorney Noonan replied that this could not be done because we would be setting up the City as a Court of Claims. He further explained that bonds were required to insure the correcting of dangerous conditions ~hat could cause a hazard to the public, but not insurance policies that would protect the cOntractors from any claims against them. Mr. Montoya suggested that a new approach coulc be set up to force a developer into insurance to provide for these situations. Councilman Ahem explained a homeowners' responsibility for injuries sustained on his property in reply to Mr. Montoya. City Manager Aiello said that this was not the issue before Council. This was a Planning matter in which a developer was seeking permission to divide a parcel. When the time comes, he continued, for the developer to request a Grading Permit, these conditions could he worked into the Grading Permit. City Attorney Noonan explained to Mr. Montoya's inquiry of why these conditions could not be stipulated as a responsibility to the C/fy before approving the Parcel Map but that these conditions would be a part of the Grading Permit. Mrs. Beverly Fotos inquired again if they had Jo wait for the Grading Permit before anything could be done to control the dust. City Attorney Noonan explained that it was necessary for them to have the Grading Permit and all of these conditions to control the dusz and other protective provisions would be included in the Grading Permit. Mayor Bertucelli repeated Mr. Noonan's provisions to the issuance of a Grading Permit. Mrs. Ortner inquired of Council'if a City Ordinance could not be adopted with all of these provisions in it to protect the people from dust and dirt with surety bonds posted. Mayor Bertucelli replied that before a Grading Permit is issued, these conditions are imposed. Mrs. Ortner requested that a committee be appointed to go over the Grading Permit with the City Council. City Attorney Noonan stated that the City alre[dy has an Ordinance which has control measures stipulated. He explained that the Ci=y had no control of the dust from Junipero Serra and Serra Monte as it was a State projec~ but the City had firm controls ~ the Ordinance. City Attorney Noonan expressed his willingness to study any new approach to remedy the basic problem. PARCEL MAP 11 CAESAR-CALl,AN HOMES (CONTINUED) SIX-~ONTH EXTENSION REQUEST OF PENINSULA MASTER BUILDERS - FIRE ALAEL{ INSTALLATION ~ UP-35 LUCKY STORES, INC. ~ SEC. 26f. 1 AND 2 SIGN ORDINANCE.' Councilman Rocca .suggested to Mrs. Ortner that she contact her insurance agent relative to damages to her ~operty by dust. Mrs. Ortner replied that she had contacted the insurance agents of G~y F, Atklnson but received no satisfaction and that she was not contacting her own agent. She felt it was not the responsibility of her own insurance company and was not looking for an increase in her insurance premiums which she felt would result from contacting them. Councilman Ahern also suggested that Mrs. Ortner call in her own insurance broker and suggested that they handle her claim. Councilman Cortest replied in sympathy with Mrs. Ortner concerning the dust. Mr. M. Gagliolo, 760 Grand Avenue, suggested t~at the people concerned, contact their own agents who would in turn seek satisfaction. Mayor Bertucelli replied to Mrs. Orner's statement that this was the City's responsi- bility by explaining that Serra Monte was not a City project. Mr. Gagliolo explained to Council that insurance companies would not raise the pre- miums to these homeowners because the damage was not their cause, and that they would pursue the responsibility to the developers. Mayor Bertucelli commented on the notice serviced to Serra Monte, Atkinson and Buzz Haskins to control the dust by watering. Mr. Gagltolo concluded by stating that he thought the City Council had done their duty to protect the people in the area. Mr. Peter Fotos, 48 Escanyo Drive, spoke from the audience regarding the speed and overloading of trucks on Junipero Serra and the dirt and debrt falling from trucks on Junipero Serra, E1Camino and Hickey Boulevards. Councilman Rocca requested the Chief of Police to take whatever steps necessary to correct the situation. Mayor Bertucelli replied to Mrs. Ortner's inquiry for a copy of the Minutes of the meeting of January 16, 1967 that they were available in the City Clerk's office. Mr. Montoya suggested that the stipulation of a designated route be adhered to by the grading contractor. Director of Public Works Louis Goss replied that we do have truck routes. Mayor Bertucelli invited any interested party to come to the Engineer's office to see the routes as they are laid out. In answering the question if the State or County has the right over the City Council, City Attorney Noonan said that the State law designates that the State cannot be pre- empted by a City ordinance. City Manager Aiello stated that Junipero Serra was a State Highway and under the control of the State regulations and explained the City's control on City streets. Mr. J. T. Zlatunich, 59 Bradford Drive, a State Highway Patrolman, replied to Mayor Bertucellt's request that he speak by stating that he could add nothing more to what has already been said. Discussion followed concerning the jurisdiction of State and City in regard to the traffic control, after which Mayor Bertucelli continued the Parcel Map 11. The next item was the communication dated February 23, 1967 from Peninsula Master Builders requesting a six-month extension to complete the Fire Alarm installation in Westborough Units No. 1-C and No. 2. Accompanying was a communication dated Februazy 21, 1967 from United Pacific Insurance Group concerning requested extension. Also accompanying was the Inter-Office Mamcr ardum dated February 24, 1967 from Fire Chief John Marchi recommending the extension to November 1, 1967. Councilman Rozzi moved, seconded by Councilman Ahern and regularly carried, that the recommendation of the Fire Chief be approved ~nd accepted. The Use Permit No. 35 as applied for by Lucky Stores, Inc., for the placement of an approximately 108.00 sq. ft. sign on rear wall of market in the PC District was the next item for Council's attention. Accompanying was the communication dated February 20, 1967 from Lucky Stores, Inc., appealing the Planning Co,~nission's denial. There being no~jections, Mayor Bertucelli set the Public Hearing for April 3, 1967. The next item was the Inter-Office Memorandum dated January 18, 1967 from City Planning Daniel M. Pass submitting the Special Report of the Landscaping of the City's Freeways amd recommending that the City Council transmit their intent to enforce Sec. 26f. 1 and 2 of the Sign Ordinance to the State Division of Highways. Accompanying was the Inter-Office Memorandum cared February 14, 1967 from City Manager Eugene Aiello submitting his recom~endation. SEC. 26f 1 AND 2 SIGN ORDINANCE (CONTINUED) RELOCATION OF GATES REQUEST BY SO.S.F. HIGH SCHOOL~' MONTHLY REPORTS SO.S.F. HIGH SCHOOL STUDENT GOVERNMENT REQUEST TO HOLD FESTIVALs REQUEST TO HOLD PUBLIC RELIGIOUS SERVICES ~ GOOD AND WELFAREs* COMMUNICATIONS CONCERNING INTERSECTION OF WEST O~NGE AND CAMARITAS AVENUESs Councilman Rozzi replied to Mrs. Ortner's question as to what landscaping was being referred to - future or present - by stating that this was the landscaping on the Bayshore Freeway. City Manager Aiello explained further that when the Bayshore Highway is widened by the Division of Highways, six or eight lanes, chrough the area north of East Grand Avenue, some landscaping would he taken out. City Manager Aiello continued by stating that the State has made a condition that our Sign Ordinance has to be in accord with the State Act governing billboard controls. He further suggested that our act coincide with the State; and in following the State, the City can make its declaration. City Manager Aiello stated that the State would bear the entire cost of landscaping in reply to Mrs. Ortner's inquiry as to who was to pay for the landscaping. Councilman Rozzi moved, seconded by Councilman Rocca and regularly carried, that the recommendation of the City Manager be approved and accepted. The next item was the communication dated October 5, 1967 from Mr. S. Winston, Vice Principal, requesting permission to relocate the gates in front of the South San Francisco High School. Accompanying was the Inter-Office Memorandum dated February 14, 1967 from Police Chief John Fabbri recommending approval, subject to conditions. At the request of the City Attorney and there being no objections, ~ayor Bertucelli continued the matter pending furth~ study. Monthly Reports were received from the followings City Clerk's Report - January 1967 Parking District No. 1 - January 1967 Library - January 1967 San Mateo County Dept. of Public Hea4th - Sanitation Section - January 1967 There being no objections, Mayor Bertucelli ordered the reports accepted and placed on file. The next item was the communication dated February 8, 1967 from the Student Government of South San Francisco High School requesting permission to hold a festival for fund raising April 21 and 22, 1967. Accompanying was the Inter-Office Memorandum from Police Chief John Fabbri dated February 24, 1967 recommending approval suhJecz to the conditions that (1) games, equipment and events to be checked by the Poiice Department prior to opening of festival; (2) Police Officer to be on duty during entire time festival is held. Councilman Rozzi moved, seconded by Councilman Rocca and reguiarly carried, that the recommendation of the Chief of Police he approved and accepted. The next item was the communication dated January 20, 1967 from Rev. Luciano Comacho requesting permission to hold pubIic religious services on Sundays between 2s30 p.m. and 3s30 p.m. at the intersection of Grand Avenue and Linden Avenue. Accompanying was the Inter-Office Memorandum from Police Chief John Fabbri dated February 8, 1967 recommending approval subject to the conditions that (1) religious services to be conducted on scene between the hours of 2s30 p.m. and 3s30 p.m.; (2) with a total of ten (10) participants; (3) that none of the assembly or service will be con- ducted upon a public street to impede or cause a traffic congestion; (4) that the services or participants will not interfere with the movement of pedestrians upon a sidewalk; (5) that the services and the use of a microphone shall not be conducted in a boisterous or loud manner; (6) that the preservation of t~e peace and order of the community will he maintained; also that the Police Department he notified 72 hours in advance of services to be held. Councilman Ahern moved, seconded by Councilman Rocca and regularly carried, that the recommendation of the Chief of Police be approved and accepted. There being nothing further, Mayor Bertucelli asked if any member of the Council had anything they wished to offer under Good and Welfare. Councilman Cortesi presented a letter from Mrs. Robert Bergero, 39 Escanyo Drive, requesting that it be read. City Manager Aiello read the letters "February 23, 1967 Councilman Emilio Cortesi City Hall South San Francisco, California Dear Councilman Cortesi: Regarding our telephone conversation last week about the proposed intersection at West Orange and Camaritas when the extension of Westborough Boulevard is completed, I would again like to state my feeIings. 115 GOOD AND WELFARE~ (GONTINUED) This intersection will be in the direct path of any child using our beautiful new Library. In my case my children walk to our Parochial School across this intersection. The children from Buri Burl use this route to walk to our Boy's Club. The number of children that cross Ju3ipero Serra Boulevard is very small compared to the number that will cross this intersection. Signals did not help on Junipero Serra, and this will be a-~three-way signal; should we have three children killed there before we do anything about it? The City wants this road built so I believe the City should do everything in their power to protect those who cross it. I urge you, and I am sure I can speak for ail mothers on this side, please help us to get the City to put an overpass over this crossing. City Manager Aiello read the letter: "February 23, 1967 Mayor:Frank J. BertuceiIi City Hall South San Francisco, California Dear Mayor Bertucelli: I have contacted the City Engineering Department regarding the proposed intersection at West Orange Avenue and Camaritas when the extension of Westhorough BouIevard is compIeted. As I understand it this will be a four-iane divided Expressway with a left turn lane and having a three-way signal. This intersection will be in the direct path of any child using our beautiful new Library. In my case my children walk to our Parochial School across this intersection. At the request of the Mayor, City Manager Aiello read the reply: "March 2, 1~7 Mrs. Robert Bergero 36 Escanyo Drive South San Francisco, California Dear Mrs. Bergero: Thank you for your letter of February 23, 1967 and the suggestion contained therein that consideration be presently given to the con- struction of an overpass at the intersection of West Orange and Camarttas. We have received advice by experts that such an overpass is not needed. However, as a result of your incuiry I am requesting a new evaluation of the necessity for such an overpass. Bertucelli Mayor hs" Mayor Bertucelli then stated as follows: "Although we have been previously advised that the overpass will not he needed, we will take Mrs. Bergero's suggestion and have a new study made by the City Manager, Director of Public Works and our City Police Chief." Peter Fotos, 48 Escanyo Drive, expressed her concern in having children cross a traffic to an island to push a button to stop traffic and proceed across another two lanes of traffic of the proposed expressway. Police Chief Fabbri explained the mechanics of the electrically controlled signal and the portions of traffic which would be controlled. Councilman Ahem stated that this would be looked into in reply to Mrs. Foto's state- ment that this was inadequate. He continued t~at a new study is to be made by the City Manager, Director of Public Works and Chief of Police. Discussion followed concerning the traffic and control of the proposed Westborough Expressway. Mrs. Mary Ortner, 32 Escanyo Drive, presented oroposa~: from the Rancho Burl Burl Homeowners= (1) to have a committee appointed bythe Rancho Buri Buri Homeowners Association to work with the County for the apgroved plans of the expressway and to work closely with the City Council before any approval is given to the expressway;' (2) to provide a landscaping firm chosen by th~ people in the area and paid for by the City to approve landscaping along side of :he road; (3) to request the State to open Suntpero Serra for a left turn for the people in this area who are 9oing to be blocked in. She continued that there is no ac:ess to the proposed freeway, and these were to be granted before the proposed f:eeway is approved by Council. Mrs. Ortner at this time read a letter which S~e had received in reply to one which she had written to the White House concerning ~he matter of beautification and landscaping. Mrs. Ortner contended that one one or two different occaions, she had been told that the "affair of Wilsey & Ham and Mr. Calla~" took place because it was necessary for the Westhorough Water District to relocate their pumping station. Discussion followed concerning why the proposed route had been changed to a new route of 100 ft. north. Mrs. Ortner stated that she believed that in the City's Master Plan, there was never any mention of property being acquired other than the California Golf Club. She inquired of Council if there had been any correspondence received from Sacramento within the last week or two, to which Mayor Be~tucelli replied there had not. Mrs. Ortner inquired if the change of route was to 100 ft. north to accommodate the Westborough Water District. Mayor Bertucelli replied that he did not know and that the Water District was not the concern of the City. Mrs. Ortner continued by describing a meeting with the County in which members of the Rancho Buri Buri Homeowners were present. She said the County Engineer stated at the first meeting that Wilsey & Ham came into the picture for the relocation of that pump station and she concluded by stating that facts prove this is not true. Mayor Bertucelli stated that he was not present at the time. Mrs. Ortner requested to know why this change of route north away from the California Golf Course nearer to the homes took place. City Engineer Louis Goss answered by stating that the original plan line was laid out by the State Highway Engineer after consulting with the County Engineer and County Planning Co~,ission. He continued hy stating that the Water District had the pump house right in the way the line would go. Troroff, working for Callan, asked for Permission to build a temporary construction south 100 ft. which they did and there were negotiations between Tronoff Engineers anc the State at that time. They built the highway~ to the side and then located it again in the original position. Wilsey & Ham, continued Mr. Goss, had nothing to do wit~ that. Mr. Goss went on further to explain that he had attended meetings which weze concerned with moving the Junipero Serra and Freeway further away from Callan Subdivision further to the east because they wanted more room for their tract shopping center. He explained that this was a separate matter and had nothing to do with t~e East-West Westborough Extension Expressway. Discussion followed concerning the names of State and County officials involved. Mrs. Ortner then asked Councilman Rozzi if he ~as now or had ever been involved in any way in the Club View Apartments to which he replied, yes. In answer to Mrs. Ortner's question, "In what way?", Councilman Rozzi replied that a group of investors put the apartments up on the leased portion of the property which is acreage north of West Orange and that he was not now involved in it. Mrs. Ortner then asked if he was in on it, to which he replied that he was temporarily on the Board of Directors to set this up; never on the original Board and the corporation has not yet been formed. Mrs. Ortner then asked that in view of these facts, when something came up concerning the Westborough Expressway and the Golf Course property, was it proper for him to vote on it in view of these circumstances. Councilman Rozzi replied that the County took a strip of land along the leased portion of the property, that the group that has the pr>perry are not being reimbursed and there is no benefit to the group. He further stated that he had no connection with them. 1i7 GOOD AND WELFARE (CO T ED) Mrs. Ortner then asked if he was an employee of Poletti Realty. Councilman Rozzi replied, yes, further commenting that he and Mrs. Ortner had a discussion on this a few weeks ago and he wanted to clear the air himself. He further stated that the tax bill for the Club View Apartment is sent to the California Golf Club, that he was in no way connected with it [nd that Mr. Poletti is President. Mrs. Ortner then asked if it were so that the firm you are employed by has a lot of c~mmerctal dealings in South San Francisco, to which Councilman Rozzi replied, primarily industrial. Mrs. Ortner then asked as to Councilman Rozzi's connection with the Industrial Savings and Loan to which he replied, a Senior Vice President. She then asked as to Logan Franklin's status in the same organization to which Councilman Rozzi replied as one of the Board of Directors. Mrs. Ortner concluced hy saying she felt very strongly that the Enterprise-Journal's editor is too close to City Hall to he printing the news in the manner in which it should be printed. Mrs. Ortner continued by requesting to know why the Master Plan in 1962 or 1963 had no mention of any property of the residents being involved, only the California Golf Club. Mayor Bertucelli replied that he did not know ~hat happened in 1962 Councilman Ahern explained that the Master Plat was only a guide and that there have aAready been changes made in it. Mrs. Ortner informed the Council on the provisions of the Land Conservation Act which protects the golf club property as a green belt and there could be no condemnation procedures under present legislation. Mrs. Ortner then spoke on the traffic congestion on E1Camino Real and Chestnut Avenue. Police Chief John Fabbri stated that the one ard two highest accident ratio in the City was Spruce Avenue and E1Camino Real, and Chestnut Avenue and E1Camino Real. Mrs. Ortner inquired if Chestnut Avenue was going to be continued to which City Manager Aiello replied that the present project will c~rry that to Mission Road. Councilman Ahern replied to Mrs. Ortner's question as to when is this connection to take place by stating that there are only tentative plans and it takes a great deal of money to finance it. Discussion followed concerning the congestion cf traffic in that particular area from traffic from the Westhorough Freeway Extension. Mrs. Ortner suggested that it start on Chestnut, all the way up Grand Avenue or Hillside Boulevard and work up. Councilman Rozzi stated that when the time comes when all information is available, they will he called into a Study Session. Police Chief Fabbri replied to Mrs. Fotos' inquiry as to how many children were going to public and parochial schools on the north side of golf course by stating that there were about 3,600 children. Discussion followed concerning the crossing of school children to the library while under the supervision of one school teacher, Mrs. Ortner inquired if the Library had been a bond issue to which the Mayor replied that it was not. Mrs. Ortner asked if these requests would be given consideration to which Mayor Ber~ucelli replied that they would he given corsideration as far as the City plans were concerned and these were open to the public. Mrs. Ortner requested that they he allowed to he present to go over the plans when they were received from the County. Councilman Roz~ requested City Manager Aiello to contact the Rancho Buri Buri Homeowers when the City was in receipt of the final plans. Mrs. Ortner again requested that the City pay for a private concern to approve the landscaping plans. Councilman Ahern explained the procedure hy which the City lets out to bid work to contracting firms. Mrs. Ortner again requested to be closer info, ed and asked that the State be requested to open Junipero Serra to a left turn lane at Arroya Drive. Mayor Bertucelli said that they would request it. Mrs. Ortner requested again to be notified and again Mayor Bertucelli assured her that they would be. Mrs. Fotos spoke again on the overpass at Camaritas and Orange Avenues and asked when the City would be in receipt of the final plans. City Engineer Louis Goss replied that the plans would be out in thirty days. Mayor Bertucelli replied to a statement that the plans had already been formed with no provisions for an overpass, that these were preliminary plans and that the City 118 GOOD AND WELFAREs (CONTZNU£D) ADJOURNMENT Manager, City Enggn~e=,~; Chief of Police were ~o review these plans and then have a Study Meeting with them. Mr. Gaglioli spoke in behalf of the residents of Rancho Burl Burl Homeowners requesting the Council meet with them and consider the overpass to prevent the reoccurrence of children's deaths as had happened on Sunipero Serra.
