The meeting was called to order by Mayor Bertucelli at 8:00 p.m. The Pledge of Allegiance to the Flag was recited after which the Invocation was given by Reverend Martin L. Frank Mammini, Andrew Rocca and Warren Steinkamp Absent: None Mayor Bertucelli asked if there was a motion approving the Minutes of the regular meeting of September 16, 1968. Councilman Rocca moved, seconded by Councilman Mammini and regularly carded, that the Minutes of the regular meeting of September 16, 1968 be approved as submitted. Mayor Bertucelli then asked if there was a motion approving the regular claims as submitted for payment. Councilman Ahem moved, seconded by Councilman Steinkamp and regularly carried, that the regular claims, totaling $216,832.97, be approved for payment. Mayor Bertucelli asked if there was a motion approving the claims for Parking District No. 1 as submitted for payment. Councilman Rocca moved, seconded by Councilman Mammini and regularly carried~ that claims as submitted for Parking District No. 1, totaling $698.95, be approved for payment. Cabot, Cabot & Forbes Industrial Park, Unit No. lA Claim: N~ilsey & Ham claim dated September 24, 1968 in the amount of $279.27 for Investigation - Street Light System. Councilman Mammini moved, seconded by Councilman Rocca and regularly carried, that the claim as submitted for Cabot, Cabot & Forbes Industrial Park, Unit No. lA, be approved for payment. Cabot, Cabot & Forbes Industrial Park, Unit No. 2 Claim: Wilsey & Ham claim dated September 24, 1968 for Invoices Nos. 4644, 4645, 4646, 4647, 4649 and 4650, totaling $3,821.30, for Engineering Services through August 31, 1968. Airport Boulevard Fire Service Assessment District Claims: (a) Enterprise-Journal claims dated July 17, 1968; July 24, 1968; and August 28, 1968, totaling $275.25, for Legal Advertising. (b) County Recorder Marvin Church, County of San Mateo, claim dated July 26, 1968 in the amount of $16.80 for recording of Assessment Maps. Councilman Mammini moved, seconded by Councilman Rocca and regularly carried, that the claims as submitted for So. Airport Boulevard Fire Service Assessment District, be approved for payment. The next items for Council's consideration were the Proclamations: MARINE CIVILIAN ASSISTANCE PROGRAM - VIETNAM "CIVIC ACTION" - September 28, 1968 through October 15, 1968; B'NAI B'RITH 125th ANNIVERSARY - October 13 - 19, 1968; NATIONAL EA{PLOY THE HANDICAPPED WEEK - October 6 - 12, 1968. There being no objections, Mayor Bertucelli so proclaimed. RESOLUTION NO. 4955 OF INT~TION TO APPROVE AN A~ENDMENT TO CONTRACT RETIRF3~ENT SYSTEM: City Attorney Noonan explained that the first resolution had been prepared in accordance with the request of the Administrative Assistant and after passage, would start a series of actions leading to the amendment to the contract between the City and the Board of Administration of the Public Employees, Retirement System. Councilman Ahern introduced the resolution entitled: "A RESOLUTION OF INTF~NTION TO APPROVE AN AMENDMENT TO CONTRACT BETWEEN THE BOARD OF ADMINISTRATION OF ~E PUBLIC EMPLOYEES' RETIRF~ENT SYSTEMANDiTHE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO." RESOLUTION NO. 4956 City Attorney Noonan explained that the next resolution accepted an easement for the ACCEPTING F. RESOLUTION NO. 4957 AWARD OF CONTRACT IMPROVEMENT AND SIGNAL- IZATION WESTBOROUGH & CALLAN BLVDS: The next item was the Inter-Office Memorandum dated October 3, 1968 from the Director of Public Works submitting compilation of bids received for the Improvement and Signal- ization of the intersection of Westborough and Callan Boulevards, and recommending award. Director of Public Works Louis Goss declared the bids received, stating that the low bidder was The Lowrie Paving Company, Inc. Councilman Rocca introduced the resolution entitled: "A RESOLUTION OF AWARD OF CONTRACT I~PROVENH[NT AND SIgnALIZATION OF THE INTERSECTION OF WESTBOROUGH AND CALL~q BOULEVARDS, SOUTH SAN FRANCISCO, CALIFORNIA." RESOLUTION NO. 4958 AUTHORIZING ACCEPTANCE AND EXECUTION OF ENDORSE- MENT (BLUE CROSS): City Attorney Noonan explained that the next resolution, in accordance with Council's request, would provide health and medical insurance to employees through a group agree- ment between City and Blue Cross Hospital Service of California after which Councilman Mammini introduced the resolution entitled: "A RESOLUTION AUTHORIZING ACCEPTANCE AND EXECUTION OF THE ENDORSEMENT TO GROUP AGREFJ~BNT NO. 2008, HOSPITAL SERVICE OF CALIFORNIA. RESOLUTION NO. 4959 AWARD OF OONTRACT DREDGING COLMACRE~K (2YD NW-6 DRAGLINE): The Inter-Office Memorandum dated September 26, 1968 from the Director of Public Works submitting compilation of bids received for the dredging of Colma Creek and Tributaries 1968 and recommending award was the next item for Council's attention. City Attorney Noonan explained that the next two resolutions were concerned with the award of contracts for the dredging of Colma Creek. Director of Public Works Louis Goss declared the bids received, stating that the low bidder for the 2-yard NW-6 Draglfne was L. C. Smith Company. Councilman Ahern introduced the resolution entitled: "A RESOLUTION OF AWARD OF CONTRACT SPECIFICATIONS FOR DREDGING COLMA CREEK AND TRIBUTARIES - 1968." Roll call vote was as follows: Ayes, Councilmen Frank J. Bertucelli, Patrick E. Ahern, F. Frank Mamminl and Warren Steinkamp. Noes, none. Absent, ~one. Abstaining, Councilm Andrew Rocca. RESOLUTION NO. 4960 AWARD OF CONTRACT (CRANE 3/4 YD BUCKET) Director of Public Works Goss declared the bids received for the Mobile Truck Crane wit'. 3/4-yard bucket, stating that the low bidder was Barton Construction Co. Councilman Rocca introduced the resolution entitled: "A RESOLUTION OF AWARD OF CONTRACT SPECIFICATIONS FOR DREDGING COLMA CREEK AND TRIBUTARIES - 1968." RESOLUTION NO. 4961 AWARD OF CONTRACT REROOFING UPPER ELEVATION MAGNOLIA CENTER: The next item was the Inter-Office Memorandum dated September 18, 1968 from the Superintendent of Recreation and Parks, submitting compilation of bids received for the reroofing of Upper Elevation of Magnolia Center and recommending award. Accompanying was the communication dated September 23, 1968 from G. J. Gutdotti Company, Inc., concerning contract to retool portion of Magnolia Center. City Attorney Noonan explained that a resolution was ready for consideration after the declaration of bids. Director of Public Works Goss declared the bids as received by Superintendent of Recrea- tion and Parks Robert Maxey, stating that the low bidder, G. 3. Guidotti Company was disqualified because a bid bond was not presented with their bid. Superintendent of Recreation and Parks Maxey recommended that award of contract be made to the low qualified bidder, Western Roofing Service. Councilman Ahem introduced the resolution entitled: "A RESOLUTION OF AWARD OF CONTRACI REROOFING UPPER ELEVATION - MAGNOLIA CENT5R." Roll call vote was as follows: Ayes, Councilmen Frank J. RESOLUTION NO. 4962 The next item was the Inter-Office Memorandum dated September 26, 1968 from the APPROVING PLANS & SPECS Director of Public Works submitting plans and specifications for the Corporation AUTHORIZING WORK AND CALL Yard Roof Reconstruction and requesting approval and authorization to advertise FOR BIDS - CORPORATION YARD for bids. ROOF RECONSTRUCTION: City Attorney Noonan explained the resolution after which Councilman Mammini intro- jO ~ 0 duced the resolution entitled: "A RESOLUTION APPROVING PLANS AND SPECIFICATIONS, AUTHORIZING /}{E WORK AND CALLING BIDS FOR CORPORATION YARD ROOF RECONSTRUCTION." R-rSOLUTION NO. 4963 AUTHORIZING ISSUANCE OF PERMIT TO INSTALL A SANITARY SEWER LIN£ - SERRANDNTE: In accordance with Council's direction, City Attorney Noonan explained that the City's staff has accomplished the execution of an agreement regarding Serramonte sewer con- nections and a resolution had been prepared authorizing issuance of a Permit to the developer to install a larger sewer line at their cost and expense. Councilman Rocca introduced the resolution entitled: "A RESOLUTION AUTHORIZING ISSUANCE OF A PE~%~IT TO INSTALL A SANITARY SEWER LINE IN SOUTCLIFF AVENUE, KING DRIVE AND ALTA MESA DRIVE." ROBINSON IN MENDRY: City Attorney Noonan presented to Council a resolution honoring the memory of Mr. Victor E, Robinson, deceased, who formerly served on the Planning Commission and Library Board. Councilman Ahem introduced the resolution, stating that Mr. Victor E. Robinson had been a public-minded citizen and would be greatly missed: "A RESOLUTION IN MENDRY OF VICTOR E. ROBINSON, DECEASF. D, AND EXPRESSING SYMPATHY TO HIS FAMILY." Councilman Steinkamp respectfully concurred with Councilman Ahern's statement. RESOLUTION NO. 4965 CALLING FOR BIDS ON SALE OF IMPROVF~T BONDS - SO. AIRPORT BLVD. FIRE ASSESSMENT DISTRICT: City Attorney Noonan explained that the next resolution which did not appear on the evening's agenda, called for bids on sale of bonds in the South Airport Boulevard Fire Service Assessment District and was ready for introduction after which Councilman Ahem Introduced the resolution entitled: "A RESOLUTION CALLING FOR BIDS ON SALE OF IMPROVF~ENT BONDS SOUTH AIRPORT BOULEVARD FIRE SERVICE ASSESSMENT DISTRICT." Roll call vote was as follows: Ayes, Councilmen Frank 3. Bertucelli, Patrick E. Ahem, F. Frank Mammini, Andrew Rocca and Warren Steinkamp. Noes, none. Absent, none. RESOLUTION NO. 4966 OF GOVERNING BODY OF APPLICANT: City Attorney Noonan explained that the next resolution authorized application to the Department of Housing and Urban Development for Federal grant for force main pumping station and was requested by the Director of Public Works. RESOLUTION NO. 4968 AUTHORIZING EXECUTION OF AGREEMENT R~LEASING AND PROVIDING RECONVEYANCE OF ~ESTBOROUGH PARCEL 16: City Attorney Noonan explained that the next three resolutions were concerned with the six-acre park site in the Westborough area and the first of the three resolutions autho- rized execution of the agreement between the City of South San Francisco and the purchasers of that parcel after which Councilman Ahem introduced the resolution entitled: "A. RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT RELEASING AND PROVIDING FOR RECON- VEYANCE OF WESTBOROUGH PARCEL 16." Roll call vote was as follows: Ayes, Councilmen Frank 3. Bertucelli, Patrick E. RESOLUTION NO. 4969 ACCEPTING GRANT DEED FROM GNFr INVESTORS: City Attorney Noonan explained that the second resolution would authorize acceptance of the deed to the six-acre park site after which Councilman Mammini introduced the resolution entitled: "A RESOLUTION ACCEPTING A GRANT DEED FROM C~ INVESTORS, A CALIPORNIA LIMITED PARTNF_RSHIP." RESOLUTION NO. 4970 AUTHORIZING ESCROW INSTRUCTIONS WESTBOROUGH PARCEL 16: City Attorney Noonan explained that the third resolution would authorize the City Attorney's office to prepare the necessary escrow instructions to clear this property with the title company, after which Councilman Stetnkamp introduced the resolution entitled: "A RESOLUTION AUTHORIZING ESCROW INSTRUCTIONS, DEEDS OF RECONVEYANCE, AND RELEASES - WESTBOROUGH PARCEL 16." REQUEST OF ALL SOULS,CHURCH The next matter for Council's consideration was the communication dated September 20, FOR ANNUAL FESTIVAL ON 1968 from Ail Souls Church requesting permission to hold the annual festival of Ail NOV. 1, 2 AND 3, 1968= Souls Parish on November 1, 2 and 3, 1968. Councilman Ahem moved, seconded by Councilman Rocca and regularly carried, that the request as submitted be granted. ADVISING OF RESIGNATION OF htR. WALTER CAPACCIOLI AS MEMBER OF ADVISORY COM- MITTEE - COLMA CREEK FLOOD CONTROL & APPOINTMENT OF MR. DANIEL SOFRANAC: The next item was the communication dated August 26, 1968 from the County Engineer and Road Commissioner, County of San Mateo, advising of the resignation of NLr. Walter Capacciol[ as a member of the Advisory Committee for the Colma Creek Flood Control Zone. Mayor Bertucelli at th~s time requested Council's confirmation of his appointment of ~. Dan~.el Sofranac as a member of the Advisory Committee for the Co!ma Creek Flood Control Zone. Councilman Ahern moved, seconde~ by Councilman Mammin] and regularly carried, that the Mayor's appointment of Ntt. Daniel Sofranac as a member of the Advisory Committe for the Colma Creek Flood Control Zone be confirmed. CLAIM AS FILED BY .~R. WILLIA~ BEITZ IN BEHALF OF HIS SON~ The next item was the communication dated September 13, 1968 from htr. William Beitz presenting a claim for medical expenses as a result of alleged injuries suffered by his son on August 16, 1968. Councilman Rocca moved, seconded by Councilman Ahem and regularly carried, that the claim be denied and referred to the City's insurance carrier. CLAI~ AS FILED BY ~R. ALVORD ~cGIBONEY: The claim as filed against the City of South San Francisco by Mr. Alvord G. McGiboney alleging automobile damages at 360 Shaw Road on July 16, 1968 was the next item. Councilman Rocca moved, seconded by Councilman Mammint and regularly carried, that the claim be denied and referred to the City's insurance carrier. CLAIM AS FILED BY MR. HENRY GILFILLANt The next matter for Council's attention was the claim as filed by Mr. Henry ¥~. Gilfillan alleging loss of boat equipment and damage to boat property at the Oyster Point Marina on June 18, 1968. Councilman Rocca moved, seconded by Councilman Mammtni and regularly carried, that the claim be denied and referred to the City's insurance carrier. REQUEST OF EUGENE AND CHARLES GONZALES TO CONNECT TO CITY'S SEWER SYSTEM: PROPOSAL TO JOIN FEDERAL RFJ~TAL ASSISTANCE PROC~N~4~ CITY PLA/qNER'S REPORT~ The next item was the communication dated January 16, 1968 from Eugene ~ and Charles R. Gonzales requesting permission to connect to the sewer system of South San Francisco and agreeing to pay all charges and fees. Councilman ~ammini moved, seconded by Councilman Ahem and regularly carried, that the request as submitted be approved, subject to capac~.ty interest charges and fee~ being paid. The next matter was the proposal to join in the Federal Rental Assistance Program. This matter having been decided under Resolutton$~ no further action was required. The City Planner's Report to the City Council with respect to Use Permit and Variance Requests considered on September 24, 1968 was the next item to be considered. The next item was the Inter-Office Memorandum dated September 18, 1968 from Equipment Maintenance Supervisor submitting compilation of bids and recommendation for three Police cars and concurrence by Arthur A. Rodondi, Acting City Manager. Acting City Manager Arthur Rodondi declared the bids received, stating that the Iow bidder was Arata Pontiac. Councilman Rocca moved, seconded by Councilman Mammini and regularly carried, that the recommendation of the Acting City Manager and Equipment Maintenance Supervisor be approved and accepted and award of contract be made to Arata Pontiac. Monthly Reports were received from the Police Department for the months of July and August, 1968. There being no objections, Mayor Bertucelli ordered the Reports accepted and placed on file. Department of Alcoholic Beveraqe Control~ Application as filed by William J. Patton, Jr., and Varni Patton for Off-Sale General at 249 Hillside Boulevard. There being no objections, Mayor Bertucelli ordered the report placed on file. There being nothing further, Mayor Bertucelli asked if any member of the City Council had anything they wished to offer under Good and Welfare. Councilman Mammini at this time brought to the attention of the members of the City Council the matter of jet noise as it affected the City. He commented on a visit to the airport and the iarger aircrafts which are soon to be empioyed. He asked if an ordinance could be adopted which wouId make it necessary for pIanes to fIy at certain altitudes over tho City City Attorney Noonan replied that such an ordinance could be tried bu~that it might be termed as "regulatory." Lengthy discussion then followed during which time the City Attorney made mention of the various cases and actions which had taken place in other states relative to this matter and the courts' interpretations, stating that, in his opinion, he did not think such a ordinance would be effective. Councilman Mammini then commented on the use of legislation to fine the air!inet, remarking that Cities should express themselves concerning this matter. Further lengthy discussion followed during which time City, Attogney Nconan made mention that the City of South San Francisco had pioneered the fteld of jet-not, se problems, commenting that it had employed the services of Dr. Garbe11 whose report was taken to the federal level in an attempt to obtain some re!ief in this regard. Discussion then followed concerning matters of take-off by aircrafts as well as the tn- conventencQ, disruption and loss of time to residential areas, business and schools by jet aircrafts. Councilman Ahem suggested that the City Attorney communicate with Congressman McCloskey, requesting assistance from him in this regard to which the City Attorney replied that a letter would be dispatched and he would also undertake the preparation of an ordinance for Council's consideration. Mayor Bertucelli at this time expressed his thanks to all of those who had a part in the program which took place on September 28, !968 as "Youth Do Appreciate Day." He at this time read from a clipping which appeared in the San Francisco Examiner and it reads as follows$ "PLBASING SIGHT Yesterday (Sept. 28) I saw groups of children - not protesting - but marching in "Youth Appreciation." Such a sight you never saw - but no TV cameras were around to cover it. Small tots, larger children, teen- agers, all marching in appreciation of their country. South San Francisco is to be commended for this parade, small as it was. The heart and the intent was pride in their country. It was a most delightful event. I hope they have a similar one every year. HELEN L. A resident of the West Park area asked concerning the development of the 2~-acre park site in the Westborough area, as well as the street lights which were to be installed. City Attorney Noonan explained the progress of the 2~acre park site which, at this time, appeared to be a little ahead of schedule, mentioning the refinancing program which the developers were going through; and because of such refinancing program, a bond had been placed to guarantee the work.
