The meeting was called to order by Mayor Bertucelli at 8~04 p.m. The Pledge of Allegiance to the Flag was recited. In the absence of Reverend Donald Wertz of the Good News Chapel, no Invocation was given. Present~ Absent~ Councilmen Frank J. Bertucelli, Patrick E. Ahem, F. Frank Mammini, Andrew Rocca and Warren Steinkamp. None. Councilman Rocca at this time complimented the Enterprise-Journal Press for their accurate reporting of his statement from the previous meeting. Mayor Bertucelli asked if there was a motion approving the Minutes of the regular meeting of April 7, 1969. Councilman Ahern moved, seconded by Councilman Mammini and regularly carried, that the Minutes of the regular meeting of April 7, 1969 be approved as submitted. Mayor Bertucelli then asked if there was a motion approving the regular claims as submitted for payment. Councilman Rocca moved, seconded by Councilman Steinkamp and regularly carried, that the regular claims, totaling $57,640.82, be approved for payment. Mayor Bertucelli asked if there was a motion approving the claims for Parking District No. 1 as submitted for payment. Councilman Mammtni moved, seconded by Councilman Rocca and regularly carried, that the claims as submitted for Parking District No. 1, totaling $1,651.33, be approved for payment. Cabot, Cabot & Forbes Industrial Park, Unit No. 2 Claims~ (a) The Lowrie Paving Co., Inc., claim dated April 1, 1969 in the amount of $461.04 covering work performed through March. (b) Cooper-Clark & Associates claim dated April 3, 1969 covering Invoices Nos. 2117 and 2097, totaling $3,806.89, for Soils Engineering Services. Councilman Rocca moved, seconded by Councilman Maewnini and regularly carried, that the claims as submitted for Cabot, Cabot & Forbes Industrial Park, Unit No. 2 be approved for payment. Councilman Steinkamp moved, seconded by Councilman Mammini and regularly carried, that the claims as submitted for Cabot, Cabot & Forbes Industrial Park, Unit No. 2A be approved for payment. 1969 South Airport Boulward Sanitary Sewer Project Claim~ Testing and Controls, Inc., claim dated April 4, 1969 in the amount of $166.00 for Services performed. Councilman Mammini moved, seconded by Councilman Rocca and regularly carried, that the claim as submitted for 1969 South Airport Boulevard Sanitary Sewer Project be approved for payment. The next item was the Notice of Hearing - Appeal from Use Permit Order UP-112 of the South San Francisco Planning Commission Re~ Private Recreation - Dance Hall-Retail Complex at 1 South Linden Avenue (M-1-H District). Mayor Bertucelli declared the Public Hearing opened, asking if any written protests had been received, to which the City Clerk replied that petitions frc~ neighboring residences objecting to the proposed use had been received as well as petitions from people who supported the proposed use as well as other communications. A lengthy discussion followed during which time Mr. Thomas L. Bocci, Attorney at Law representing the applicants in the matter, spoke in their behalf, requesting Council that they amend the application on its face to restrict the application for the dance permit to that portion of the building that relates to the most southerly one-half PUBLIC HEARING UP-112 DANCE CONPLEX~' (CONTINUED) 5-o which takes it out of the 200 ft. limitation provided for in Ordinance No. 565. He further reviewed the application requesting an indication from the members of the City Council concerning the matter of modifying the application, stating that this could be accomplished by the City Council with no need to have it returned to the Planning Commission. At the request of Mayor Bertucelli, the City Clerk read all of the material which had been received from the Planning Co,~nission and which included department reports in which their recommendations had been submitted. Further lengthy discussion then followed during which time Mr. Bocci spoke in behalf of his clients, commenting that to return it to the Planning Commission would only delay the matter that much more, that his clients wanted a decision this evening and would not request a rehearingl that if such decisions were not received this evening, they would withdraw from the matter. He at length spoke on the matter of the duty of the City to provide areas for teenage activities and the responsibility that the City Council had in this regard. He likewise spoke on the problems which arose among youthful groups, the problems would always exist and that with proper supervision, such problems would not be occurring in the proposal of his clients. Councilman Mammini commented that no member of the City Council wished to deny recreational activities to the youth of the community, pointing out the areas which were already being used for such activities and the future use of buildings to in- crease the recreational activity. Mrs. Mary Ortner, 32 Escanyo Drive, stated that it was the Council's obligation to provide activities for the use of the City and not be concerned with providing activities for areas outside of the community itself. Councilman Rocca stated that the Council was aware that something should be done for the young people of the City and was desirous of fulfilling this need but that the application before the City Council at this time was one of a commercial venture by Mr. Bocci's clients and not necessarily one to benefit the youth of the community sole6/. Mayor Bertucelli reiterated the previous statements made by the members of the City Council, stating that many members of the City's staff were presently working in youth activities, citing the Boys' Club, Police Athletic Association, the new swim- ming pool which was being built and the future expansion of a program in the Magnolia Recreation Center. He cited the problems which Council recently had before them con- cerning the congregation of youths from outside areas at the Brentwood Bowl, com- menting on a discussion which he had with Mrs. Spingola with regard to the area'as~not being suited for the type of activity which she wished to conduct because of the lack of parking facilities and the fact that the building was not constructed for this type of activity and did not conform to the requirements of the City's departments. Donald Edwards, 138 Cherry Avenue, spoke on the need for activities for teenagers since most of the teen affairs were for those 13 years of age or under. He further remarked that ~ was the desire of the teenagers in the community to go to an area where they could hear big-name bands. Mrs. Eileen Spingola, 138 Cherry Avenue, spoke in her own behalf, setting forth her desires to assist the youth of the community as well as those outside the community in order that some activity could be provided where none existed. Mrs. Hanntgan, resident of the City, stated that she would support Mrs. Spingola's request if she were assured that the conduct of the operations would be properly operated and meet the requirements of the City's specifications. Mayor Bertucelli stated that no one opposed Mrs. Spingola's desire but that it was necessary to follow the requirements of the City's ordinances and codes, and the recom- mendations as outlined by the departments. City Planner Daniel Pass then spoke, outlining to Council the discussion which had been held at the time it was before the Planning Commission, illustrating the required number of parking spaces which were needed for the proposed number of people who,would be in attendance, that the number of parking spaces which would be provided was far below that which was required, that the South City Village, a residential area of single family homes adjacent to the problem, could not put up with the noise factor, traffic congestion and parking problems which would be created as a result of this type of operation. He concluded by stating that he had checked with other cities in the Peninsula and that such ventures, after they had been commenced, were required to cease their operations because of the problems outlined. He further explained similar activities being conducted in San Francisco and that a City of this size was better able to accommodate such a venture. John O'Hara, 110 Arroyo Drive, stated that it was his feeling that something should be done for the young people of the co~unity. Mrs. Antoinette Fraschieri, 478 Avalon Drive, remarked that she felt it was unfair to the members of the City Council and department heads to be subjected to attack because they recommended in accordance with the City's laws and ordinances, stating that she likewise felt that something should be done for the youths of the community. Miss Gayle Picci, 120 Sherwood Way, who introduced herself as Vice President of St. Veronica's Teen Club, supported the application of Mrs. Spingola, stating that it was not'the desire of teenagers to rebel but to have a Place where they could go and enjoy the activities they like and to hear name bands performing for them. Rex Star, resident of Pacifica, next spoke, stating that the area of Magnolia Center was not adequate for such an operation as was being proposed by the applicants, stating that in attending those places in San Francisco where such activities were conducted, they were willing to walk great distances from where they were required to park in order to attend. LANDS - ELM COURT TO PALM AVENUE Mayor Bertucellt stated that possibly a request such as what Council had before them this evening should be made of the County Board of Supervisors and make it on a County level so that a greater number could be accomodated. Councilman Ahem asked if an attempt was made to obtain one of the Fiesta buildings. at the County Fair Grounds to which a reply was that an attempt had been made and that they were turned down. ~r. Marcel Campredon, a member of the Planning Con~nission, cor~mented on the statement of Thomas Bocci in which he requested to move the activity 200 ft. from the nearest residential area and if this were granted, it would leave about 10 ft. of space for dance activities. The Police Chief stated that this was correct; that there would be only about 8 ft. of room left for dancing. At this point, Mr. Henry Parvin, one of the applicants, stated that he would relieve the Council of any decision by withdrawing their application at this time. Mr. Bocci at this time moved to withdraw the application in behalf of his clients, extending his apologies to Councilman Mammini and other members of the City Council if any statement which he made to be offensive since it was not so intended and may have been made in the heat of argument in behalf of his clients. Mayor Bertucelli declared the Public Hearing closed after which Councilman Rocca moved, seconded by Councilman Steinkamp and regularly carried, that the withdrawal of this application hy the applicants he accepted. Mayor Bertucelli declared a recess at 10505 p.m. Mayor Bertucelli recalled the meeting to order at 1051§ p.m. The next matter was the Public Hearing on the adoption of the General Plan. Mayor Bertucelli declared the Public Hearing opened, asking if any written protests had been received to which the City Clerk replied that none had been received by his office. Mayor Bertucelli then asked if anyone present in the audience wished to speak on the matter. There being none, Mayor Bertucelli declared the Public Hearing closed. The next item was the Proclamation designating the week of May 11 - 17, 1969 as NATIONAL POLICE WB~K. Mayor Bertucelli so proclaimed. City Attorney Noonan explained the first resolution which was the subject of this evening's Public Hearing, after which Councilman Steinkamp introduced the resolution entitled5 "A RESOLUTION ADOPTING THE AMENDMENT TO THE CITY'S GENERAL PLAN OF 1963." Roll call vote was as followss Ayes, Councilmen Frank J. Bertucelli, Patrick E. Ahem, F. Frank Mmmnini, Andrew Rocca and Warren Steinkamp. Noes, none. Absent, none. The next item was the Inter-Office Memorandum dated April 10, 1969 from the City Attorney advising of the Attorney General's letter concerning Asphaltic Petroleum Products Case. City Attorney Noonan stated that this resolution has the approval of the City Manager and authorizes the Attorney General's office to represent the City in the asphalt anti- trust suits after which Councilman Rocca introduced the resolution entitleds "A RESO- LUTION AUTHORIZING THE ATTORNEY GENERAL'S OFFICE OF CALIFORNIA TO CONDUCT LEGAL PRO- CEEDINGS - ASPHALT ANTI TRUST SUITS." The Inter-Office Memorandum dated April 10, 1969 from the Director of Public Works concerning the compilation of bids for Galway Drive Improvement was the next matter for Council's attention. Director of Public Works Louis Goss declared the bids received, stating that the low bidder was The Lowrie Paving Company, Inc. City Attorney Noonan explained the resolution which had been prepared after which Councilman Rocca introduced the resolution entitled~ "A RESOLUTION OF AWARD OF CONTRACT GALWAY DRIVE IMPROV~J~.NT." The next matter was the Inter-Office Memorandum from the Landscape Specialist dated April 14, 1969 submitting compilation of bids and recommendation for the Landscape Development of San Francisco Water Department lands - Elm Court to Palm Avenue. City Manager Thomas McKenzie declared the bids received, and after an explanation of the types of planting, stated that the low bidder was Rudolph Watson, Inc. City Attorney Noonan explained the resolution after which Councilman Ahern introduced the resolution entttled~ "A RESOLUTION OF AWARD OF CONTRACT - LANDSCAPE DEVELOPMENT - SAN FRANCISCO WATER DEPARTMENT LANDS - ~ COURT TO PALM AVENUE." City Attorney Noonan explained that the next resolution would authorize cancellation of taxes for properties acquired for public use (lO-acre park site in Westborough). Councilman Ahem introduced the resolution entitled~ "A RESOLUTION AUTHORIZING CAN- CELLATION OF TAXES ON PROPERTY ACQUIRED FOR PUBLIC USE AND THE CITY ATTORNEY'S CONSENT THERETO AND REQUESTING THE BOARD OF SUPERVISORS TO AUTHORIZE CANCELLATION OF COUNTY TAXES AND THE DISTRICT ATTORNEY'S CONSENT THERETO." Roll call vote was as follows~ Ayes, Councilmen Frank J. Bertucelli, Patrick E. Ahem, F. Frank Mammini, Andrew Rocca and Warren Steinkamp. Noes, none. Absent, none. These were to be submitted to the City for consideration and, therefore, permission was requested to continue these resolutions. There being no objections, Mayor Bertucelli so ordered. City Attorney Noonan explained that the next resolution accepts the parcel of property from Joseph Ragni & Sons, Inc., for the future fire station site and authorizes the City Clerk to record said Grant Deed. Councilman Steinkamp introduced the resolution entitled: "A RESOLUTION ACCEPTING A GRANT DEED FROM JOSEPH RAGNI & SONS, INC." Roll call vote was as follows: Ayes, Councilmen Frank J. Bertucelli, Patrick E. Ahern, F. Frank Mammini, Andrew Rocca and Warren Steinkamp. Noes, none. Absent, none. Mayor Bertucelli ordered the title of the ordinance read. The title of the ordinance was read. City Attorney Noonan then explained the ordinance and advised the Council regarding pro- cedure for adoption and passage. Councilman Steinkamp moved reading of the ordinance in its entirety be waived and that the ordinance be passed and adopted by reading title only, seconded by Councilman Ahem and passed by unanimous vote. Councilman Rocca moved that the ordinance entitled~ "AN ORDINANCE OF THE CITY OF SOUTH SAN FRANCISO0 AMENDING ORDINANCE NO. 449, AS AMENDED, ENTITLED 'AN ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO RECREATING AND RE-ESTABLISHING A PERSONNEL SYSTEM FOR THE CITY OF SOUTH SAN FRANCISCO AND REPEALING ORDINANCE NO. 216 AND ALL INCONSISTENT ORDINANCES,'" the entire reading of which has been duly waived, be introduced and seconded by Councilman Mammini and passed by the following roll call vote. Mayor Bertucelli ordered the title of the ordinance read. The title of the ordinance was read. City Attorney Noonan then explained the ordinance and advised the Council regarding procedure for adoption and passage. The next item was the communication dated April 3, 1969 from the Santo Christo Society requesting permission to hold its annual Fiesta on May 10, 11, 1969 and the placement of flags on Grand Avenue. Councilman Mammini moved, seconded by Councilman Ahem and regularly carried, that the request as submitted he approved. CITY PLANNER'S REPORT: LETTER OF APPEAL FROM P.C.'S DENIAL OF UP-114, PIOMBO PERMIT: STUDY SESSION TAPING RECOMMENDATION: RODENT CONTROL PROGRAM: REQUEST OF SAN MATEO COUNTY ECONOMIC OPPOR- TUNITY COMMISSION~ MONTHLY REPORTS DEPARTMENT OF ALCOHOLIC BEVERAGE CONTROL: The City Planner's Report to the City Council with respect to Use Permit and Variance Requests considered on April 14, 1969 was the next matter for Council's consideration. ' n There being no ob3ectto s, Mayor Bertucelli ordered the Report accepted and placed one file. The next item was the communication dated April 18, 1969 from Mr. William Botieff to the City Council appealing the Planning Commtssian's denial of Use Permit No. 114. There being no objections, Mayor Bertucellt set the Public Hearing on the denial of Use P~mit No. 114 by the Planning Commission for Monday, May 19, 1969. The next item was the communication dated April 17, 1969 from the Piombo Construction Company as addressed to the City Council requesting that a second amendment be made to allow the permtttee to modify the haul routes by including a portion of Westborough Boulevard between Gellert and Junipero Serra Freeway and a portion of Gellert Boulevard from the intersection with Westborough southerly for 60 ft. Permittee agreed that the addition of said portions of streets would also come within the imsurance bond, fee provisions and all other provisions of the existing permit. Councilman Rocca moved, seconded by Councilman Mammini and regularly carried, that the grading permit issued to Piombo Construction Company, dated December 18, 1967, which has been amended, be further amended by 1. Adding the following streets to the haul routes described in Section 2D(2) (a): (1) That portion of Westborough Boulevard between Gellert Boulevard and Junipero Serra Freeway, and (2) That portion of Gellert Boulevard between the intersection of Westborough Boulevard to a point on Gellert Boulevard southerly for a distance of 60 ft. 2. That all of the provisions of the grading permit, including the corporate surety bond provisions, insurance provisions and fee provisions shall apply. 3. That a copy of this Minute Order be attached to the original permit in Central Records. The next matter was the communication dated April 17, 1969 from City Manager Thomas P. McKenzie to the City Council concerning the taping of City Council'Study Sessions. There being no objections, Mayor Bertucelli ordered the communication accepted and placed on file. The Inter-Office Memorandum dated April 9,.1969 from Assistant City Manager Laurence Ross advising of the existing Rodent Control Program and requesting authorization to continue this program for 1969-70 was the next matter for Council's attention. Councilman Mammini moved, seconded by Councilman Steinkamp and regularly carried, that the City Manager be authorized to award the contract to the lowest responsible bidder and execute same for Rodent Control 1969-70. The next item was the Inter-Office Memorandum dated April 9, 1969 from Assistant City Manager Laurence L. Ross requesting formal authorization concerning the City's contri- bution of monies to the San Mateo County Economic Opportunity Commission. City Manager Thomas McKenzie explained that Council had given tentative approval of the inclusion of $5,000 in the next year's budget to support this program and was requesting formal acknowledgment so that a letter of Intent may be forwarded to the San Mateo County Economic Opportunity Commission stating South San Francisco's contribution of $5,000 if San Mateo County allocates $20,000 to the South San Francisco Information Center Program, such donation to be made during 1969-70 fiscal year. Councilman Ahern moved, seconded by Councilman Rocca and regularly carried, that the recommendation of the City Manager be approved and accepted and authorization to forward a letter of Intent to the San Mateo County Economic Opportunity Commission be granted. Monthly Reports were received from the following, Fire Department - March 1969 Building Inspection Department - March 1969 Library - March 1969 San Mateo County - Sanitation Section - March 1969 There being no objections, Mayor Bertucelli ordered the Reports accepted and placed on file. Department of Alcoholic Beveraqe Control: (a) Application for Off Sale General as filed by Buran, Paul & Marion F.; Miscalco, Lawrence J. & Jo Anne S.; Rodriguez, Fred A. & Carmen at 142 Hazelwood Drive (b) Application as filed by The House of Seagram, Inc., for Beer & Wine Importers General at 164 Marco Way. There being no objections, Mayor Bertucelli ordered the Reports placed on file. GOOD AND WELFARE~ STATEMENT CONCERNING RECRE- ATIONAL PROGRAM FOR OLDER TEENAGERS~ PROCLAMATION BEAUTIFICATION MONTH MAY, 1969~ INFORMATION REC~JEST CONCERNING WESTBOROUGH PARKs COMMENTS CONCERNING YOUTH PROGRAM & COLMA CREEK FLOOD CONTROL MEETING; PERSONNEL SESSION REQUEST OF CITY ~ANAGF~ ADJOUP~M~r; There being nothing further, Mayor Bertucelli asked if any member of the City Council had anything they wished to offer under Good and Welfare. Councilman Mammini briefly commented that it was true that present recreational programs were for those around the age of 14 years and something should be done for the older youth of the community, that he did not mind undertaking the task to accomplish this end and requested Council's support in this regard. Councilman Ahern requested that the Mayor proclaim the month of May as "Beautification Month," stating that through the office of the City Manager, the City could work out with the local scavenger service for pick-ups, more than once a month in orderr that residents could join in this program. Mayor Bertucelli so proclaimed, instructing the City Manager to arrange for the extra garden refuse pick-up. Councilman Steinkamp stated that he supported the cause of the teenagers and offered whatever time and effort he could to this program. There being nothing further, Mayor Bertucelli asked if anyone present in the audience had anything they wished to offer. ~Lr. Bruce Rosengren, 2084 ~hallow Way, President of the West Park Homeowners Association, requested a report concerning the development of the park in Westborough which was given by the Director of Public Works. Mr. Dom ld Grimes, 123 Francisco Drive, expressed his commendations to Councilmen Mammini and Steinkamp concerning their offer to~.work on the youth program, stating that the City should first look after its own youth. He then briefly commented on the hearing which was to be held this coming Friday at 2sO0 p.m. with regard to Colma Creek Flood Control, asking as to why better publicity had not been given to the matter by the County of San Mateo. Brief discussion followed at which time Mayor Bertucelli requested everyone be present that could attend. City Manager McKenzie brought to Council's attention the matter of meetings scheduled for the next few weeks after which he requested a brief personnel session with the City Council on the adjournment of the regular meeting. There being no objections, Mayor Bertucelli adjourned the meeting at 10~45 p.m. to a personnel session.
