Council present: Teglia, Damonte, Nicolopulos, Addiego and Acosta. Council absent: None. Recited. Mayor Acosta discussed a letter received from Supervisor Speier stating that the Board of Supervisors was in opposition to the action taken by the Secretary of Interior to reopen the Proposed Notice of Lease Sale to include the deleted basins. He continued stating that this dealt with off-shore site drilling for oil and natural gas and opened the matter for Council discussion. Councilman Addiego proposed that the suggested Resolution be amended in the following manner before adoption: That the 4th, 5th, 6th paragraphs be deleted and that the paragraph following "NOW THEREFORE BE IT RESOLVED, that this Board urges President Reagan and Secretary of Interior Watt to:" be amended to read "Postpone the lease of the basins within the Lease Sale #53 until crucial envir- onmental studies are completed; delete tracts in all basins crucial to safe port access, local econ- omies, commercial .... " A discussion followed on the pro- tection of the natural resources, environment, wildlife and putting all basins on an equal footing whether it is the East Coast or the Gulf Coast, etc. 4/8/81 Page 1 AGENDA ACTION TAKEN 106 1. Damonte Roberta Cerri Teglia MINUTES CITY COUNCIL City Council Conference Room April 8, 1981 NOTICE IS HEREBY GIVEN, pursuant to Government Code 54956 of the State of California, that the South San Francisco City Council and the South San Francisco Planning Commission will hold a Joint Special Meeting on Wednesday, April 8, 1981, at 7:00 p.m., in the City Council Conference Room, City Hall, 400 Grand Avenue, South San Francisco, California. The purpose of the meeting is a Study Session to discuss the following: 1. Fast food restaurants, 7-11 Markets and Fotomats. 2. Traffic related problems along Westborough Boulevard. 3. New residential condominium growth. 4. Residential building densities. 5. Future residential development east of the Bayshore Freeway. 6. Manufactured housing (SB 1960). 7. Downtown (Grand Avenue) Business District. 8. Charging of fees in reference to appeals of Planning Commission decisions to City Council. Fast food restaurants, 7-11 Markets and Fotomats. Commissioner Getz arrived: Chairman Grimes arrived: ACTION TAKEN Council present: Council absent: Teglia, Damonte,- Nicolopulos, Addiego and Acosta. None. Planning Commissioners present: Martin, Bertucelli, Hoyer, Mantegani, Terry. Planning Commissioners absent: Grimes, Getz. Recited. Mayor Acosta requested that the members wishing to speak go through their respective chair for recognition before speaking. Vice Chairman Martin spoke of the many applications that had gone before the Planning Commission for fast food restaurants, 7-11 Markets and Fotomats. He spoke of the problems related to safety in and around the permits, i.e., traffic, pedestrian, lack of supervision once the permit is given, litter, etc. He asked for some guidelines from the Council on on fast food restaurants and how many would be placed in an area or no restrictions of how many and the resultant police problems with traffic, etc. Commissioner Getz arrived at 7:15 p.m. Commissioner Bertucelli stated that on Airport Boulevard there were traffic problems that the Police Department had to deal with if fast food res- taurants were allowed a permit for the McDonald site and he felt it was an engineering problem not a Planning problem. Chairman Grimes arrived at 7:30 p.m. Commissioner Mantegani cited 4/8/81 Page 2 AGENDA ACTION TAKEN 109 1. Fast food restaurants - Cont. (TF-92) an example wherein the Planning Commission had denied a McDonald's application in Westborough and the Council after hearing the appeal had approved the application. He said the Commission had just voted approval for a Ben Frank's and there had been discussion on the decision at the last Council meeting. He felt that if guidelines were established then the Planning Commission would know the direction Council intended be taken in the future on fast food restaurants, 7-11 Stores, Fotomats and whether the permit applications were to be limited or expanded. Commissioner Getz defended the fast food restaurants and stated that they served the needs of the community providing that they do not tie up traffic and create a bottleneck. Commissioner Hoyer spoke of the drive through restaurant on Airport Blvd., as proposed by McDonald's and stated the Commission felt it was out of character with the surrounding area. He said in Japan there was a McDonald's by the Airport, that was attractively designed and constructed and was concerned that McDonald's plan for South San Francisco was of the cheapest design and construction. Mayor Acosta said it was up to the Commission to decide whether a business that applied for a Use Permit met the design and con- struction criteria. He stated that if there was an appeal of a Planning Commission decision, then only would the matter be heard by Council and be judged on its own merits. 4/8/81 Page 3 AGENDA ACTION TAKEN Fast food restaurants - Cont. (TF-135) (~TF-224) (TF-266) Councilwoman Teglia suggested that a Subcommittee be established by the Planning Commission to deal with new and on-going problems, i.e., pedestrian and vehicular traffic that created Police pro- blems. She suggested revocation of Use Permits to handle businesses with a lack of supervision that caused Police problems. Discussion followed on the problems the Fotomat businesses were having, revocation of violators' Use Permits, which body had the authority and responsibility to revoke permits, the steps taken in a revocation procedure, etc. Commissioner Bertucelli stated that he never spoke on a one-to-one basis to any applicants and asked if that policy had changed in that the Mayor had spoken to an appli- cant. Mayor Acosta said that speaking to citizens was an inherent right of an appointed or elected officials job. Commissioner Getz stated that anyone has the right to approach an elected official and the con- stitutional right to have a fair hearing presented before the public. He further stated that a decision should not be made in a back room with a proponent who is on an upcoming agenda. A decision must be made in public after hearing the merits of the case. He stated that a Councilman or Commissioner could speak to a citizen on any subject but the agenda item. If the Councilman or Commissioner did speak to a proponent on a hearing matter and disclosed that he had to his constituents he would be unable to vote on the matter. 4/8/81 Page 4 AGENDA ACTION TAKEN 111 e e Streamlining of the permit process. (TF-396) A discussion followed on the Brown Act, lobbying, Council's legislative responsibility on behalf of the entire City, different interpretations of the Brown Act, streamlining of the permit process. Vice Chairman Martin spoke of three stranded, people along the golf course and E1 Camino and expressed concern over the lack of street lights and/or reflectors in the area. He suggested putting a public telephone and lights in that area. He said that with higher density through growth in the Westborough area towards Gellert it would create more pro- blems of egress and ingress from Junipero Serra. Commissioner Bertucelli said that Burlingame had had similar pro- blems on Trousdale from the flow of traffic from Highway 280 and after someone was injured the City put stop signs along Trousdale to check speeding autos. A discussion followed on reducing the speek limits, radar enforce- ment, reducing the divider strips, the proposed 380 extension, etc. Councilwoman Teglia suggested giving Director of Public Services Yee direction to draw up a list of priorities coupled with technical analysis of the traffic problems. Director of Community Devel~opment Dell'Angela stated that these two items were related in terms of density and asked how the Council and Planning Commission viewed growth in these two areas. He stated this would be helpful knowledge in the development of the General Plan. 4/8/81 Page 5 AGENDA ACTION TAKEN 112 e Be New residential condominium growth - Cont. Residential building densities - Cont. (TF-466) Future residential development east of the Bayshore Freeway. (TF-520) Commissioner Mantegani stated that the designs for condos that had been approved by the Commission looked good on paper, but did not live up to the design after being built. He stated he now believed that 40 units to the acre was too high after viewing some of the developments after completion. A discussion followed on lowering the density per acre, the condos being over built on density, re- flecting land prices to density, the General Plan and the Zoning Ordinance being rewritten. Director of Community Development Dell'Angela said his understanding was that Staff did not want to see residential development east of the Bayshore Freeway and asked if Council concurred with the policy. He stated that a developer wanted to build industrial condos in that area and asked if Council desired the area to be a planned residential waterfront area only like Foster City. He said it was important that Staff and the Commission had direction on whether the area was to stay a commercial/industrial use area or to encourage residential development. A discussion followed on the development of Sierra Point which the City of Brisbane had not wanted it to be residential and the developer had made it re- sidential on the South San Francisco side making it this City's re- sponsibility. Further discussion ensued on a soil evaluation if the area was to be residential, the possible residential develop- ment of the American Bridge pro- perty in the event of future sale of the property. 4/8/81 Page 6 AGENDA ACTION TAKEN 112 Future residential development east of the Bayshore Freeway - Cont. (TF-570) Manufactured housing (SB 1960). (TF-730) (TF-742) Mr. Diodati, owner of the Healy Tibbets property, said he had talked to the Planning Commission and Staff before purchasing the property and had the understanding that the property was zoned commercial. He related that in the past month he had been told that the property was to be rezoned as a residential use only. He stated that he was an industrial developer and would not have bought the property if he had known he could not develop it commercially. He stated that 10 acres were under water, 20 acres were on buildable non-filled land and the remaining 4 acres of his land had soil problems. He stated he paid two million dollars for the land. A discussion followed on a planned residential growth on filled land, unstable soil, Police problems if Mr. Diodati built warehouses, and chasing away developers by putting too many restrictions on development. Mr. Diodati said he planned to put a marina in and pointed to the map and indicated the solid land, the acres of land with up to forty feet of mud, where he intended putting four industrial buildings, etc. Director of Community Development Dell'Angela discussed an analysis by the Department of Housing and Community Development on SB 1960 which provides for mobile homes in single family residential zones which will take effect on July 1, 1981. He stated that the new law would impose certain require- ments to accept manufactured housing in the future. Mayor Acosta made reference to a presentation made at a Council of Mayor's meeting on manufactured housing and the word mobile homes 4/8/81 Page 7 AGENDA ACTI ON TAKEN 114 e e Manufactured housing (SB 1960) - Cont. (TF-830) Downtown (Grand Avenue) Business District. (TF-853) is no longer acceptable - it is a manufactured home. He stated that the mobile homes were no longer licensed for highways, and are taxable property as long as the homes are put on permanent foundations. He said he was not agreeable to a mobile home park but would be interested in a subdivision of manufactured homes placed on individual lots that the people own in a planned community. Director of Community Development Dell'Angela said that the mobile home parks fulfill a housing need for many people and asked: 1) Whether Council was concerned that after July 1, 1981 people would be buying vacant lots to erect manufactured homes in single family areas; and 2) Should Staff.~be looking at legalizing mobile home parks and setting aside areas for this use. A discussion followed on how many existing mobile home parks were in the City, confining them to specific areas, the presentation on manufactured homes being presented to all of Council and the Planning Commission, etc. Consensus of Council that there would not be any new mobile home parks allowed and the existing ones should be upgraded. Director of Community Development Dell'Angela said that Staff felt that some program should be started to upgrade the buildings on Grand Avenue. Discussion followed on the new County Rehabilitation Loan Program, possibility of mixed uses, the master parking plan, the Parking District's policies on parking spaces for new construction, etc. 4/8/81 Page 8 AGENDA ACTION TAKEN 1115 e 10. Downtown (Grand Avenue) Business District - Cont. Charging of fees in reference to appeals of Planning Commission decisions to City Council. (TF-957) Items of Mutu~al Concern. (TF-1088) Parking Place Commissioner Rosaia spoke of the critical parking problems in the Parking District with new construction not pro- Viding additional parking spaces. Director of Community Development Dell'Angela asked if the two legislative bodies felt it was reasonable to charge a $50.00 appeal fee to cover administrative costs or did they feel that an appeal is a right to which everyone is entitled. A discussion followed on whether it was legal to charge a fee, in- creasing the processing fee to cover the administrative costs, setting up a subcommittee to in- vestigate the permit fee structure, etc. Vice Mayor Nicolopulos stated that a fee should not be charged for an appeal, that the appeal process was every citizen's right and the Council was the individual's last resort. Discussion followed on the appeal process, Council sending the appeal back to the Planning Commission when it was felt the information was insufficient. ~ Director of Community Development Dell'Angela said that some cities have delegated final decision making to administrative staff on minor variance issues such as side yard set backs. He Saidlalso that some cities give the Planning Commission the final say on Use Permits and instead of an appeal going to the Council it would go to the courts. Vice Chairman Martin said he felt it would be advantageous for the Planning Commission to have a consent calendar to expedite routine matters. 4/8/81 Page 9 AGENDA ACTION TAKEN 10. Items of Mutual Concern - Cont. (TF-!135) ADJOURNMENT: RESPECTFULLY SUBMITTED, Councilwoman Teglia said she had no problem with the consent calendar, however she did have a problem with delegation of authority to the administrative staff and with the appeal process bypassing Council. Chairman Grimes expressed concern over the permit process for attached garages versus detached garages and new garages being built without a Use Permit or a hearing. A discussion followed on a speedy permit process for the home owner, the variance procedures, room additions conforming to the style of the home, revocation of permits when there are violations, illegal postings on buildings.
