Litigation - Molieri vs. City of South San Francisco

Re-convened into Open Session 9:55 p.m. All Councilmembers present.
City Attorney Mattas announced that Council, by a vote of 5-0, has
approved a settlement agreement with Danilo Molieri. The settlement
approved by the City Council includes Mr. Molieri's retirement from police
work and permanent employment with the City of South San Francisco. It
also resolves all outstanding claims by Mr. Molieri against the City
including his disability retirement and workers compensation claims.
Under the terms of the settlement, Mr. Molieri will receive $1.3 million,
rather than the $1.9 million amount awarded by the jury. The City will not
oppose Mr. Molieri's request for a disability retirement based on injuries he
has claimed to receive during an altercation with a suspect in April, 1997.
The parties also agreed, subject to Court approval, to reverse the judgement
and to dissolve an injunction issued against the Police Department. Neither
party admitted fault in the settlement. The City Council also voted 5-0 to
designate the Mayor and the City Attorney as the individuals to respond to
any inquires about the settlement. City Council, also as part of their initial
5-0 vote, authorized the City Attorney to execute the settlement agreement
and authorized the City Manager to execute the resolution related to the
PERS disability determination.
