HomeMy WebLinkAboutReso 32-2016 RESOLUTION NO. 32-2016 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION APPROVING USE OF PACIFIC GAS & ELECTRIC RULE 20A WORK CREDITS AND AUTHORIZING THE CITY MANAGER TO EXECUTE AGREEMENTS TO COMPLETE THE SPRUCE AVENUE UNDERGROUND UTILITY DISTRICT PROJECT. WHEREAS, the California Public Utilities Commission ("CPUC") has authorized electric and telecommunication utilities to convert overhead utility lines and facilities to underground pursuant to Electric Rule 20 and Telecommunication Rule 32, and WHEREAS, the City of South San Francisco desires to complete a project that will convert to underground the overhead utilities along Spruce Avenue from Railroad Avenue to the north edge of Spruce Elementary School between Lux Avenue and Park Way; and WHEREAS, in accordance with the requirements of Electric Rule 20 and Telecommunication Rule 32 for establishing qualified underground utility districts, the City Council adopted an ordinance on February 10, 2016 establishing the Spruce Avenue Underground Utility District ("District") with boundaries defined in the ordinance and as described above; and. WHEREAS, Pacific Gas & Electric ("PG&E") has notified the City of South San Francisco that it has accumulated work credits in the amount of $6,173,446 and may borrow future work credits in the amount of$1,018,680, yielding a total of$7,192,126 work credits that the City may direct PG&E to use for qualified underground utility conversion projects pursuant to CPUC Electric Rule 20A, and WHEREAS, to the extent allowed by Rule 20A and the CPUC, the City desires to have PG&E use its Rule 20A work credits to complete work within the District, consisting of placing its distribution lines and property services laterals underground, and converting the property electric service panels to accept underground feeds ("Spruce Avenue Underground Utility District Project"); and WHEREAS, the conceptual cost estimate for PG&E to complete the undergrounding work within the District is $2.8 million, an amount subject to revision as PG&E further defines the work through the design phase; and WHEREAS, the other overhead communications and cable utilities will fund their shares of the project through their own internal programs; and WHEREAS, the City will fund the cost of replacing streetlights mounted on utility poles within the District in an amount conceptually estimated at $182,000; and WHEREAS, having established the District, the City now needs to enter into standard agreements with PG&E and complete other required forms and documentation, including, but not limited to, the "Agreement to Perform Tariff Scheduled Related Work, Rule 20A - General Conditions," the "Agreement to Perform Tariff Schedule Related Work, Rule 20A - Electric Panel Service Conversion," the "Letter of Streetlight Agreement," and the "Rule 20A Wheelchair Access Consideration." NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of South San Francisco that it hereby takes the following actions: 1. Approves the use of the City's Rule 20A work credits for work in the Spruce Avenue Underground Utility District; and 2. Directs PG&E to use the City's Rule 20A work credits to place its distribution lines and the property services laterals underground, and to convert the property electric service panels to accept underground feeds; and 3. Authorizes the City Manager to complete, execute, and transmit on behalf of the City all agreements, acknowledgements, and forms necessarily to complete the Spruce Avenue Utility Underground District project, subject to approval as to form by the City Attorney; and 4. Authorizes the City Manager to take any other related actions consistent with the intent of this Resolution. * I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 9th day of March, 2016 by the following vote: AYES: Councilmembers Karyl Matsumoto, Richard A.
