Box 711 (City Hall, 400 Grand Avenue) South San Francisco, CA IRW Resolution: RES 53 -2016 File Number: 16 -384 Enactment Number: RES 53 -2016 RESOLUTION IN SUPPORT OF AB2502: LOCAL INCLUSIONARY HOUSING POLICIES. WHEREAS, pursuant to Article XI, Section 7 of the California Constitution, many California cities and counties have implemented inclusionary housing ordinances as a land use regulation under their police power; and WHEREAS, inclusionary housing ordinances require that developers allocate a certain percentage of housing units in a new development to be affordable to low- and moderate - income households; and WHEREAS, in In 2009, a state appellate court ruling in the Palmer v. City of Los Angeles case indicated that the state's Costa - Hawkins Rental Housing Act (Costa - Hawkins) prohibits local governments from creating affordable rental housing through local inclusionary programs; and WHEREAS, AB 2502: Local Inclusionary Housing Policies restores the authority of local governments to enact inclusionary housing policies; and WHEREAS, AB 2502 clarifies state law and allows jurisdictions to choose the affordable housing policies that fit the development context of their community; and WHEREAS, AB 2502 does not require inclusionary policies or alter rent control; it simply allows the policies that have been effective at creating affordable housing for the last 40 years to continue at the local level without fear of litigation; and WHEREAS, the City of South San Francisco desires to support AB 2502. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that the City Council hereby supports AB 2502: Local Inclusionary Housing Policies. At a meeting of the City Council on 5/11/2016, a motion was made by Richard Garbarino, seconded by Pradeep Gupta, that this Resolution be approved. The motion passed.
