HomeMy WebLinkAboutSuccessor Reso 04-2016File Number: 16-654 . 04-201f •� I . • WHEREAS, on June 29, 2011, the Legislature of the State of California ( "State ") adopted Assembly Bill xl 26 ( "AB 26 "), which amended provisions of the State's Community Redevelopment Law (Health and Safety Code sections 33000 et seq.); and WHEREAS, pursuant to AB 26 and the California Supreme Court decision in California Redevelopment Association, et al. v. Ana Matosantos, et al., which upheld AB 26 (together with AB 1484, the "Dissolution Law "), the former Redevelopment Agency of the City of South San Francisco was dissolved on February 1, 2012; and WHEREAS, the City of South San Francisco became the Successor Agency to the Redevelopment Agency of the City of South San Francisco ( "Successor Agency "); and WHEREAS, pursuant to the Dissolution Law and the Long Range Property Management Plan (LRPMP), certain real property located in the City of South San Francisco was transferred to the Successor Agency ( "Agency Properties "); and WHEREAS, pursuant to Health and Safety Code Section 34191.5(c)(2)(C), property shall not be transferred to a successor agency, city, county or city and county, unless a LRPMP has been approved by the Oversight Board for the Successor Agency to the Redevelopment Agency of the City of South San Francisco ( "Oversight Board ") and the California Department of Finance ( "DOF "); and WHEREAS, pursuant to the Dissolution Law, the Successor Agency prepared an LRPMP, which was approved by a resolution of the Oversight Board on May 21, 2015, and was approved by the DOF on October 1, 2015; and WHEREAS, the LRPMP establishes a plan for transferring or selling the Agency Properties that were owned by the former Redevelopment Agency; and WHEREAS, the LRPMP identifies seven (7) parcels to be transferred from the Successor Agency to the City for governmental uses pursuant to Health and Safety Code section 34191.5(c); and Page 1 WHEREAS, the LRPMP also identifies two (2) parcels to be conditionally transferred from the Successor Agency to the County of San Mateo for governmental uses pursuant to Health and Safety Code section 34191.5(c); and WHEREAS, the LRPMP also identifies a portion of one (1) parcel to be transferred from the Successor Agency to the City as part of an approved redevelopment project plan, specifically the El I/Chestnut Avenue Area Plan in order to construct a public library; and "T i 17uic Mtj as p7rtivi an U1,177, VIC W as an appropriate location for a public library, but is otherwise significantly constrained in its sale or development potential by its environmental conditions; and WHEREAS, the implementation of the Amended Long Range Property Management Plan through this Resolution itself does not commit the Successor Agency to any action that may have a significant effect on the environment and thus does not constitute a "project" subject to the requirements of the California Environmental Quality Act ("CEQA"), pursuant to CEQA Guidelines section 1506 1 (b)(3). NOW, THEREFORE, ► IT RESOLVED that the Successor Agency to the City of South San Francisco Redevelopment Agency hereby resolve as follows: 1. Finds and determines that the above recitals are true and correct and the proposed actions are consistent with the LRPMR 2. Subject to approval by the Oversight Board, the conveyance by the Successor Agency to the City of South San Francisco of the Agency Properties identified in the LRPMP as properties #4, #5, and #8 through #12, and as also described in Exhibit A, is hereby approved. The transfer of these properties is conditioned on the requirement in the LRPMP that they remain in public use. 3. Subject to approval by the Oversight Board, the conveyance by the Successor Agency to the City of the library site portion of the former PUC property parcel A2, also identified as parcel A2b of property 06 in the LRPMP (APN 0 11-326-030), and as more specifically described in Exhibit B, for development consistent with an approved redevelopment plan, at no cost to the City, is hereby approved. 4. Subject to approval by the Oversight Board, the conveyance by the Successor Agency to the County of San Mateo ("County") • the Agency Properties identified in the LRPMP as properties #13 and #14, and as described in Exhibit A, is hereby approved. The transfer of the properties to the File Number: 96 -654 Enactment Number: RES O4 -2096 County would be conditioned upon the County retaining the existing Health Center at this location as a health center, and the properties would be transferred to the City in the event the County elected to close the Health Center. In the event the County declines to take ownership of the property, the properties shall be conveyed to the City and the City will retain ownership of the properties and continue using them for a public use. 5. The Executive Director and his or her designees are authorized and directed to execute all documents and take all actions necessary to implement this Resolution, including without limitation the execution of grant deeds, quitclaim deeds, certificates of acceptance, and all other necessary instruments, as applicable, subject to approval as to form by Agency Counsel. 6. Finds that the implementation of the Amended Long Range Property Management Plan through this Resolution itself does not commit the Successor Agency or the City of South San Francisco to any action that may have a significant effect on the environment and thus does not constitute a "project" subject to the requirements of the California Environmental Quality Act ( "CEQA "), pursuant to CEQA Guidelines section 15061(b)(3). At a meeting of the Joint Special Meeting City Council and Successor Agency on 8/10/2016, a motion was made by Richard Garbarino, seconded by Pradeep Gupta, that this Resolution be approved.
