Box 711 (City Hall, 400 Grand Avenue) South San Francisco, CA File #:16-676,Version:1 Report regarding a resolution approving the transfer of certain former Redevelopment Agency real property assets pursuant to the approved Long Range Property Management Plan and Health and Safety Code Section 34191.5 (Alex Greenwood, Economic & Community Development Director) RECOMMENDATION It is recommended that the Oversight Board for the Successor Agency to the Redevelopment Agency of the City of South San Francisco approve the transfer of certain former Redevelopment Agency real property assets,consistent with the Long Range Property Management Plan and Health and Safety Code Section 34191.5. BACKGROUND/DISCUSSION On June 29,2011,the Legislature of the State of California (“State”)adopted Assembly Bill x1 26 (“AB 26”), which amended provisions of the State’s Community Redevelopment Law (Health and Safety Code sections 33000 et seq.).Pursuant to AB 26 and the California Supreme Court decision in California Redevelopment Association,et al.v.Ana Matosantos,et al.,which upheld AB 26 (together with AB 1484,the “Dissolution Law”),the former Redevelopment Agency of the City of South San Francisco was dissolved on February 1, 2012. Dissolution Law governs the disposition of former Redevelopment Agency real property assets.At the time of its dissolution,the former Redevelopment Agency owned thirty-two parcels of real property.Pursuant to Dissolution Law,the Successor Agency to the Redevelopment Agency of the City of South San Francisco (“Successor Agency”)is responsible for the disposition of the properties in accordance with the procedures and requirements of Dissolution Law and the Long Range Property Management Plan (LRPMP). The LRPMP was prepared by the Successor Agency and approved by the Oversight Board for the Successor Agency to the Redevelopment Agency of the City of South San Francisco (“Oversight Board”)on May 21, 2015.On October 1,2015,the California Department of Finance (“DOF”)approved the Successor Agency’s LRPMP,which governs the disposition of all former Redevelopment Agency properties in South San Francisco.The LRPMP groups the properties into three categories:properties to be transferred for governmental use; properties that should be sold; and properties that are approved for redevelopment. The LRPMP identifies 10 properties that are approved to be transferred at no cost for various government or civic uses. These 10 properties include the following: 1.Seven properties are to be transferred from the Successor Agency to South San Francisco for various governmental uses at no cost. These seven properties include: ·Two properties that form a narrow pathway used for a segment of Centennial Trail (Former PUC City of South San Francisco Printed on 8/11/2016Page 1 of 4 powered by Legistar™ File #:16-676,Version:1 ·Two properties that form a narrow pathway used for a segment of Centennial Trail (Former PUC Properties); ·One small parcel that is part of the future expansion of Orange Memorial Park (80 Chestnut Avenue); ·Fire Station 61 (480 North Canal); ·Land necessary for the future Caltrain Station Plaza (296 Airport Boulevard); ·A portion of the existing Miller Parking Garage (323 Miller Avenue); and ·The “Breezeway” that connects Miller Parking Garage and Grand Avenue (356 Grand Avenue). 2.Two properties are to be conditionally transferred to the County of San Mateo for governmental uses at no cost. These properties include 306 Spruce Avenue/472 Grand Avenue, to be used as the San Mateo County Health Center, and 468 Miller Avenue, the small surface parking lot that serves the San Mateo County Health Center. In the event that the County does not accept the transfer of these properties, or ceases to run a health center at this location, the properties are to be transferred to the City, at no cost, for governmental use. 3.One property is to be transferred to South San Francisco as part of an approved redevelopment project to construct a public library.This last property,which is designated in LRPMP as “Site A2b,”is discussed in more detail below. The nine parcels in Exhibit A to the attached resolution were specifically designated in the LRPMP to be transferred for government use and their grant deeds will include language restricting the use of the property to governmental/public use.The tenth property (as discussed in greater detail below)is a portion of a parcel identified for future development,but,as indicated in the LRPMP and City planning documents,the relevant portion is designated to be used as a public library.Therefore,this portion is to be transferred to the City in order to implement this civic use.All 10 of the properties described above would be transferred consistent with the LRPMP, and at no cost, as set forth in the LRPMP. SITE A2b - LIBRARY/COMMUNITY CENTER The LRPMP includes several properties that were acquired from the San Francisco Public Utilities Commission (PUC).Collectively,these properties are commonly referred to in planning documents as the “PUC Property” and are identified as properties appropriate for redevelopment.For planning purposes,the PUC Property is divided into Sites A1, A2, A3, B, and C, as shown in Attachment 1 (PUC Site Map). Site A2 is a narrow,63,992 square feet strip of land fronting along El Camino Real at Chestnut Avenue (including portions of APN 011-326-030 and 093-331-070)as shown and described in Exhibit B to the attached resolution. Site A2 is further divided into Sites A2a and A2b, each of which has 31,996 square feet. During the past 10 years,Site A2b has consistently been identified as the site for a library in various City planning initiatives -such as the El Camino Real/Chestnut Avenue Area Plan.The El Camino Real/Chestnut Avenue Area Plan was specifically relied on when the LRPMP was prepared,and this civic library use is also identified in the LRPMP,as shown in Attachment 2 (Map of Site A2b).In addition,the Oversight Board met City of South San Francisco Printed on 8/11/2016Page 2 of 4 powered by Legistar™ File #:16-676,Version:1 identified in the LRPMP,as shown in Attachment 2 (Map of Site A2b).In addition,the Oversight Board met in closed session on March 15,2016 to discuss site A2b and in open session on May 17,2016 to receive a presentation on the Measure W Municipal Services Building Site Plan options which included the use of Site A2 for library and recreational use. It is important to note that Site A2 has a number of physical constraints that diminish its value and is why Site A2b has consistently been identified as a proper location for a civic library use.The marketability of the entire Site A2 is limited due to extreme grade variance dropping precipitously from the El Camino Real frontage, environmental condition and also due to the underground BART facility.However,the development of a library on Site A2 will benefit the taxing entities through an increase in property tax revenues for the surrounding PUC parcels and will make these properties more attractive to developers and residents. For instance,libraries and other similar civic and recreational uses have shown to make a positive impact in raising property values in surrounding neighborhoods.According to the American Planning Association (“APA”),civic facilities such as libraries have helped to induce property tax growth in communities such as Oakland,Atlanta,Chattanooga,Amherst,and many other communities of various sizes throughout the nation. Recent experiences in the Bay Area,such as the new libraries in Walnut Creek and Rockridge,appear to further support the link between attractive civic facilities and increased property values. The remaining portion of Site A2 (referred to as Site A2a,see Attachments 1 and 2),would be transferred for redevelopment consistent with the LRPMP at a later time.While Site A2a has similar value constraints as A2b, this portion was not designated as a site for a civic use in the LRPMP,but rather redevelopment consistent with an approved redevelopment plan.On March 15,2016,the City,the Successor Agency,and the Oversight Board met in closed session to negotiate the disposition of this portion within the former PUC properties. CONCLUSION With the LRPMP approved,Successor Agency staff is working to implement the LRPMP by disposing of assets.Per Senate Bill 107,California Health and Safety Code section 34191.5(f),actions to implement the disposition of property pursuant to an approved LRPMP does not require review by the DOF.Adoption of the resolution would consistent with the LRPMP.The attached resolution approves the conveyance of certain former Redevelopment Agency assets to the City of South San Francisco for governmental and public use. Their conveyance will be relatively straightforward transactions including the execution of Quitclaim Deeds, Certificates of Acceptance, and all other necessary instruments, as applicable. It is recommended that the Oversight Board for the Successor Agency to the Redevelopment Agency of the City of South San Francisco,State of California,consistent with the Long Range Property Management Plan, approves, at no cost, the transfer of 10 properties as described in this report. Box 711 (City Hall, 400 Grand Avenue) South San Francisco, CA File #:16-678,Version:1 Resolution approving the transfer of certain former Redevelopment Agency real property assets pursuant to the approved Long Range Property Management Plan and Health and Safety Code Section 34191.5 WHEREAS, on June 29, 2011, the Legislature of the State of California (the “State”) adopted Assembly Bill x1 26 (“AB 26”), which amended provisions of the State’s Community Redevelopment Law (Health and Safety Code sections 33000 et seq.); and WHEREAS, pursuant to AB 26 and the California Supreme Court decision in California Redevelopment Association, et al. v. Ana Matosantos, et al., which upheld AB 26 (together with AB 1484, the “Dissolution Law”), the former Redevelopment Agency of the City of South San Francisco was dissolved on February 1, 2012; and WHEREAS, the City of South San Francisco became the Successor Agency to the Redevelopment Agency of the City of South San Francisco (“Successor Agency”); and WHEREAS, pursuant to Health and Safety Code Section 34191.5(c)(2)(C), property shall not be transferred to a successor agency, city, county or city and county, unless a Long Range Property Management Plan (LRPMP) has been approved by the Oversight Board and the California Department of Finance (“DOF”); and WHEREAS, pursuant to the Dissolution Law, the Successor Agency prepared an LRPMP, which was approved by a resolution of the Oversight Board for the Successor Agency to the Redevelopment Agency of the City of South San Francisco (“Oversight Board”) on May 21, 2015, and was approved by the DOF on October 1, 2015; and WHEREAS, pursuant to the Dissolution Law and the LRPMP, certain real property located in the City of South San Francisco was transferred to the Successor Agency (“Agency Properties”); and WHEREAS, the LRPMP establishes a plan for transferring or selling the Agency Properties that were owned by the former Redevelopment Agency; and WHEREAS, the LRPMP identifies seven (7) parcels to be transferred from the Successor Agency to the City for governmental uses pursuant to Health and Safety Code section 34191.5(c); and WHEREAS, the LRPMP also identifies two (2) parcels to be conditionally transferred from the Successor Agency to the County of San Mateo for governmental uses pursuant to Health and Safety Code section 34191.5 (c); and WHEREAS, the LRPMP also identifies a portion of one (1) parcel to be transferred from the Successor Agency to the City as part of an approved redevelopment project plan, specifically the El Camino Corridor Project Plan and the El Camino Real/Chestnut Avenue Area Plan in order to construct a public library; and City of South San Francisco Printed on 9/21/2016Page 1 of 3 powered by Legistar™ File #:16-678,Version:1 WHEREAS, the portion of the parcel identified in the LRPMP to be transferred from the Successor Agency to the City as part of an approved redevelopment project plan is further indicated in the LRPMP as an appropriate location for a public library, but is otherwise significantly constrained in its sale or development potential by its environmental conditions; and WHEREAS, the implementation of the amended LRPMP through this Resolution itself does not commit the Oversight Board to any action that may have a significant effect on the environment and thus does not constitute a “project” subject to the requirements of the California Environmental Quality Act (“CEQA”), pursuant to CEQA Guidelines section 15061(b)(3). NOW, THEREFORE, BE IT RESOLVED that the Oversight Board of the Successor Agency to the Redevelopment Agency of the City of South San Francisco does hereby take the following actions: (1)Finds and determines that the above recitals are true and correct and the proposed actions are consistent with the LRPMP. (2)Approves the conveyance from the Successor Agency to the City of South San Francisco of the Agency Properties identified in the LRPMP as properties #4, #5, and #8 through #12, and as also described in Exhibit A. The transfer of these properties are conditioned on the requirement in the LRPMP that they remain in public use. (3)Approves the conveyance from the Successor Agency to the City of South San Francisco of the library site portion of the former PUC property parcel A2, also identified as parcel A2b of property #6 in the LRPMP (APN 011-326-030), and as more specifically described in Exhibit B, for development consistent with an approved redevelopment plan, at no cost to the City. (4)Approves the conveyance from the Successor Agency to the County of San Mateo (“County”) of the Agency Properties identified in the LRPMP as properties #13 and #14, and as described in Exhibit A. The transfer of the properties to the County are conditioned upon the County retaining the existing Health Center at this location as a health center, and the properties will be transferred to the City in the event the County elects to close the Health Center. If the County declines to take ownership of the property, the properties will be conveyed to the City and the City will retain ownership of the properties and continue using them for a public use. (5)Authorizes and directs the Executive Director and any designees to execute all documents and take all actions necessary to implement this Resolution, including without limitation the execution of Grant Deeds, Quitclaim Deeds, Certificates of Acceptance, and all other necessary instruments, as applicable, subject to approval as to form by Agency Counsel and Oversight Board Counsel. (6)Upon transfer of the Agency Properties to the City and/or County, the Grant Deeds will include language restricting the use of the properties to governmental/public use. In the event that City or County as Grantee discontinues the restricted use or seeks to use the properties for a non-governmental/public purpose, the City or County shall enter into a compensation agreement with the San Mateo County Auditor-Controller or other appropriate entity or entities, providing that all net revenue from such non-governmental/ public use shall be distributed in the same manner as property tax, subject to then-current law respecting such distribution.
