said city acquire the use of a small

The work of constructing said small boat pier shall be
done at the location and upon the land hereinafter mentioned
and strictly in accordance with the plans and specifications
heretofore submitted by the wor~s engineer of said city for
s.~id work and hereby adopted for said ~ork and in accordance
with the agreement provided for in the notice required to be
given under this resolution. All of the said work and the
materials used in connection therewith shall be furnished
under the direction and to the satisfaction of the works engineer
of said city.
The City Council hereby ascertains that the general pre-
vailing rates of per diem wages and the general prevailing
rates for legal holiday and overtime work applicable to said
work to be done are as follows:

Positions not listed above will be allocated in accordance
with the definitions which appear in the special provisions, as
interpreted in the light of this classification.
The minimum wage paid to all skilled labor for which
rates are not shown above shall be not less than $1.50 per hour.
The minimum wage paid to all intermediate labor for which
rates are not shown above shall be not less than $1.40 per hour.
The minimum wage paid to all unskilled labor for which
rates are not shown above shall be not less than $1.40 per hour.
All classifications to be paid time and one-half for time
over eight hours, Saturdays and holidays and double time on Sundays.
Monthly rates are to be equal to the above based on a
176-hour working month.
The following are to be considered holidays: New Year's
Day, Decoration Day, Independence Day, Labor Day, Admission Day,
Thanksgiving Day, Christmas Day,
THE City Clerk is hereby directed to cause a notice in-
viting sealed proposals for doing said work and for furnishing
all the materials necessary therefor to be published by two.
insertions thereof, and not less than five (5) days apart in
"The Enterprise", a newspaper of general circulation, published
and printed in the City of South San Francisco, which notice
shall be substantially in the following form.
NOTICE Ih~VITING SEALED P~OPOSALS OR BIDS FOR THE
CONSTRUCTION OF A S~LALL BOA~ PIER IN THE CITY OF
SOUTH SAN F~CISCO AND FOR LEASING SUCH PIER TO
SAID CITY.
Notice is hereby given that sealed proposals or bids
will be received by the City Council of the City of South San
Fra~cisco on tile 17th day of November , 1947, at the
hour of 8 o'clock p.m., for doing the following public work in
said city, to wit:
The construction of a small boat pier on the land situate
in the City of South San Fra~icisco, County of San Mateo, State
of California, and hereinafter described.
The land hereinbefore referred to is all that certain
tract or parcel of land situate in the City of South San Francisco,
County of San ~ateo, State of California, and described as follows:
BEGINNING at a point which bears North 508.85 feet,
North 6~° ~5' East ~2.60 feet, North. 33° ~5' East 167.89 feet,
East 243.47 feet and South 190 feet more or less from the South-
easterly corner of that certain parcel of land acquired by Wildberg
Brothers, a description of which was recorded March 9, 1923, in
Volume 66 of Official Records at Page 381, San Mateo County Records;
thence from said point of beginning South l0 feet; thence East 260
feet; thence North 20 feet; thence West 260 feet; thence South l0
feet to the point of beginning.
All work of constructing such small boat pier shall be
done at the location shown upon the plans for said wor~ and
strictly in accordance with the plans and specifications here-
tofore adopted for said work. All such work and the materials
used in connection therewith shall be furnished under the direction
and to the satisfaction of the works engineer of said city.
Said City Council has ascertained that the general prevail-

The folloWing are to be considered holidays: New Year's

It sha'll be mandatory upon the contractor to whom the
contract ~s awarded, and upon any subcontractor under him, to
pay not less than the specified rates to all laborers, workmen
and mechanics employed by them in the execution of the contract.
The contractor shall forfeit as a penalty to the City of South
San Francisco Ten Dollars ($10.00) for each laborer, workman
or mechanic employed, for each calendar day, or portion thereof,
such laborer, workman or mechanic is paid less than the said
stipulated rates for any work done under said contract, by him,
or by any subcontractor under him.. And such contract shall con-
tain a stipulation to this effect, in accordance with the pro-
visions of Chapter 397 of the Statutes of California, 1931.
No bid will be accepted from any contractor who has not
been licensed in accordance with the provisions of an act of the
Legislature of the State of California entitled: "An act providing
for the registI'ation of contractors, and defining the term con-
tractor, providing the method of obtaining licenses to engage in
the business of contracting, anG fixing the fees for such licenses;
providing the method of suspension and cancellation of such licenses;
and prescribing the punishment for violation of the provisions of
this act", Chapter 791 of Statutes and Amendments of 1929, as
ame nd e d.
Notice is further hereby given that no contractor or sub-
contractor or agent or representative thereof shall knowingly
employ or cause or allow to be employed on the wor~ herein pro-
vided for any alien, except in cases of extraordinary emergency
caused by fire, flood, or danger to life or property.
The contractor or subcontractor, to whom a contract for
said work may be awarded, shall forfeit as a penalty to the City
of South San Francisco~Ten Dollars ($10.00) for each alien know-
ingly emPloyed~'in the execution of such contract, for each
calendar day, or portion thereof, during which such alien is per-
mitted or required to labor in violation of the provisiOns of
Article 4 of the Labor Code °f the State of California. A provision
to this effect shall be inserted in such contract.

contractor for each calendar day during which any workman is re-
quired or permitted to labor more than eight (8) hours in viola-
~ion of the provisions of said Article 3.
The contract to be awarded shalI contain a further stipula-
tion that the contractor, to whom such contract may be awarded,
shall use or supply only such unmanufactured articles, materials,
and supplies as may have been mined or produced in the United
States and only such manufactured articles, materials, and supplies
as have been manufactured in the United States, substantially from
all articles, materials or supplies mined, produced, or so manu-
factured, as the case may be, in the United States, excepting only
where such articles, materials or supplies from which they
are manufactured are not mined, produced or manufactured, as
the case may be, in the United States, as required by an act
of the Legislature of the State of California entitled: "An
act to require the use of materials and supplies substantially
produced in the United States, in public works and for public
purposes"~ Chapter 226 of the Statutes of California, 1933.
The successful bidder shall, within ten (10) days after
the award, enter into a contract with the City of South San
Francisco for the faithful performance of the work to be done
under said award. All sealed proposals or bids shall be
accompanied by a check payable to the City of South San Fran-
cisco, certified by a responsible bank for an amount Rich
shall not be less than ten (10) percent of the aggregate
of the proposal, or by a bond for the said amount and so payable,
signed by the bidder and two (2) sureties who shall justify be-
fore any officer competent to administer an oath in double said
amount over and above all statutory exemptions. If the proposal
be accepted and the contract awarded ann if the bidder shall
fail and neglect to execute a contract and give the bonds re-
quired, the sum mentioned in said checK, or the principal sum ·
of said bond, as the case may be, shall be liquidated damages
for such failure and neglect and shall be forfeited to and paid
into the treasury of the City of South San Francisco. The bidder
to whom the contract is awarded will be required to execute a
0ond for the faithful performance of his work in an amount equal
to fifty (50) percent of the amount of the undertaking with at
least two (2) responsible sureties in the full amount of the bond
each; and will also be required before entering upon the work to
furnish a good and sufficient bond, as required under the pro-
visions of Section 4,200 et seq. of the Government Code of the
State of California.
The successful bidder will be required to enter into an
agreement with the City of South San Francisco for the construction
of such small boat pier and in Which agreement such successful bid-
der shall agree to lease from said city the land hereinbefore des-
cribed for a period of four (4) years fz~om the date of such agree-
ment at the monthly rental of One Dollar (~i~l.00) per month, and
under which agreement the successful bidder will execute a lease
of said land, with such small boat pier to said city for the perio~
of three (3) years following the date of actual completion of the
construction of such pier. The a~nual i'ent under the lease to be
executed Hy such successful bidder to said city shall be an amount
of money which shall equal one-third (1/3) of the amount of the
bid of such successful bidder and shall be payable annually in
advance at the times following: 0ne-T~lird (l/Z) of the amount of
such bid shall become payable on the expiration of thirty-five
(Z0) days fro~ the date of actual completion of construction of
such pier; one-third (1/3) of the amount of said bid shall become
payable on the expiration of one (1) year and thirty-five
days following the date of such completion; and one-third (1/3)
of the amount of such bid shall b~come due and payable on the
expiration of two (B) years and thirty-five (~) days from the
date of such actual completion. The lease to be executed by
such successful biader to said city, under the agreement above
mentioned, s~all provide that said City of South San Francisco
shall have the option and privilege of purchasLr~g such small boat
pier for the sum of One Hundred Dollars (.-~100.00), provided that
said city shall~have given such successful bidder notice of its
election to exez~cise such option within the last ~onth of the
term of the lease to b.e executed by such successful bidder to
said City of South San Francisco.
Plans, specifications and proposal sheets may be obtained
at the office of the wor~s engineer of said City of South San
Franieco, in the City Hall of said city, in South San Frar~cisco,
Califo mia.
Sealed proposals or bids will be delivered to the City
Clerk on or before 8 o'clock p.m., on I¥~onday, the 17th day
of November , 1947.
All sealed proposals will be opened by said City Council
in public session on ~onday, the 17th day of November ,
194~', at 8 o'clock p.m., in the Council Chamber of said City
Couneil.
$~id City Council reserves the right to reject any and all
bids.
