HomeMy WebLinkAboutReso 2564-1958 Signed Copy(Harbor Way Assessment) RESOLUTION NO, 2564 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DECLARING THAT INVESTIGATION PROCEEDINGS ARE NOT REQUIRED IN CONNECTION WITH THE IMPROVEMENT OF HARBOR WAY FROM ITS NORTHERLY TERMINUS AT EAST GRAND AVENUE, IN SAID CITY, AND EXTENDING SOUTHERLY THEREFROM TO THE IMPROVED PORTION OF SAID HARBOR WAY AT THE NORTHERLY EDGE OF THE SUBDIVISION KNOWN AS "SOUTH SAN FRANCISCO INDUSTRIAL PARIC' BE IT RESOLVED by the City Council of the City of South San Francisco, California, that: WHEREAS it is the intention of said City Council to make the following improvements in and for said city, to-wit, the improvement of the proposed extension of Harbor Way from the northerly terminus thereof, at East Grand Avenue in said City, and extending southerly therefrom to the improved portion of said Harbor Way at the northerly edge of that certain subdivision known as "South San Francisco Industrial Park", such work of improvement to consist of all the following: 1. a) The grading and preparation of the subgrade for pavement; b) The construction and installation of standard curb and gutter; c) The construction and installation of concrete sidewalks; d) The construction and installation of reinforced concrete pipe storm drains; e) The construction and installation of standard storm water catch basins; f) The construction and installation of pavement consisting of an eight (8)-inch crusher-run base with plant-mixed surface; and 2. The performing of all work auxiliary to any of the above which may be necessary to complete the same; and 3. The acquisition of such lands, or rights-of-way, or such existing improvements as shall be necessary; and WHEEEAS the owners of more than sixty percent (60%) of all the property within the area proposed to be established as a special assessment district for the performance of the foregoing described work of improVement, which district shall be known as "Harbor Way Assessment District", have signed and filed with this City Council a written petition for the doing of said work and waiver of proceedings under the "Special Assessments Investigations Limitation and Majority Protest Act of 1931"; and WHEREAS the City of South San Francisco is the owner of a parcel of property lying within the area of the proposed special assessment district, NOW, THEREFORE, IT IS ORDERED, FOUND, AND DETERMINED AS FOLLOWS: 1. In view of the filing of the aforementioned written petition and waiver, which has been signed by the owners of more · than sixty percent (60%) of all the property within the proposed assessment districts no investigation proceedings are required by law to be hsd under the Special Assessment~Investigstions Limitation and Majority Protest Act of 1931. Accordingly, this City Council shall proceed under the provisions of the Municipal Improvement Act of 1913, as amended, and the Improvement Bond Act of 1915 to carry through the contemplated proceedings Without any further restrictions whatsoever by reason of the terms and provisions of said Special Assessment Investigations Limitation and Majority Protest Act of 1931. 2. The boundaries of the lands and of the districts of lands proposed to be specially assessed to pay the costs and expenses of such work and proposed improvement are generally described in · "Exhibit A", hereto attached and by this reference made a part hereof. 3. With respect to the parcel of land owned by the City of South San Francisco, as in the premises hereto ment±oned~ said City shall, just as in the case of any private party owner and in e the same manner~ bear a proportionate share of the burden of paying for the proposed work of improvement, with the amount of said City*s assessment being fixed in accordance with the benefits deriving to its said property. 4. The statute under which it is proposed to conduct proceedings for the proposed improvement is the "Municipal Improvement Act of 1913", as amended, and it is proposed to pay for said improvements by special assessment upon adjacent property upon an area basis with bonds to be issued as authorized under the "Improvement Bond Act of 1915". I hereby certify that the foregoing resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular on the 6th day of following vote: meeting thereof held January , 1958, by the AYES, COUNCILMEN NOES, ABSENT G. Ryan None None ATTEST: 52067 ECS :hj 1-6-58 BOUNDARY DESCRIPTION HARBOR WAY ASSESSMENT DISTRICT All that certain real property situate in the City of South San Francisco, County of San Mateo, State of California being more particularly described as follows: BEGINNING at a point in the southerly line of East Grand Avenue, said point being the northeasterly corner of that certain 15.743 acre tract described in the Deed from Metal & Thermit Corp., a corporation, to Grace F. Guerin, dated June 17, 1947 and recorded July 24, 1947 in Volume 1352 of Official Records of San Mateo County at page 373 (77876-G); thence from said Point of Beginning along the easterly and southeasterly boundary of said 15.743 acre tract 1051 feet, more or less, to its intersection with the northerly line of that certain 17.O09 acre parcel described as Parcel No. 2 in the Oeed from South San Francisco Land & Improvement Co., a corporation, to Southern Pacific Company, a corporation, dated June 7, 1950 and recorded June 13, 1950 in Volume 1876 of Official Records of San Mateo County at page 204 (64107-1); thence crossing said 17.009 acre parcel southeasterly in a straight line 175 feet, more or less, to a point in the southerly line of said 17.009 acre parcel, distant thereon easterly 180 feet, from the southeasterly corner of the lands described in the Deed from Southern Pacific Company, a corporation, to South San Francisco Land & Improvement Co., a corporation, dated dune 30, 1950 and recorded August i0, 1950 in Volume 1915 of Official Records of San Mateo County at page 514 (77691-1); thence easterly along said southerly line of the 17.OO9 acre parcel, 990 feet more or less, to a point on the westerly line of the lands, now or formerly, of the Growers Rice Milling Co.; thence southerly, along last said westerly llne and its production southerly, 352 feet more or less, to a point on that certain bulkhead line course delineated as "N 89'58~39'' W 2730.84 ft" on that certain map entitled "HARBOR LINES IN VICINITY OF SOUTH SAN FRANCISCO SAN FRANCISCO BAY CALIFORNIA" filed with the - i - EXHIBIT 52067 £ cs: hj ! -6-58 V San Francisco Harbor Line Board (Corps of Engineers~ U. Army), San Francisco, California on December 16, 1936 in File 1, Division 4, Sheet 14; thence westerly, along said bulkhead line course, 486 feet more or less to Point 16 as shown on said harbor line map; thence continuing southerly, along said bulkhead line, 395 feet more or less to Point 17 as shown on said map; thence leaving said bulkhead line and continuing southerly along the southerly prolongation of the last course 20.00 feet; thence S 89°59104"W 31.02 feet; thence northwesterly cur~ing to the right, tangent to the preceding course, with a radius of 338.35 feet & a central angle of i0°25~36'' an arc distance of 61.57 feet; thence tangent to the preceding curve, N 79°35~ 20" W 279.50 feet; thence S 89°55~28'' W 212.50 feet to the northeasterly corner of the lands described as Parcel 6 in the Deed from South San Francisco Land & Improvement Co. to City of South San Francisco, dated August 13, 1954 and recorded August 20, 1954 in Volume 2636 of Official Records of San Mated County at page 407 (79914-L); thence southerly, along the easterly line of said Parcel 6, IOO feet to the southeasterly corner thereof; thence westerly, along the southerly line of said Parcel 6, 100 feet to the southwesterly corner thereof; thence leaving said Parcel 6, westerly 56 feet more or less to the southeasterly corner of lands described in the Deed from South San Francisco Land & Improvement Co. to John P. ~P~rdy and John I.
