HomeMy WebLinkAboutReso 2565-1958 Signed Copy(Harbor Way Assessment) RESOLIYrION NO. 2565 A RESOLUTION OF THE CITY COUNCIL OF TBE CITY OF SoIYrH SAN FRANCISCO EMPLOYING ATTORNEYS FOR TB~ PREPARATION OF ALL LEGAL AND LEGISLATIVE DOCUMENTS PERTAINING TO PROCEEDINGS TO BE TAKEN IN CONNECTION WITH THE PROPOSED SPECIAL ASSESS- MENT DISTRICT TO BE KNOWN AS "H~RBOR WAY ASSESS- MENT DISTRICT" BE IT RESOLVED by the City Council of the City of South San Francisco, California, that whereas Messrs. Richard J. Dolwig and Robert D. Miller, Attorneys at Law, have heretofore been designated as legal counsel in connection with the undertaking of the special assessment proceeding specified in the title hereto, the employment of said attorneys is hereby ratified and confirmed and they are hereby employed to prepare all resolutions, notices, affidavits, and all other legal or legislative documents pertaining to the special assessment proceedings being undertaken for the improvement of a portion of Harbor Way, as the same is proposed to be extended northerly from the northerly boundary of that certain subdivision known as "South San Francisco Industrial Park" to East Grand Avenue. Such employment shall include the furnishing of opinions on the legality of the contract, the assessment, the bonds, and all other documents pertaining to said special assessment pro- ceedings, and all phases thereof. BE IT FURTHER RESOLVED that the compensation to which said attorneys shall become entitled and which shall be payable as an incidental expense is hereby fixed at two percent (2%) of the total cost of the aforesaid improvement proceedings, exclusive of all incidental expenses, it being expressly understood that the services of said legal counsel shall not include the undertaking of any eminent domain proceedings or any other litigation relative to said improvement proceedings and that the City of South San Francisco ' ,.:~TRAL RECORD~ FILE NO.: .... shall not be obli§ated for the payment of the compensation of said legal counsel otherwise than as herein provided for. The compensa- tion in this paragraph specified shall become due and payable either at the time that the bonds which may be issued and sold in connection with said improvement proceeding shall be delivered to the purchaser thereof, or, if no bonds shall be issued and sold, at the expiration date of the period for the payment of assessments to be levied in said improvement proceedings.
