HomeMy WebLinkAboutApndx C_NOP APPENDIX C NOTICE OF PREPARATION (NOP) AND COMMENTS NOTICE OF PREPARATION OF A SUBSEQUENT EIR FOR A PROPOSED UPDATE TO THE OYSTER POINT SPECIFIC PLAN AND RELATED GENERAL PLAN AND ZONING PROVISIONS To: Agencies, Organizations, and Interested Parties From: City of South San Francisco, Economic and Community Development Department Subject: Notice of Preparation (NOP) of a Subsequent Environmental Impact Report (EIR) in Compliance with Title 14, Sections 15082(a), 15103, and 15375 of the California Code of Regulations (CCR). The City of South San Francisco (City) is the Lead Agency under the California Environmental Quality Act (CEQA) for the proposed project identified below. The City has prepared and certified an EIR for the Oyster Point Specific Plan (OPSP) and related development, and will prepare a Subsequent EIR for the proposed project identified below: Project Title: Oyster Point Specific Plan Update/General Plan Amendment and Details for Phases II, III, and IV. The project location and a summary of the project description are included on the following page. Previous and Current Environmental Review: The Oyster Point Specific Plan (“OBSP”) and Phase I Project EIR (State Clearinghouse Number 2010022070, certified in 2011) addressed Phases II through IV of the OPSP on a programmatic level. The current proposal revises proposed uses at Phases III and IV (OPSP Update) and adds project-level detail for Phases II, III, and IV. To ensure that the proposed revisions are fully analyzed under CEQA, a Subsequent EIR will be prepared for the proposed OPSP Update in compliance with Title 14, Section 15162 of the CCR. An Initial Study has not been prepared. The Subsequent EIR will address all environmental topic areas and identify the extent to which revisions are required to analysis and conclusions of the previous EIR. The certified EIR for the OPSP and Phase I Project is available for review on the City’s website at weblink.ssf.net (click on “Planning”, then “Environmental Reports”, and then “Oyster Point Specific Plan”) and at the City of South San Francisco Planning Division, 315 Maple Avenue, South San Francisco, CA 94083. Agency/Public Comments: The City requests your comments regarding the scope and content of the environmental review to be conducted for the proposed project. Due to the time limits mandated by State law, your response must be sent at the earliest possible date but not later than 30 days after receipt of this notice. The City will accept written comments on this NOP between March 1, 2017 and March 30, 2017. Scoping Meeting: The Lead Agency will conduct a scoping meeting on Thursday, March 23, 2017, beginning at 1:00 PM, in the Annex Conference Room, 315 Maple Avenue, South San Francisco, California, at which agencies, organizations, and the public will have an opportunity to submit verbal comment. Please note that verbal comments are limited to three minutes per speaker. EIR Process: Following the close of the NOP comment period, a Draft Subsequent EIR will be prepared that will consider all environmental topic areas in Appendix G of the CEQA Guidelines and take into consideration NOP comments. In accordance with Title 14, Section 15105(a) of the CCR, the Draft Subsequent EIR will be released for public review and comment for the required 45-day review period. Following the close of the 45-day public review period, the City will prepare a Final Subsequent EIR that will include responses to all subst antive comments received on the Draft Subsequent EIR. The Draft Subsequent EIR and Final Subsequent EIR will be considered by the Planning Commission and City Council in making the decision to certify the EIR and to approve or deny the OPSP Update. NOP for Oyster Point Specific Plan Update and Details for Phases II, III, and IV Page 2 of 2 See Figure 2 Area Figure 1: OPSP Location Phase II Phases III & IV Figure 2: Current Proposal for OPSP Phases II, III & IV Project Location: The site of the OPSP is part of the City’s “East of 101” planning area, bound by the San Francisco Bay on the east and Highway 101 and railway lines on the west. The OPSP encompasses approximately 81 acres of land at the eastern end of Oyster Point and Marina Boulevards in South San Francisco. The currently proposed update would affect approximately 32.6 acres of the 81-acre OPSP area. Project Description: The Project Sponsor, Oyster Point Development, is proposing amendments to the South San Francisco General Plan and the OPSP (Chapter 20.230 of the South San Francisco Zoning Ordinance) and related project-level entitlements and development agreement to allow for the development of office/Research and Development (R&D) and a new mixed-use community on Phases II, III, and IV of the OPSP area. The programmatic OPSP originally envisioned a total of 1,750,000 square feet of office/R&D across phases II, III, and IV. The proposal for Phases III and IV would require modifications to the existing OPSP. The OPSP Update for Phases III and IV consists of approximately 1,472,000 square feet of mixed-use, including approximately 1,191 residential units and 22,000 square feet of flexible use retail and/or amenity space. The maximum dwelling unit density would be approximately 100 units/acre across a total of 12.4 acres. The proposed uses for Phase III and IV require amendments to the General Plan and OPSP, and each phase will require a Precise Plan (proposed to occur after approval of the OPSP Update). The proposal for Phase II is consistent with the existing programmatic OPSP and includes 1,070,000 square feet of office/R&D including approximately 28,000 square feet of flexible-use retail/amenity space across 20.2 acres. Phase II will require a Precise Plan that outlines the detailed design of the improvements (proposed to occur after approval of the OPSP Update). Although Phase II is not affected by the OPSP Update, project- level aspects of the infrastructure and open space for Phase II are included in the analysis to ensure integrated planning for the entire area. Phase I of the existing OPSP development, for which the City approved a Precise Plan in 2011, is not affected by the proposed modifications and is not included within the OPSP Update. BTW, Part of the Phase II development area is on the landfill. Please be aware, that CCR Title 27 21190 Post closure land use, new projects or developments on and or within 1000 feet of the waste is required to comply with the design requirements to mitigate Health and Safety impacts (landfill gas). A few of the buildings on the Phase II development are on the landfill. See the attached figure. I believe a clear established landfill permitted boundary would be beneficial to the redevelopment to establish separate district parcel or parcels that will define the landfill particularly as it relates to Phase II development plans.
