Resolution Authorizing the Filing of Argument in Favor of Formation of CFD 2017-01 (Public Services and Facilities) and Potential Rebuttal Argument WHEREAS,on December 4,2017,the City Council adopted Resolution #151-2017 calling a special landowner election for Community Facilities District, City of South San Francisco Community Facilities District No. 2017-01 (Public Services and Facilities); and, WHEREAS,the following special tax measure (“Measure”)will be voted on at a special election to be held in the City of South San Francisco on March 14,2018,at which there will be submitted to the qualified landowner voters within the City of South San Francisco Community Facilities District No.2017-01 (Public Services and Facilities) the following Measure: BALLOT MEASURE:Shall the City of South San Francisco (the “City”)be authorized to annually levy a special tax solely on lands within the City of South San Francisco Community Facilities District No.2017-01 (Public Services and Facilities)(the “CFD”)in accordance with the rate and method contained in the Resolution of Formation of the CFD adopted by the City Council of the City on December 4,2017,commencing in the City’s fiscal year 2018-19,to pay for the public services and the public facilities for the CFD described in said Resolution of Formation including to pay the costs of the City in administering the CFD,and shall the annual appropriations limit of the CFD be established in the amount of $1,500,000?; and, WHEREAS,pursuant to Elections Code Section 9286,the final date to submit arguments in favor or against the Measure is December 18, 2017; and, WHEREAS, arguments may be submitted by the City Council, a Councilmember, or the City as a voter; and, WHEREAS,if a ballot argument in favor of a Measure is filed by a member of the City Council,that argument will receive priority in selection, if more than one argument were filed. NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of South San Francisco that the City Council hereby takes the following actions: 1.Authorizes and directs the City Attorney to prepare an impartial analysis of the Measure showing the effect of the Measure. 2.___________________________is hereby authorized to submit a written argument in favor of the Measure,not to exceed 300 words,on behalf of the City Council.The argument may be signed by members of City of South San Francisco Printed on 1/2/2018Page 1 of 2 powered by Legistar™ File #:17-1209 Agenda Date:12/13/2017 Version:1 Item #:1. Measure,not to exceed 300 words,on behalf of the City Council.The argument may be signed by members of the City Council or bona fide associations or by individual voters who are eligible to vote.In the event that an argument is filed against the Measure,_______________________is also authorized submit a rebuttal argument on behalf of the City Council,which may be signed by members of the City Council or bona fide associations or by individual voters who are eligible to vote,who may be different from the persons who signed the primary argument. 3.Pursuant to California Elections Code Section 9285,when the City Clerk,or her designee,has selected the arguments for and against the Measure,which will be printed and distributed to the voters,the City Clerk, or her designee,shall send copies of the argument in favor of the Measure to the authors of the argument against,and copies of the argument against to the authors of the argument in favor.Rebuttal arguments shall be printed in the same manner as the direct arguments.Each rebuttal argument shall immediately follow the direct argument that it seeks to rebut.
