RESOLUTION APPROVING A WAIVER OF THE CHILDCARE
IMPACT FEE AT THE REQUEST OF BEACON COMMUNITIES,
INC., DEVELOPER OF THE ROTARY SENIOR HOUSING PROJECT
AT 300 MILLER AVENUE, IN THE AMOUNT OF $148,080.
WHEREAS, in January 2015, the City of South San Francisco (the "City ") and Rotary Plaza, Inc.
entered into an Exclusive Negotiation Rights Agreement (ENRA) establishing a mutual
understanding regarding the potential development of 300 Miller Avenue; and
WHEREAS, in April 2016, Beacon Communities, Inc. on behalf of Rotary Plaza, Inc. (the
"Developer "), received approvals from the City Council to construct a five - story, multi - family
residential development with 80 affordable senior housing units and one manager's unit (the
"Project "); and
WHEREAS, the 80 affordable units will be restricted to seniors with an income at or below 50
percent of the County of San Mateo area median income (AMI); and
WHEREAS, in April 2016, the City and the Developer executed a Development Agreement (DA),
which specified that certain development fees ( "Development Fees ") would be charged based on the
effective date of the DA; and
WHEREAS, Development Fees are due upon issuance of building permits or certificates of
occupancy for the Project, as are required by the South San Francisco Municipal Code ( SSFMC),
except as otherwise provided under the DA or other project approvals; and
WHEREAS, on November 14, 2001, the City Council adopted an ordinance establishing a Childcare
Impact Fee ( "Childcare Fee "); and
WHEREAS, the Childcare Fee is codified in SSFMC Chapter 20.310 and applies to new residential
and commercial development; and
WHEREAS, SSFMC Section 20.310.004 provides developers of affordable housing units and senior
housing units the option to request a waiver of the Childcare Fee; and
WHEREAS, developers may request a fee waiver for those units designated as low- or
moderate - income affordable housing, or senior housing units; and
WHEREAS, granting the fee waiver is at the sole discretion of the City Council; and

WHEREAS, the Developer requested a waiver pursuant to SSFMC Section 20.310.004 and Section
2.2(a) of the DA; and
WHEREAS, based on the fee schedule adopted by City Council Resolution 77 -2006 ( "A Resolution
Increasing the Child Care Facility Impact Fee in Accordance with South San Francisco Section
20.115.030(F) "), the Childcare Fee requested to be waived totals $148,080, which is calculated by
multiplying the number of senior, affordable units in the Project (80 units) by the per -unit fee for
developments over 18 dwelling units per acre ($1,851); and
WHEREAS, the project consists of 80 senior, affordable housing units, which will not increase
demand for childcare services within the City; and
WHEREAS, the Developer's existing senior housing developments provide benefits to
communities, including tutoring and mentoring children and integrating seniors into the community
at- large, and the new Project is anticipated to as well; and
WHEREAS, the City Council of the City of South San Francisco wishes to grant the requested
Childcare Fee waiver.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco
that a Childcare Impact Fee waiver in the amount of amount of $148,080 is granted to Beacon
Communities, Inc., developer of the Rotary senior housing project at 300 Miller Avenue.
At a meeting of the City Council on 9/12/2018, a motion was made by Pradeep Gupta, seconded by Karyl
Matsumoto, that this Resolution be approved. The motion passed.
