HomeMy WebLinkAboutOrd 1361-2005 ORDINANCE NO. 1361-2005 AN ORDINANCE AlVIENDING THE CITY OF SOlJTI-I SAN FRANCISCO ZONING MAP rro CHANGE l'HE LAND USE DESIGNATION OF 501 AND 543 FORBES BOULEVARD FROM PLANNED INDlTSTRIAL (P-I) TO GENENTECH RESEARCH AND DEVELOPMENT OVERLAY (GENEN1'ECH R & D OVERLAY DISTRIC1) ZONE DIS'TRIC'T WHEREAS, the properties are designated "Planned Industrial" in the 1999 General Plan; and, WHEREAS, the reclassification will not change the land use classification, approved uses or increase the approved density in the East of 1 01 Area over that analyzed in the South San Francisco General Plan Environmentall1npact Report; and WHEREAS, the City of South San Francisco Planning COlnlnission held a duly noticed public hearing July 21, 2005; and WHEREAS, on July 21, 2005, the Planning COlnlnission found that the above described reclassification will ensure internal consistency in the General Plan; and WHEREAS, the above described rezoning will ensure internal consistency in the General Plan; and WHEREAS, as required by the "Adlninistrative Procedure" (SSFMC Section 20.87) and the "Research & Development Overlay District Regulations" (SSFMC Section 20.39.040 (B) (iii), the following findings are made in support of the rezoning, based on public testilnony and Inaterials sublnitted to the City of South San Francisco Planning Division. a) The proposed project is consistent with the City's General Plan, which designates this site for Business and Technology Park use; b) The proposed project is compatible with the intent and purpose of the "Research and Developlnent Overlay District" (SSFMC Chapter 20.39.050 (a), (b) and (c)) in the City's Zoning Ordinance which provides that "Deve1oplnent standards are requirements of the underlying zoning district including, but not limited to, building setbacks, lot coverage and floor area ratio may be atnended for the properties to be reclassified;" c) The proposed project Ineets all standards of the "Genentech Research and Development Overlay District" (SSFMC Chapter 20AO). The project complies with the Purpose, Definitions, Design review, and Development standards and requirements of the Genentech Research and Development Overlay District; and WHEREAS, the above described rezoning will not change the land use classification, change the approved uses, or increase the approved density in the East of 101 Area over that which was analyzed in the South San Francisco General Plan Environmental Impact Report; and WHEREAS, the City has prepared a Negative Declaration in accordance with the provision of CEQA, as amended; and WHEREAS, on July 21, 2005, the Planning COlnmission took public testiInony and considered the information contained in the staff report, orally presented by City staff and recommended approval of the Negative Declaration; and WHEREAS, the City of South San Francisco Planning COlrunission held a duly noticed public hearing July 21, 2005 on the adequacy of the proposed amendment to the Zoning Map and recormnended approval of same. NOW THEREFORE, the City Council of the City of South San Francisco does hereby ORDAIN as follows: SECTION 1. AMENDMENTS The City Council hereby amends the City of South San Francisco Zoning Map for SOland 543 Forbes Boulevard by changing the zoning designation frOln Planned Industrial (P-I) to Genentech Research and Developlnent Overlay District (Genentech Rand D Overlay District). SECTION 2. SEVERABILITY If any provision of this ordinance or the application thereof to any person or circulnstance is held invalid, the remainder of this ordinance, including the application of such part or provision to other persons or circumstances shall not be affected thereby and shall continue in full force and effect. To this end, provisions of this ordinance are severable. The City Council of the City of South San Francisco hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause, or phrase hereof irrespective of the fact that anyone or more sections, subsections, subdivisions, paragraphs, sentences, clauses, or phrases be held unconstitutional, invalid, or unenforceable. SECTION 3. PUBLICATION AND EFFECTIVE DATE This Ordinance shall be published once, with the nmnes of those City Councihnembers voting for or against it, in the San Mateo TiInes, a newspaper of general circulation in the City of South San Francisco, as required by law, and shall become effective thirty (30) days frOln and after its adoption. * * * * * * Introduced at a regular meeting of the City Council of the City of South San Francisco, held the lOth day of August, 2005. Adopted as an Ordinance of the City of South San Francisco at a regular meeting of the City Council held the 24 day of August, 2005 by the following vote: AYES: Councilmelnbers Richard A.
