City Council conducted this meeting in accordance with
California Governor Newsom 's Executive Orders N-25-20
and N-29-20 and COVID-19 pandemic protocols.

ANNOUNCEMENTS FROM STAFF
Police Chief Azzopardi apprised Council and the community of a planned peaceful demonstration
scheduled on Thursday, June 4, 2020, at 11:00 a.m. in front of City Hall ending at the Municipal
Services Building, 33 Arroyo Drive. He joins police chiefs across the state in denouncing the
actions of the Minneapolis Police Department officers during the arrest and tragic death of Mr.
George Floyd. Police Chief Azzopardi acknowledged the community's desire for change and
indicated he would be participating in the march. He informed the community that there would be a
strong police presence to ensure that everyone involved was safe.
Council engaged in discussions about street closures, bus routes, social distancing, and police
presence. Police Chief Azzopardi responded to the Council's concerns and indicated that the South
San Francisco Chamber of Commerce informed downtown merchants of the planned
demonstration, and officers notified businesses on Chestnut Avenue.
LEGISLATIVE BUSINESS
Report regarding an urgency ordinance of the City of South San Francisco further enacting a
temporary moratorium on small business and nonprofit entity evictions due to nonpayment
of rent where the failure to pay rent results from income loss resulting from the Novel
Coronavirus (COVID-19) (Sky Woodruff, City Attorney)
City Attorney Woodruff presented the report and indicated that on April 8, 2020, the City Council
adopted an urgency ordinance that prohibited the eviction of small businesses and non -profits that
are unable to pay all of the rent due because of a demonstrated loss of income resulting from
COVID-19 pandemic. At the time that the City Council adopted the urgency ordinance, the County
of San Mateo implemented a similar prohibition on the eviction of residential tenants as part of its
efforts to protect public health. Both the county's order and the city's ordinance expired on May 31,
2020. Governor Newsom issued an order that suspended some of the state laws that conflicted with
local enactments, which prohibited evictions because of non-payment of rent initially set to expire
May 29, 2020, extended through July 28, 2020. San Mateo County has extended its moratorium on
residential evictions through June 2020. The proposed urgency ordinance extends the current
moratorium on evictions for nonpayment of rent by small business and nonprofit entities impacted
by COVID-19 through June 2020 to match the County. If the county further extends its order
because of local conditions related to public health, the city's ordinance would be extended to match
the county. Once the ordinance expires, small business or nonprofit entities must repay any back
due rent no later than 90 days following the expiration of the ordinance. Additionally, the small
business or nonprofit entity could use the ordinance as an affirmative defense in an unlawful
detainer action.

Ordinance No. 1600-2020, by roll call vote: AYES: Councilmembers Matsumoto, Nagales and
Nicolas, Vice Mayor Addiego and Mayor Garbarino; NAYS: None; ABSENT: None; ABSTAIN:
None.

Being no further business Mayor Garbarino adjourned the meeting at 5:16 p.m.
