CITY OF SOUTH SaN FKaNCISCO AND DEFINING THE POWERS
AND DUTIES OF CITY N~NAGER.
Section 1. The office of City l~anager of the City of
South San Francisco is hereby created. The city m~ager shall be
appointed by the city council solely on the basis 'of his executive
and administrative qualifications. The city manager shall hold
office during the pleasure of the city council.. No person elected
to membership in the city council shall, subsequent to such .election,
be eligible for appointment as city manager until one (1) year shall
have elapsed following the expiration of the last term on which he
was elected.
Section 2. In the absence of the city manager from
the city or in the event of his temporary disability to perfo~ the
duties of the office, the city council may appoint some properly
qualified person to perform the duties of the office of city manager.
Section 3. Upon his appointment to office, the city
manager shall file in the office of the city clerk a bond for the
faithful discharge of his duties, to be approved by said city council,
in such amount as may be fixed by the city council.
Section ~. The city manaf~er shall ~e the administra-
tive head of the city government, but ~der the direction ~d control
of the city council. He shall be responsible to the city co~cil for
the efficient administration of the affairs of the city which are
under his jurisdiction, in addition to his general powers as
administrative head, and not as a limitation thereof, it shall be
the duty of the city manager and he shall have power:
(1). To see that all laws and ordinances of said
city are duly enforced.

(2). To appoint, discipline and dismiss all officers
and employees of said city, excepting Such as hold office or employ-
ment under the provisions of Ordinance No. 216 of said city entitled:
"AN ORDINANCE OF THE CITY OF SOUTH SAW FRANCISCO CREATING AND
ESTABLISHING A PERSONNEL SYSTEM FOR SAID CITY", adopted by said
city council on the 15th day of December, 1941, the city planning
commission, the recreation commission, the library board, and the
personnel board.
(3). To transfer employees from one department to
another where legally permissible; and, where legally permissible,
to consolidate and combine offices, positions, departments and units~·
under his jurisdiction, with the consent of said city council.
(4). To exercise control over all departments and
divisions of the city government and over all appointive officers
and employees thereof, where legally permissible, subject to the
approval of said city council.
(5). To attend all meetings of the city council and
all meetings of all committees thereof, unless excused therefrom by
the city council or by the committee.
(6). To recommend to the city council for adoption
such measures and ordinances as be'may deem necessary or proper.
(7). To keep the city council advised at all times
as to the financial conditions and needs of the city.
(8). To prepare and submit an annual budget to the
city council.
(9). To prepare and recommend the salary plan to
the city council.
(lO). To purchase all supplies for alo departments
and divisions of the city government. No expenditure of money shall
be Submitted or recommended to the city council, except upon the
report and approval of the city manager.

(ll). To make investigations into the affairs of
the city and each department and division thereof; to make in-
vestigation~ with respect to all contracts and obligations in which
said city is a party.
(12). To investigate all complaints in relation to
alo matters concerning the administration of the government of said
city; to investigate the service required to be rendered by any
public utility in said city, and to see that all provisions of
franchises, permits and privileges granted by said city are faith-
fully observed.
(13). To exercise general supervision over all public
buildings, public parks, other public property which are under the
control and jurisdiction of the city council, excepting all such
property as may be under the control and jurisdiction of the recreation
commission of said city.
(l~). To devote his entire time during customary working
hours to the duties and interests of said city.
(15). To perform such other and additional duties and'
to exercise such other and additional powers as may be reasonably
delegated to him by ordinance or resolution of said city council.
Section 6. Except for the purposes of inquiry, and
recommendations with~respect to policy, the city council and its members
shall intrust the administrative service wholly to the city manager.
Neither the city council nor any member thereof shall give orders to any
of the subordinates of the city manager.
'Section 7. The city manager shall receive such salary
as the city council shall, from time to time, fix by resolution or by
motion.

Section $. If any section, subsection, sentence,
clause or phrase of this ordinance is for any reason held to be
invalid, such decision or decisions shall not affect the validity .
of the remaining portion of this ordinance. The city council
hereby declares that it would have passed this ordinance and each
section, subsection, sentence, clause or phrase thereof, irrespective
of the fact that any one or more sections, subsections, sentences,
clauses or phrases may be declared invalid.
Section 9. This ordinance shall be published by
one insertion in The Enterprise, a newspaper of general circulation,
published and circulated in said city and shall take effect and be
in force upon the expiration of thirty (30) days after its passage.

Passed and adopted as an ordinance of the City of
SoUth San Francisco at a regular meeting of the city council of the
City of South San Francisco, this 2nd day of May , 1949, by
the following vote:
Ayes, Councilmen: Victor Boido, Leo Ferko, Adolph Sani. Emilio Cortesi.
Noes, Councilmen: None
Absent, Councilmen: Chas. K. Elder
